Mr._Witt_Ԁarguesthattheburdenofproofshouldbeonhertoshowwhatherexpenseswere   becauseofherpracticeofdestroyinghercancelledchecks.Heinvokestheruleofevidencethat   whereapartyhasdestroyedevidence,eitherintentionallyornegligently,apresumptionarisesthat  theevidencewouldbeunfavorabletothepartydestroyingit._Hamann_Ԁv.RidgeToolCo.,539 l N.W.2d753(Mich.App.1995);Welshv.UnitedStates,844F.2d1239(6thCir.1988).But,wefind X thatunderthecircumstancesofthiscase,thefactthatMs._Witt_Ԁdestroyedhercancelledchecksdoes D notshifttheburdentohertoshowwhatshespenthermoneyon.Theevidencedoesnotshowthat 0p thecheckswereunavailablefromthebankandMs._Witt_Ԁproducedthechecksshewrotefromthe \ timeshewasrequestedtodoso.Herbankstatementsshowedcertainexpenditures,andshe H explainedcertainlargeitemsasattorneysfees,medicalanddentalexpensesforherselfandher 4 daughter,andherdaughtersschoolexpenses.     Werecognizethatapartymaybechargedwithdissipatingthemaritalassetsafterthe  separation.SeeWilliamsv.Williams,No.02A019208CH00236(Tenn.Ct.App.atJackson,filed  December21,1993).ButMs._Witt_Ԁhadtohaveaplacetostayifshefounditintolerabletostayin  themaritalhome.Shehadtopaytheutilitiesandprovidefoodherherself.Shepaidfortheseitems | withthemoneysheearnedherselfaftertheseparation.Inouropiniontheexpendituresidentified h intherecorddonotamounttoadissipationofmaritalassets,evenifsomeoneelseislivingwithher.
