DavidWashingtonisservingseventytoseventyfiveyearsforrape,burglary,grandlarceny,andpetitlarceny.Hehasbeenincarceratedsince1976andispresentlyhousedattheNortheastCorrectionalCenterinMountainCity.Aftertwentyyearsbehindbars,Mr.WashingtonquestionedthecalculationofhisparoleeligibilitydateandassertedthattheDepartmentofCorrectionhadmisfiguredhissentencereductioncreditsunderTenn.CodeAnn.4121236(1990).AftertheDepartmentsresponsetohiscomplaintprovedunsatisfactory,Mr.WashingtonfiledsuitintheChanceryCourtforDavidsonCountyrequestingthecourttocorrecthissentenceexpirationdateandtoawardhimthesentencereductioncreditstowhichhewasentitled. 0   ף RatherthanansweringMr.Washingtonspetitionfordeclaratoryjudgment,theDepartmentrespondedimmediatelybyfilingforsummaryjudgment.Insteadofspecifyingthegroundsforthesummaryjudgment,themotionmerelyaskedforasummaryjudgmentandrecitedthatgroundsforthemotionweresetoutinanaccompanyingmemorandumoflaw.Themotionreferredtonosupportingmaterialsofanytype. Mr.WashingtonmovedtostriketheDepartmentsmotionbecause theRespondentshavenotreflectedanyexhibitsorprooftojustifythatsaidcalculationofhis[sic]sentenceiscorrect.HealsocomplainedthattheState"did[not]...supplypetitionertheaffidavitofFayeClaudasreflectedontheirmemoranduminsupportofmotiontotheCourtas[i]ndicatedbycertificateofserviceonthepetitioner."Hesupportedtheseassertionswithanaffidavittothesameeffect.InitsordergrantingtheDepartmentsmotion,thetrialcourtrecitedthat [f]romthematerialsubmittedbythedefendantinsupportofitsmotionforsummaryjudgment,itappearstotheCourtthattheplaintiffssentencesandparoleeligibilityarecorrectlycalculated.Mr.Washingtonhasappealedtothiscourt.@ II.  Tenn.R.Civ.P.56.02expresslyprovidesthatadefendingpartyinadeclaratoryjudgmentactionmay,atanytime,moveforsummaryjudgmentwithorwithoutsupportingaffidavits.Whenadefendingpartymovesforasummaryjudgment,itbearstheinitialburdenofproducingsufficientevidencetosupportitsmotionandtosatisfythetrialcourtthatthematerialevidenceisundisputed,Byrdv.Hall,847S.W.2d208,213(Tenn.1993);Burgessv.Harley,934S.W.2d58,62(Tenn.Ct.App.1996),andthatitisentitledtoajudgmentasamatteroflaw.Andersonv.StandardRegisterCo.,857S.W.2d555,559(Tenn.1993). TheDepartmenthasnotshouldereditsburdenofproofinthiscase.Thetrialcourtsjudgmentrefersto materialsubmittedbytheDepartmentinsupportofitsmotionforsummaryjudgment;however,theappellaterecorddoesnotcontainthismaterial.OnJune24,1996,thiscourtorderedtheclerkandmastertoprepareandtransmitasupplementalrecordcontainingthematerialsupportingtheDepartmentsmotion.TheclerkandmastersubsequentlyfiledasupplementalrecordcontainingacopyoftheDepartmentsmemorandumoflawfiledwithitssummaryjudgmentmotion.ThismemorandumreferstoanaffidavitbyFayeClaud,butthesupplementalrecorddidnotcontainMs.Claudsaffidavit.Again,onApril30,1997,thiscourtorderedtheclerkandmastertocertifyandtransmitasecondsupplementalrecordspecificallytoconsistoftheaffidavitofFayeClaud,theDepartmentofCorrectionmanagerofsentenceinformationservices.OnMay20,1996,theclerkandmastercertifiedtothiscourtthatherofficehadnosuchaffidavit. Mr.Washingtonsverifiedpetitionputsatissuethematerialfactsconcerningthecorrectcalculationofhissentence.ThestatementsintheDepartmentsmotionandmemorandumoflawinsupportofsummaryjudgmentdonotconstituteevidenceofthefactsinMr.Washingtonscase,Statev.Dykes,803S.W.2d250,255(Tenn.Crim.App.1990);Pricev.MercurySupplyCo.,682S.W.2d924,929n.5(Tenn.Ct.App.1984),andthoselawyerwrittenstatementsalonedonotremoveallgenuineissuesoffactinthiscase.TherecordinitspresentstaterequiresthiscourttofindthattheDepartmenthasfailedtocarryitsburdenofprovidingcompetentevidenceuponwhichthetrialcourtcouldproperlyconcludethattherearenogenuineissuesconcerningthematerialfactsofthisdispute.Accordingly,wehavenochoiceotherthantovacatetheorderdismissingthecomplaint.@ III.
