ÐÌà ½ àThe€partiesðð€twelve„year„old€daughter,€Ô_ÔAlyssaÔ_Ô,€has€anxiety€disorder€and€sensory€integrationÐ ô$D # Ðdysfunction€which€results€in€temper€tantrums,€or€ð ðmeltdownsðð€as€referred€to€by€the€parties.€€Ms.Ð à%0!$ ÐÔ_ÔWoolmanÔ_Ô€testified€that€she€did€research€on€Ô_ÔAlyssaÔ_Ôððs€condition€and€has€had€success€with€Ô_ÔAlyssaÔ_Ô€inÐ Ì&"% Ðimplementing€behavior€modification.€€Ms.€Ô_ÔWoolmanÔ_Ô€testified€that€Ô_ÔAlyssaÔ_Ôððs€teachers€in€WilliamsonÐ ¸'#& ÐCounty€also€implemented€behavior€modification€which€resulted€in€improvements.€€Ms.€Ô_ÔWoolmanÔ_ÔÐ ¤(ô#' Ðtestified€that€she€has€had€to€call€Mr.€Ô_ÔWoolmanÔ_Ô€twice€to€handle€Ô_ÔAlyssaÔ_Ôððs€meltdowns.€€Ð )à$( Ðâ âÐ |*Ì%) Ðà ½ àMr.€Ô_ÔWoolmanÔ_Ô€testified€that€he€has€implemented€behavior€modification€by€putting€less€pressureÐ ° Ðâ âon€Ô_ÔAlyssaÔ_Ô€and€giving€her€more€latitude€in€her€choices.€€On€one€occasion,€Ô_ÔAlyssaÔ_Ô€hit€Mr.€Ô_ÔWoolmanÔ_Ô.€Ð œì ÐMr.€Ô_ÔWoolmanÔ_Ô€restrained€Ô_ÔAlyssaÔ_Ô€by€sitting€on€her€and€pinning€down€her€wrists.€€Mr.€Ô_ÔWoolmanÔ_ÔÐ ˆØ Ðtestified€that€he€did€not€place€any€weight€on€Ô_ÔAlyssaÔ_Ô.€€Mr.€Ô_ÔWoolmanÔ_Ô€testified€that€he€has€yelled€atÐ tÄ ÐÔ_ÔAlyssaÔ_Ô.€€Jessie€testified€that€Mr.€Ô_ÔWoolmanÔ_Ô€has€left€Jessie€alone€with€Ô_ÔAlyssaÔ_Ô€during€a€meltdown.€€Mr.Ð `° ÐÔ_ÔWoolmanÔ_Ô€denies€leaving€Jessie€alone€with€Ô_ÔAlyssaÔ_Ô€during€a€meltdown.€€Jessie€testified€that€Ô_ÔAlyssaÔ_Ô€hasÐ L œ Ðhit€her€siblings,€has€thrown€things,€and€has€tried€to€hurt€herself.€€Jessie€testified€that€Ô_ÔAlyssaÔ_Ô€acts€betterÐ 8 ˆ Ðat€Ms.€Ô_ÔWoolmanÔ_Ôððs€house.Ð $ t ÐÌà ½ àThe€children€have€lived€in€Mr.€Ô_ÔWoolmanÔ_Ôððs€house€since€at€least€five€years€prior€to€the€divorce.€Ð ü L  ÐMs.€Ô_ÔWoolmanÔ_Ô€testified€that€she€had€no€complaints€about€the€Williamson€County€School€District€orÐ è 8  Ðhow€they€were€handling€Ô_ÔAlyssaÔ_Ôððs€special€needs.€€Ms.€Ô_ÔWoolmanÔ_Ô€also€testified€that€Ô_ÔAlyssaÔ_Ô€is€anÐ Ô$  Ðinflexible€child€that€needs€the€least€amount€of€classroom€changes.€€Ms.€Ô_ÔWoolmanÔ_Ôððs€father,€who€livesÐ À  Ðin€Nashville,€Tennessee,€testified€that€he€has€a€close€relationship€with€the€children.€€Jessie€testifiedÐ ¬ü  Ðthat€she€preferred€to€live€with€her€mother.€€Jessie€testified€that€she€loved€her€father€but€that€she€needsÐ ˜è  Ðher€mother€right€now€and€does€not€feel€comfortable€in€her€fatherððs€house.€€Jessie€testified€that€herÐ „Ô  Ðfatherððs€house€is€unkept.€Ð pÀ ÐÌà ½ àFrom€our€review€of€the€record,€we€are€unable€to€find€that€the€evidence€preponderates€againstÐ H˜ Ðthe€trial€courtððs€finding€that€relocation€to€Illinois€would€not€be€in€the€best€interest€of€the€children.€Ð 4„ ÐAccordingly,€we€affirm€the€trial€courtððs€decision€refusing€to€allow€the€children€to€relocate€to€IllinoisÐ  p Ðwith€Ms.€Ô_ÔWoolmanÔ_Ô.€€€Ð  \ ÐÌà ½ àIn€addition€to€denying€Ms.€Ô_ÔWoolmanÔ_Ôððs€request€to€relocate€with€the€children,€the€trial€courtÐ ä4 Ðdeclined€to€modify€the€existing€custody€arrangement.€€In€child€custody€cases,€the€law€is€wellÐ Ð  Ðestablished€that€when€a€decree€awarding€custody€of€children€has€been€entered,€ð ðthat€decree€is€resÐ ¼  Ðjudicata€and€is€conclusive€in€a€subsequent€application€to€change€custody€unless€some€new€fact€hasÐ ¨ø Ðoccurred€which€has€altered€the€circumstances€in€a€material€way€to€make€the€welfare€of€the€childrenÐ ”ä Ðrequire€a€change€in€custody.ðð€€òòLong€v.€Longóó,€488€S.W.2d€729,€731„32€(Tenn.€Ct.€App.€1972)€(citingÐ €Ð ÐòòHicks€v.€Hicksóó,€176€S.W.2d€371€(Tenn.€Ct.€App.€1943)).€€In€other€words,€once€the€trial€court€hasÐ l¼ Ðmade€an€initial€determination€with€respect€to€custody,€it€cannot€entertain€a€subsequent€petition€toÐ X ¨ Ðmodify€custody€absent€a€material€change€in€circumstances€such€that€the€welfare€of€the€child€demandsÐ D!” Ða€redetermination.€€òòSee,€e.g.,€Ô_ÔMassengaleÔ_Ô€v.€Ô_ÔMassengaleÔ_Ôóó,€915€S.W.2d€818,€819€(Tenn.€Ct.€App.€1995).€Ð 0"€  ÐÌà ½ àThe€party€seeking€a€change€in€custody€has€the€initial€burden€of€showing€a€material€change€inÐ $X" Ðcircumstances€which€affects€the€welfare€of€the€child.€€òòSee€Harris€v.€Harrisóó,€832€S.W.2d€352,€353Ð ô$D #
