OnSeptember1,1982,theTrialCourtenteredadivorcedecreeadoptinga ChildCustodyandPropertySettlementAgreementexecutedbythepartiesandproviding:   `  Thiscausecameontobeheardonthe2nddayofSeptember,1982,beforetheHonorableThomasA.Greer,Jr.,SpecialJudgedesignatedbyappointment,upontheDivorceBillheretobeforefiledinthiscause,upontheAgreedOrderpermittingawithdrawaloftheAmendmentstosaidDivorceDecreeandallowingthismattertobepresentedonthestatutorygroundsofirreconcilabledifferencesasallegedintheDivorceBill,uponthewrittenChildCustodyandPropertySettlementAgreementexecutedbytheparties,uponthetestimonyofwitnessespresentedinopenCourt,uponstatementofcounsel,andupontheentirerecordinthiscause,fromallofwhichtheCourtfindsthattheComplainant,VirginiaGrafWaddey,andtheDefendant,IraClintonWaddey,Jr.,haveexperiencedsuchirreconcilabledifferencesintheirmarriageaswouldrenderfurthercohabitationimproper. Itis,therefore,ORDERED,ADJUDGEDandDECREEDthatthebondsofmatrimonysubsistingbetweentheComplainant,VirginiaGrafWaddey,andtheDefendant,IraClintonWaddey,Jr.,beabsolutelyandforeverdissolvedandthattheComplainant,VirginiaGrafWaddey,begrantedanabsolutedivorceandbevestedwithalltherightsandprivilegesofanunmarriedperson. Itis,therefore,ORDERED,ADJUDGEDandDECREEDthattheChildCustodyandPropertySettlementAgreementasexecutedbythepartiesisinallrespectsapprovedandratifiedinfullandisincorporatedasapartofthisDivorceDecree,thesameasifcopiedhereinverbatim,andsaidAgreementshallbegivenfullforceandeffectinallrespectsbetweenthepartiesheretoasanOrderofthisCourt.       TheChildCustodyandPropertySettlementAgreementcontainedthefollowingprovision:   `  2. Mr.WaddeyagreestopaytoMrs.WaddeyasperiodicalimonyinfuturothesumofOneThousand($1,000)DollarspermonthwiththefirstofsaidpaymentsbeingmadeonorbeforeSeptember10,1982,andsubsequentpaymentsatmonthlyintervalsthereafteruntilthedeathofMrs.Waddey,theremarriageofMrs.Waddey,orMarch1,1996,whichevereventshallfirstoccur.  ӄ   Further,eachofthepartiesreservetherighttopetitiontheCourtforpropermodificationofprovisionsremainingwithinthejurisdictionoftheCourtuponachangeofcircumstance.     OnMarch29,1996,plaintifffileda PetitionforContemptandforModificationofAwardofSupportalleging:   `  13. Further,thePetitioner,inoraboutJuly10,1995,wasdiagnosedwithamalignanttumorwhichresultedinbilateralmastectomiesrevealingadditionalmalignantsites. 14. Asaresultofthisdiagnosis,Petitionerhasundergonetwobreastreconstructionsurgeriesandsixchemotherapytreatmentscausingprematuremenopauseandhotflashesresultinginfatigueduetosleepdisturbances. 15. Duetotheresectionofherabdominalmusclesduringthisreconstruction,Petitionernowsuffersabdominalweaknesswhichlimitsherphysicalactivities. 16. ThusfarPetitionerhasincurredapproximatelyFiftySixThousandDollars($56,000.00)inmedicalexpenses,someofwhichwascoveredbyhermedicalinsuranceunderan80/20PPOplanwithaOneThousandDollar($1,000.00)deductible. 17. Petitionersmedicalconditionwillrequirehertotakecertainmedicationsfortheremainderofherlifeaswellasadditionalphysicianvisitsandhasalreadyforcedhertospendsubstantialamountsoftimeawayfromwork. 18. Petitionersmedicalconditionhasseverelydiminishedherabilitytoearnalivingandcreatedamaterialandsubstantialchangeincircumstanceswhichwerenotinthecontemplationoftheparties,orbeforethisCourt,atthetimethisFinalDecreewasentered.     Thepetitionrequested:   `  4. ThattheCourtmodifyitsoriginalFinalDecreeandordertheRespondenttocontinuehisalimonyobligationintheamountofOneThousandDollars($1,000.00)permonthfortheremainderthePetitionerslifeoruntilsheremarries.     Thedefendantmovedtodismissforlackofjurisdiction. TheTrialCourtenteredanorderstating:   `  TheportionofMs.WaddeysPetitionforContemptandforModificationofAwardofSupportseekingtoextendorrevivethealimonyobligationofMr.WaddeywhichterminatedabsolutelybyitstermsonMarch1,1996,wasuntimelyfiledonMarch29,1996,andthatMr.WaddeysMotiontoDismissClaimsforModificationofAlimonyshouldbeGRANTED.     Plaintiffappealedandpresentedasingleissueasfollows:   ` I. Doesthedivorcecourthavejurisdictiontoentertainapetitionformodificationofalimonyinfuturoifthewifefilesherpetitionafterthepaymentterminationdate?Yes,theDivorceCourtretainsjurisdictionbecauseithasacontinuingstatutorypowertomodifythesettlementagreementastoalimonyinfuturo,andthepartiesspecificallyreservedwithinthesettlementagreementtherighttopetitiontheCourtformodificationintheeventofachangeincircumstances.     T.C.A.364101(11)makesirreconcilabledifferencesavalidcauseofabsolutedivorce. T.C.A.365101(a)(1)providesthatadivorcedecreemayprovideforthesuitablesupportandmaintenanceofeitherspousebytheotherspouse,theordertoremaininthecourtscontrol. T.C.A.365101(d)(1)provides   `  Itistheintentofthegeneralassemblythataspousewhoiseconomicallydisadvantaged,relativetotheotherspouse,berehabilitatedwheneverpossiblebythegrantingofanorderforpaymentofrehabilitative,temporarysupportandmaintenance.Wherethereissuchrelativeeconomicdisadvantageandrehabilitationisnotfeasibleinconsiderationofallrelevantfactors,includingthosesetoutinthissubsection,thenthecourtmaygrantanorderforpaymentofsupportandmaintenanceonalongtermbasisoruntilthedeathorremarriageoftherecipientexceptasotherwiseprovidedinsubdivision(a)(3).Rehabilitativesupportandmaintenanceisaseparateclassofspousalsupportasdistinguishedfromalimonyinsolidoandperiodicalimony.     Terminationormodificationofanalimonyawardafteradivorcedecreebecomesfinaldependsuponwhethertheoriginalawardwasinsolido,orlumpsumorinfuturo,orperiodic.Alimonyinsolidoisnotsubjecttochangeafterthedecreebecomesfinal.Themerefactthatlumpsumalimonyispayableininstallmentsisneitherconclusivenordeterminativeregardingitsstatueasinsolidoorinfuturoalimony.Phillipsv.Webster,Tenn.App.1980,611S.W.2d591. Theawardingofalimonyinsolidoininstallmentsisanacceptablepractice.Thedeterminativefactorindistinguishingbetweenalimonyinfuturoandalimonyinsolidoisthedefinitenessorindefinitenessoftheamountorderedtobepaid.򀀀Isbellv.Isbell,Tenn.1991,816S.W.2d735. InPhillips,supra,the1975divorcedecreeprovidedlumpsumalimonyof$100,000payableinspecifiedinstallments.In1977,thepartiesexecutedanagreementmodifyingthesecuritypledgedtosecurethesupport.Theagreementrefersto periodicalimonypayments.ThisCourtheldthatthequotedwordswereineffectivetotransformcourtorderedunchangeablelumpsumalimonyintoperiodicchangeablealimony. Inthepresentcase,bytheuniquewordingofthepropertysettlementagreementanddivorcedecree,auniquestatusoflumpsumalimonywascreated.Thatis,itwasagreedanddecreedthat,duringthetimeframeoftheinstallmentpayments,thealimonywouldbeconsideredperiodicandchangeable.Thespecialandunusualreservationofpowertochangewhatwouldotherwisebeunchangeableendedonthedateofthelastscheduledpayment.Aftertheexpirationofthetimefixedforinstallmentpayments,thealimonybecamelumpsumandunchangeable. Thisresolutionoftheproblemisnotentirelysatisfying,foritissubjecttothecharacterizationof makeshifting.However,thereverseofthisresolutionwouldproduceanevenmoreunsatisfactoryresult,foritwouldauthorizeatrialcourttoperpetuateitspowertochangelumpsumalimonyuntilthedeathorremarriageoftherecipient. ThejudgmentoftheTrialCourtisaffirmed.Costsofthisappealaretaxedagainsttheappellant.ThecauseisremandedtotheTrialCourtfornecessaryfurtherproceedings.
