Ðñ- ñthe›€former€spouse€could€rehabilitate€herself€sufficiently€to€live€in€the€manner€to€which€she€wasÏaccustomed€during€the€marriage.€€Ìà  àIn€this€case,€the€trial€courtððs€award€of€permanent€alimony€after€a€period€of€rehabilitativeÏalimony€was€based€on€the€finding€that€Wifeððs€prospects€for€rehabilitation€were€limited€because€ofÏher€depression,€past€employment€history,€and€the€possibility€of€fibromylalgia.€€As€in€òòò òHanoveró óóó,€theÐ 0 € Ðtrial€court€in€this€case€applied€the€factors€set€out€in€Tennessee€Code€Annotated€ðð€36„5„101(d).€€AfterÏthe€period€of€rehabilitative€alimony€ends,€and€the€trial€court€can€see€the€extent€to€which€Wife€hasÏrehabilitated€herself,€the€trial€court€may€decide€to€modify€or€eliminate€the€award€at€that€time.€€TheÏevidence€does€not€preponderate€against€the€trial€courtððs€factual€findings,€and€we€find€no€abuse€ofÏdiscretion€in€the€trial€courtððs€decision€to€award€alimony€òòin€futuroóó€at€the€end€of€the€rehabilitativeÐ à Ðperiod.Ìà  àHusband€argues€that€the€trial€court€erred€in€awarding€any€rehabilitative€alimony€at€all.€€HeÏargues€that€Wife€has€already€obtained€means€of€supporting€herself,€earning€approximately€$17,000Ïper€year€as€a€real€estate€agent.€€Consequently,€she€has€no€need€for€five€years€of€rehabilitativeÏalimony.€€Ìà  àHowever,€rehabilitative€alimony€may€be€awarded€for€reasons€other€than€to€permit€aÏfinancially€disadvantaged€former€spouse€to€obtain€job€skills.€€ð ðWhile€rehabilitative€alimony€may€beÏparticularly€appropriate€when€evidence€shows€that€the€disadvantaged€spouse€can€becomeÏeconomically€sufficient€by€further€education€or€job€skills€training,€the€award€of€rehabilitativeÏalimony€is€not€limited€to€those€specific€circumstances.ðð€òòò òQuarry€v.€Quarryó óóó,€1992€WL€141796,€at€*Ð P( #& Ð4€€(Tenn.€œApp.€June€25,€1992).›€€In€this€case,€the€trial€court€found€that€the€award€of€rehabilitativeÏalimony€was€supported€by€the€following€factors:ÌÓÓà8  à(1)€€the€relative€education€and€training€of€each€party;€(2)€the€ability€and€opportunityÏof€each€party€to€secure€such€education€and€training€to€improve€that€partyððs€earningÏcapacity€to€a€reasonable€level;€(3)€the€fact€that€Wife€suffers€from€depression€andÏdemonstrated€a€need€for€treatment€for€this€problem;€(4)€the€fact€that€Wife€has€notÏbeen€successful€in€real€estate€and€will€probably€need€to€go€into€another€line€of€workÏin€order€to€adequately€support€herself;€(5)€Wifeððs€monthly€expenses€outweigh€herÏcurrent€income€by€close€to€$800.00;€(6)€the€standard€of€living€the€parties€establishedÏduring€the€marriage;€and€(7)€the€extent€to€which€each€party€has€made€tangible€andÏintangible€to€the€marriage€as€monetary€and€homemaker€contributions.Ð Ð Ð  ÐÌÓIÓThe€trial€court€also€considered€the€fault€of€the€parties€in€causing€the€dissolution€of€the€marriage.ÏAfter€reviewing€the€record,€we€conclude€that€the€evidence€does€not€preponderate€against€the€trialÐ 09€48 Ðcourt's€award€of€rehabilitative€alimony€to€Wife€in€the€amount€of€$1,500€per€month€for€a€period€ofÏfive€years.€€The€decision€of€the€trial€court€on€this€issue€is€affirmed.€Ìà  àHusband€also€argues€that€the€trial€court€erred€in€awarding€$4,000€in€attorney€fees€as€alimonyÐ pÀ Ðòòñ* ñò òñ* ñòˆòin€solidoóˆóñ* ñó óñ* ñóó.€€Husband€argues€that€such€an€award€is€not€proper€where€the€former€spouse€receives€aÐ P   Ðportion€of€the€marital€estate.€€In€this€case,€Wife€was€awarded€marital€assets€valued€at€$141,785.€ÏHusband€contends€that€this€award€provides€Wife€with€sufficient€funds€to€pay€her€attorney€and€theÏ$4,000€for€attorneyððs€fees€award€was€error.€€However,€most€of€the€assets€awarded€to€Wife€were€non„¼liquid€assets.€€Moreover,€in€determining€whether€to€award€attorneyððs€fees,€the€trial€court€mustÏconsider€the€factors€listed€in€Tennessee€Code€Annotated€ðð36„5„101(d)€and€quotedòòò ò€óóó óabove.€€òòò òSeeÐ ° ÐHoughland€v.€Houghlandó óóó,€844€S.W.2d€619,€623€(Tenn.€App.€1992);òòò ò€Harwell€v.€Harwelló óóó,€612Ð à ÐS.W.2d€182,€185€(Tenn.€App.€1980).€€An€award€of€attorneyððs€fees€is€within€the€sound€discretion€ofÏthe€trial€court€and€will€not€be€disturbed€on€appeal€unless€there€is€a€showing€of€abuse.€ò òòòLyon€v.€Lyonó óóó,Ð P  Ð765€S.W.2d€759,€762„63€(Tenn.€App.€1988).€€We€find€no€abuse€of€discretion€in€the€award€of€€Ïattorneyððs€fees.€€The€decision€of€the€trial€court€is€affirmed€on€this€issue.Ìà  àWife€raises€one€issue€on€appeal,€the€trial€courtððs€determination€that€the€entire€interest€in€theÏPartnership€was€Husbandððs€separate€property.€€While€Husband€was€married€to€his€first€wife,€theyÏpurchased€an€interest€in€the€Partnership.€€This€interest€was€divided€between€Husband€and€his€priorÏwife€at€their€divorce.€€At€the€time€of€the€marriage€between€Husband€and€Wife,€Husband€owned€œanÏapproximate›€5%€interest€in€the€Partnership.€€During€the€marriage,€Husband€purchased€the€ex„wifeððsÏœinterest,€another€approximately€5%€interest.›€€Husband€acknowledged€that€this€interest€was€purchasedÏwith€Husband€and€Wifeððs€ð ðjoint€funds.ðð€Ìà  àTennessee€Code€Annotated€ðð€36„4„121€grants€the€trial€court€the€power€to€ð ðequitably€divide,Ïdistribute€or€assign€the€marital€property€between€the€parties€without€regard€to€marital€fault€inÏproportions€as€the€court€deems€œjust.ðð€€Tenn.€Code€Ann.€€ðð€36„4„121€(1996).›€€Therefore,€the€trial€courtÏwide€has€discretion€to€adjudicate€the€rights€of€the€parties€in€all€jointly€owned€property.€ò òòòWallace€v.Ð °1-0 ÐWallaceóóó ó,€733€S.W.2d€102,€106€(Tenn.€App.€1987).€œÐ 3à.2 Ðà  àIn€this€case,€the€trial€court€reviewed€all€of€the€assets€at€issue,€including€the€marital€home€andÏthe€Partnership€interest,€which€generates€approximately€$432€per€month€in€income.€€After€reviewingÏthe€evidence,€the€trial€courtððs€award€to€Husband€included€the€interest€in€the€Partnership€and€theÐ 09€48 Ðconcomitant€income€of€$432€per€month,€and€the€award€to€Wife€included€the€marital€home,Ïrehabilitative€alimony€and€thereafter€alimony€òòin€futuro€óóof€$200€per€month.€€It€should€be€noted€thatÐ à Ðcounsel€for€Wife,€in€his€closing€statement€at€trial,€referred€to€the€Partnership€interñ1 ñeñ1 ñsñ2 ñeñ2 ñt€and€state,€ð ðweÏsay€let€him€keep€that€because€that€will€go€to€help€him€pay€my€client€alimony.€.€.€.ðð€€While€the€trialÏcourt€awarded€considerably€less€permanent€alimony€than€requeasted€by€Wife,€in€reviewing€theÏoverall€division€of€marital€property,€we€cannot€say€that€the€evidence€preponderates€against€the€trialÏcourtððs€decision€on€the€Partnership€interest.€€The€trial€court€is€affirmed€on€this€issue.€›Ìà  àWife€also€requests€attorneyððs€fees€incurred€in€this€œappeal.€€Both€parties€on€appeal€haveÏprevailed€on€some€issues€and€not€on€others.€€Under›€the€circumstances€as€a€whole,€we€œdeny€theÏrequest€for€attorneyððs€fees€incurred€in€this€appeal.€Ìà
