ðJacquelineðð),€the€only€child€of€the€parties.€ÏPlaintiff/Appellant,€Rozanne€F.€Wright€(ð ðWrightðð),€appeals€the€judgment€of€the€trial€courtÏawarding€her€attorneyððs€fees€in€the€amount€of€$3,000;€failing€to€award€her€costs€ofÏdepositions€incurred€because€of€defendant/appelleeððs,€Jan€H.€Schmidt€(ð ðSchmidtðð),Ïcounter€claim€for€sole€custody€that€was€dropped€before€proof€was€taken€at€trial;€failingÏto€require€Schmidt€to€€reimburse€her€for›€sums€spent€in€procuring€special€education€forÏJacqueline€prior€to€the€November€œ20,›€1996,€hearing;€failing€to€deviate€upwards€fromÏthe€child€support€guidelines€in€awarding€an€increase€in€support;€and€allowing€SchmidtÏto€pay€installment€payments€on€back€support€judgment€award.€€For€reasons€statedÏhereinafter,€we€affirm€the€judgment€of€the€trial€court€in€part€and€reverse€in€part.ÌÌà àThe€parties€were€divorced€on€July€21,€1986.€€œThere›€was€one€child€of€thisÏmarriage,€œJacqueline.›€At€the€time€of€the€divorce,€Jacqueline€was€sixteen€months€old.€ÏThe€Final€œDecree€provided,›€òòinter€aliaóó,€œthat›€Wright€was€granted€an€absolute€divorceÏfrom€Schmidt,€that€Wright€was€awarded€sole€custody€of€Jacqueline,€that€Schmidt€wasÏto€pay€$325€per€month€in€child€support€payable€œat›€$162.50€œon›€the€1st€and€15th€of€œeach›Ïmonth,€that€Schmidt€was€to€obtain€and€maintain€health€insurance€on€Jacqueline€andÏpay€one€half€of€Jacquelineððs€medical€expenses€not€covered€by€insurance,€that€SchmidtÏwas€to€make€and€maintain€Jacqueline€as€sole€beneficiary€of€all€life€insurance€that€wasÏin€effect€on€his€life€until€Jacqueline€reached€the€age€of€18€or€graduated€from€highÏschool,€and€that€Schmidt€was€to€pay€Wright€$4,296.13€which€was€one€half€of€theÏoutstanding€debt€incurred€by€the€parties€for€their€mutual€benefit€during€the€marriage.€ÏœThere›€is€evidence€as€to€a€private€agreement€entered€into€by€Wright€and€Schmidt€onÏAugust€15,€1987,€whereby€Schmidt€was€to€pay€Wright€a€lump€sum€of€$4,500€on€orÏbefore€August€21,€1987,€in€order€to€constitute€payment€for€various€monies€that€SchmidtÏhad€been€unable€to€pay€prior€to€said€agreement.€€In€any€event,€the€private€agreementÏstated€that€it€would€be€void€if€Schmidt€did€not€pay€the€amount€by€August€27,€1987.€ÌÌà àIn€April€of€1994€when€Jacqueline€was€in€third€grade,€she€was€state€certified€asÏlearning€œdisabled€in€word€recognition€and€written€expression€skills.›€€œIn›€May€of€thatÏsame€year,€Wright€secured€the€services€of€Dr.€Lois€Degler€to€evaluate€what€type€ofÏeducational€support€was€needed€to€assist€with€Jacquelineððs€learning€disability.€œDegler›Ïtutored€Jacqueline€twice€a€week€in€order€to€advance€her€reading€and€word€recognitionÍskills.€€œDegler›€continued€to€tutor€Jacqueline€until€May€of€1995.€€€Degler€charged€$40Ïper€hour€for€the€tutoring€sessions€with€Jacqueline.€€ÌÌà àThe€Metropolitan€Davidson€County€School€System€(ð ðMetroðð)€is€required€toÏconduct€a€meeting€which€is€composed€of€an€ð ðM„Team.ðð× ƒ1 ××  ×€€This€M„Team€is€composed€ofÏindividuals€œwho€evaluate›€the€educational€needs€of€a€particular€child€and€suggest€aÏplan€whereby€to€obtain€the€appropriate€education€for€œthe›€child€with€special€educationalÏneeds.€€Degler€accompanied€Wright€to€this€M„Team€meeting.€€œMetro›€œsought›€anÏevaluation€report€œon›€Jacqueline€to€œdefine›€her€educational€difficulties.€€œThis›€aided€in€theÏformulation€œof€an›€educational€plan€for€Jacqueline€that€would€be€appropriate€for€herÏspecific€educational€needs.€€œThe›€evaluation€revealed€that€Jacqueline€was€learningÏdisabled€in€the€areas€of€basic€word€recognition€œand›€written€expression€skills.€ÌÌà àIn€consulting€this€evaluation,€the€M„Team€proposed€that€Jacqueline€be€enrolledÏin€a€special€one€hour€writing€program€three€times€a€week.€€œIn›€order€to€do€this,ÏJacqueline€would€have€to€be€absent€during€a€œportion›€of€her€reading€class.€€œDegler›Ïconsulted€with€Wright€and€advised€her€that€this€proposal€would€not€be€acceptable.€ÏœThe›€M„Team€offered€for€someone€to€work€with€Jacqueline€on€reading€skills€at€someÏother€point€during€the€day,€but€Degler€once€again€advised€Wright€against€this€proposalÏstating€that€she€felt€it€was€not€acceptable.€€œDegler›€was€of€the€opinion€that€one„on„oneÏinstruction€was€appropriate€given€Jacquelineððs€particular€difficulties.€Ìà àÌà àAs€a€result€of€this€meeting€and€of€the€M„Teamððs€ð ðunacceptableðð€proposal,€WrightÏenrolled€Jacqueline€in€Montessori€Academy€in€the€fall€of€1994.€€œDegler›€continued€toÏtutor€Jacqueline€throughout€the€entirety€of€this€time.€€œAlthough€Wright›€and€Degler€feltÏthat€Montessori€Academy€was€an€œimprovement,›€œthey€did€not€believe€it€to€be€the€optimal›Ïœchoice€of€education€for€Jacqueline.›€€œConsequently,›€in€March€of€1995,€Wright€enrolledÏJacqueline€at€Benton€Hall€School.€€Benton€Hall€is€a€private€school€that€specializes€inÏteaching€children€with€special€education€needs.€€œThe›€tuition€at€Benton€Hall€was€$6,000Ïper€year.€€œMrs.›€Ritchie€Purcell,€the€principal€of€the€elementary€school€at€Benton€Hall,Ïtestified€via€deposition.€€€She€stated€that€Benton€Hall€was€the€optimal€education€forÏJacqueline.€€ÌÌà àWhile€at€Benton€Hall,€a€battery€of€tests€œwas›€performed€on€Jacqueline€much€likeÏthose€performed€on€her€by€the€Metropolitan€Davidson€County€School€System.€ÏœJacqueline›€was€11.5€years€old€at€the€time€of€testing.€€œThe›€test€scores€revealed€thatÏJacquelineððs€only€learning€disability€at€this€time€was€in€her€basic€reading€skills.€€œEvery›Ïother€aspect€of€Jacquelineððs€testing€fell€œwithin›€the€standard€range€for€œchildren›€her€age.€ÏœAdditionally,›€Jacquelineððs€report€at€Benton€Hall€School€œrevealed›€that€she€is€performingÏwell€in€her€studies.€ÌÌà àWright€filed€a€petition€to€increase€child€support€and€for€contempt€on€March€2,Ï1994.€€œIn›€the€petition,€Wright€alleged,€òòinter€aliaóó,€that€Schmidt€had€not€paid€child€supportÏas€ordered,€that€he€had€failed€to€provide€medical€insurance,€and€that€he€should€beÏenjoined€and€restrained€from€removing€Jacqueline€from€the€state€of€Tennessee.€€œAt€theÍtime,€there›€was€a€motion€for€permission€to€take€Jacqueline€out€of€the€state€ofÏTennessee€filed€on€or€about€June€17,€1994.€€œPursuant›€to€the€Order€of€June€24,€1994,Ïthe€trial€court€entered€an€order€setting€certain€visitation,€as€well€as€modifying€theÏrestraining€order€which€enjoined€and€restrained€Schmidt€from€removing€JacquelineÏfrom€Tennessee.€€œAn›€answer€to€the€petition€to€increase€child€support€and€for€contemptÏand€counter€petition€for€joint€custody€was€filed€on€October€19,€1994.€€œThereafter,›€onÏSeptember€21,€1994,€an€agreed€order€was€approved€for€a€temporary€interim€increaseÏin€child€support.€œÌ›Ìà àAn€amended€petition€to€increase€support€and€for€contempt€was€filed€on€May€3,Ï1995.€€œSchmidt›€filed€œan›€amended€€supplemental€counter„petition€on€May€17,€1996,Ïwherein€he€sought€sole€custody€of€Jacqueline.€€œWright›€filed€an€answer€to€this€amendedÏœcounter€petition›€on€September€6,€1996.€€œThere›€was€also€a€motion€to€require€Schmidt€toÏpay€one„half€of€the€extraordinary€educational€expenses€incurred€due€to€the€allegedÏspecial€œneeds›€of€the€child€filed€on€November€8,€1996.€ÌÌà àThe€trial€of€this€matter€was€set€for€November€20,€1996.€€At€this€hearing,€SchmidtÏreneged€on€his€petition€for€sole€custody€and€orally€amended€the€petition€to€be€oneÏrequesting€extended€visitation.€€œAlthough›€the€trial€was€not€completed,€the€trial€courtÏintended€to€take€proof€the€following€day€on€November€21,€1996.€€œThe›€trial€court,Ïhowever,€did€not€hear€the€conclusion€of€the€case€until€March€26,€1997.€€œPursuant›€to€theÏamended€order,€the€trial€court€specifically€found€that€the€appropriate€amount€of€childÏsupport€based€upon€Schmidtððs€gross€income€was€$513€per€month.€€œThe›€trial€courtÍfurther€ordered€21%€of€any€and€all€bonuses,€after€taxes,€paid€to€Schmidt€œto›€be€paid€toÏWright€as€reasonable€child€support.€€œAdditionally,›€the€court€found€Schmidt€in€willfulÏcontempt,€but€found€that€because€of€the€mitigating€circumstances€in€œthe›€cause,ÏSchmidt€should€not€be€sentenced€to€jail.€€The€court€awarded€Wright€child€supportÏarrearages€in€the€amount€of€$12,858.33€with€12%€interest€to€be€paid€out€in€monthlyÏinstallments€of€$128.58.€€œThe›€court€further€found€that€Wright€should€be€awardedÏ$645.05€for€funds€not€reimbursed€toward€the€medical€premiums.€€œWright›€was€alsoÏawarded€a€judgment€for€reasonable€attorneyððs€fees€in€the€amount€of€$3,000.€ÌÌà àœThe€parties€raised€the›€following€issues€œfor›€review€by€this€Court:ÌÓÓà8 àà8 à1.€€Whether€the€trial€court€abused€its€discretion€in€limiting€itsÏaward€of€reasonable€attorneyððs€fees€to€$3,000€in€thisÏlitigation.ÌÌà8 àà8 àTenn.€Code€Ann.€ðð€œ36„5„103(c)€provides:›à àÌÓÓà8 àà8 àœ(c)›€The€plaintiff€spouse€may€recover€from€the€defendantÏspouse,€and€the€spouse€or€other€person€to€whom€theÏcustody€of€the€child,€or€children,€is€awarded€may€recoverÏfrom€the€other€spouse€reasonable€attorney€fees€incurred€inÏenforcing€any€decree€for€alimony€and/or€child€support,€or€inÏregard€to€any€suit€or€action€concerning€the€adjudication€ofÏthe€custody€or€the€change€of€custody€of€any€child,€orÏchildren,€of€the€parties,€both€upon€the€original€divorceÏhearing€and€at€any€subsequent€hearing,€which€fees€may€beÏfixed€and€allowed€by€the€court,€before€whom€such€action€orÏproceeding€is€pending,€in€the€discretion€of€such€court.ÌÌÓÓÌà àThere€is€no€absolute€right€to€attorneyððs€fees,€but€the€award€of€attorneyððs€fees€inÏcustody€and€support€proceedings€is€familiar€and€almost€commonplace.€€òòSee€Deas€v.ÏDeasóó,€774€S.W.2d€167,€170€(Tenn.€1989).€€The€trial€court€has€a€wide€discretion€in€theÏaward€of€attorneyððs€fees€that€will€not€be€modified€except€upon€a€finding€of€an€abuse€ofÏdiscretion.€€òòSherrod€v.€Wixóó,€849€S.W.2d€780,€785€(Tenn.€Ct.€App.€1992).€€ÌÌà àConsidering€the€unchallenged€affidavit€submitted€by€counsel€for€Wright,€anÏinordinate€amount€of€time€was€spent€by€Wrightððs€counsel€in€this€action€not€onlyÏenforcing€a€decree€of€child€support€previously€ordered€by€the€court€but€also€inÏpreparing€for€litigation€over€Schmidtððs€amended€œcounter€petition›€for€sole€custody€filedÏwith€the€court€on€May€17,€1996.€€Wrightððs€counsel€testified€via€affidavit€that€he€spentÏapproximately€55€hours€in€defending€Schmidtððs€counter„petition€and€approximately€26Ïhours€in€prosecuting€Wrightððs€case.€€He€further€testified€that€his€rate€of€pay€was€$200Ïper€hour€for€a€total€of€$16,340€in€attorneyððs€fees.€€Apparently,€many€of€the€hoursÍexpended€by€Wrightððs€counsel€were€in€preparation€for€litigation€of€the€custody€issue€inÏSchmidtððs€œcounter€petition›€and€in€enforcing€the€child€support€award€previously€issuedÏby€the€trial€court.€€Considering€the€total€amount€of€time€spent€either€defendingÏSchmidtððs€sole€custody€counter„petition€or€prosecuting€Wrightððs€claims€for€arrearagesÏand€increases€in€child€support€and€in€light€of€Tenn.€Code€Ann.€ðð€36„5„103(c),€it€isÏunclear€whether€or€not€Wright€was€sufficiently€compensated€for€attorneyððs€feesÏnecessitated€by€Schmidt.€€Consequently,€we€reverse€the€judgment€of€the€trial€courtÏawarding€Wright€$3,000€in€attorneyððs€fees€and€remand€this€case€for€furtherÏproceedings€necessary€in€determining€appropriate€attorneyððs€fees.ò òòòÓ  ÓÌDiscretionary€Costsó óóóÌÓ  Óà àWright€contends€that€the€Trial€Court€erred€in€denying€her€motion€forÏdiscretionary€costs€for€the€depositions€taken€in€preparation€for€Schmidtððs€œcounterÏpetition›€for€sole€custody.€€Costs€were€requested€pursuant€to€Tennessee€Rules€of€CivilÏProcedure€54.04.€€After€reviewing€Wrightððs€request€for€said€discretionary€costs,€the€trialÏcourt€denied€the€motion.€€The€awarding€of€such€costs€is€a€matter€within€the€soundÏdiscretion€of€the€œtrial›€œcourt.›€€òòLock€v.€National€Union€Fire€Ins.óó,€809€S.W.2d€483Ï(Tenn.1991).€€There€is€no€evidence€in€the€record€to€indicate€the€œtrial›€œjudge›€abused€œher›Ïdiscretion.ÌÌÓ  Óò òòòPast€and€Future€Educational€Expensesó óóóÌÓ  Óà àConcerning€œthe€›€œissue€of€past,€present,€and€future€private€educational€expenses,›Ïwe€are€reviewing€a€finding€of€fact€by€the€trial€court.€€As€such,€we€must€conduct€ourÏreview€òòde€novoóó€upon€the€record,€accompanied€by€a€presumption€of€correctness€of€theÍfinding€of€the€trial€judge.€€Reversal€is€only€a€possibility€if€the€evidence€preponderatesÏagainst€the€finding€of€the€trial€judge€or€if€the€trial€judge€has€committed€an€error€of€law.€ÏTenn.€R.€App.€P.€13(d).€€Ìœà àIn›€the€case€under€submission,€Wright€contends€that€the€trial€court€erred€by€notÏordering€Schmidt€to€reimburse€Wright€for€the€monies€expended€for€private€educationÏcosts€prior€to€the€November€20,€1996,€œhearing€and€in€refusing€to€deviate€upward€fromÏthe€child€support€guidelines€in€order€to€allow€for€present€and€future€private€educationÏcosts.›€€We€disagree.€€ÌÌà àThe€M„Team€consisted€of€Shirley€Claridge,€the€school€psychologist;€theÏprincipal€of€the€school;€and€two€of€Jacquelineððs€teachers.€€There€was€simply€aÏdisagreement€between€Wrightððs€expert,€Dr.€Degler,€and€the€M„Team€concerning€howÏto€address€Jacquelineððs€learning€disability€in€word€recognition€and€written€language.€ÏBased€œupon›€the€evidence€in€the€record,€Jacquelineððs€intelligence€quotient€(IQ)€at€herÏfirst€testing€at€the€age€of€nine€was€111€for€verbal€IQ,€99€for€performance€IQ,€and€106€forÏthe€full€scale€IQ.€œThis›€places€Jacqueline€in€the€66%€percentile€and€well€within€theÏaverage€range€for€children€her€age.€€Thereafter,€when€Jacqueline€was€eleven€yearsÏand€six€months€old,€she€was€retested€with€the€identical€IQ€test.€€Her€performance€andÏscores€were€very€similar€to€those€obtained€at€her€first€testing.× ƒ2 ××  ×€€Additionally,€we€noteÏthat€Jacquelineððs€report€card€is€quiet€impressive€œand€replete›€with€mostly€Aððs€and€Bððs.€ÏWe€find€that€Jacqueline€is€a€bright€child€who€simply€has€moderate€difficulty€with€wordÏrecognition.€€œAfter€a€review€of€the€evidence€in€its€entirety,€it›€is€the€opinion€of€this€courtÍthat€Jacquelineððs€word€recognition€difficulties€did€not€merit€œextraordinary›€educationalÏexpenses€in€the€past€and€do€not€merit€such€expenses€at€the€present€time.€€The€trialÏcourt€found€that€Jacquelineððs€educational€difficulties€did€not€meet€the€standard€forÏð ðextraordinary€educational€needsðð€and€thereby€refused€to€order€Schmidt€to€partiallyÏpay€for€past,€present,€and/or€future€private€education.€€We€agree€and€affirmÏaccordingly.€€€€€€€€€€€€€€€€€œÌ›€€€€€€€€€ÌÓ  Óò òòòInstallment€Paymentsó óóóÌÓ  Óà àAt€trial,€the€trial€judge€allowed€Schmidt€to€make€payment€on€his€$12,858.33€inÏchild€support€arrearages€via€œmonthly€installment›€payments€œthat€were€the€equivalent€ofÏthe€interest›€that€would€accrue€on€such€an€amount.œ× ƒ3 ××  ×€€While€this€conclusion€is€quiteÏlogical€and€sensible,€it€does€not€follow€the€statutes€or€case€law€of€this€state.€€ÌÌà àThe€Tennessee€Supreme€Court€handed€down€an€opinion€in€òòHarrington€v.ÏHarringtonóó,€759€S.W.2d€664€(Tenn.€1988),€that€precisely€confronted€this€issue€ofÏinstallment€payments€for€child€support€arrearage€awards.€€That€Court€properly€pointedÏout€that€Tenn.€Code€Ann.€ðð€26„2„216(a)(1)€deals€directly€with€installment€payments€forÏmonetary€awards.€€Tenn.€Code€Ann.€ðð€26„2„216(a)(1)€provides:ÌÓÓà8 àà8 à(a)(1)€After€any€judgment€has€been€rendered€in€any€courtÏand€the€time€to€appeal€therefrom€has€elapsed€without€suchÏan€appeal€having€been€made,€the€judge€of€the€court€whichÏrendered€the€judgment€may,€either€before€or€after€theÏissuance€and€service€of€garnishment,€upon€written€consentÏof€the€parties€or€upon€written€motion€of€the€judgment€debtor,Íafter€due€notice€and€after€full€hearing€of€such€motion,€enterÏan€order€requiring€such€judgment€debtor€to€pay€to€the€clerkÏof€the€court€a€certain€sum€of€money€weekly,€biweekly€orÏmonthly€to€apply€upon€such€judgment.€€The€filing€of€suchÏmotion€by€the€debtor€shall€stay€the€issuance,€execution€orÏreturn€of€any€writ€of€garnishment€against€wages€or€salaryÏdue€the€judgment€debtor€or€any€other€funds€belonging€toÏthe€judgment€debtor€sought€to€be€substituted€to€theÏsatisfaction€or€payment€of€or€upon€such€judgment€during€theÏperiod€that€such€judgment€debtor€complies€with€the€order€ofÏthe€court.€€Such€motion€of€the€judgment€debtor€shall€beÏsupported€by€an€affidavit€stating€his€inability€to€pay€suchÏdebt€with€funds€other€than€those€earned€by€him€as€wages€orÏsalary,€or€received€from€other€sources€in€such€amounts€asÏto€necessitate€or€make€equitable€installment€payments,€theÏname€and€address€of€his€employer,€or€other€source€of€fundsÏand€amount€of€such€wages€or€salary,€and€the€date€ofÏpayment€thereof.ÌÌÓÓÌà àThis€procedure€was€obviously€not€followed€in€the€present€case.€€From€theirÏinception,€these€statutes€have€required€that€a€motion€to€pay€a€judgment€in€installmentsÏbe€filed€and€considered€by€the€trial€judge€only€after€the€judgment€against€the€debtorÏhas€become€final.€€òòHarrington€v.€Harringtonóó,€759€S.W.2d€at€667.€€Such€a€motion€cannotÏbe€heard€by€the€trial€judge€unless€it€is€supported€by€an€affidavit€of€the€debtor€stating€hisÏinability€to€pay€with€monies€except€for€those€ð ðearned€by€him€as€wages€or€salary,€orÏreceived€from€other€sources€in€such€amounts€as€to€necessitate€or€make€equitableÏinstallment€payments.ðð€€Tenn.€Code€Ann.€ðð€26„2„216(a)(1)€(Supp.€1997).€€WhenÏconsidering€a€motion€for€installment€payments,€the€trial€court€should€consider€all€theÏcircumstances€of€both€parties,€as€well€as€the€amount€of€the€judgment,€other€debtsÏowed€by€and€judgments€against€the€debtor,€the€amount€of€wages€earned€by€theÏdebtor,€other€funds€receivable€by€the€debtor,€and€the€exemptions€granted€by€theÍstatutes.€€òòId.óó€at€668.€€ÌÌà àIn€the€case€before€us,€at€the€request€of€counsel€for€Schmidt,€the€trial€courtÏordered€installment€payments€on€the€$12,858.33€child€support€arrearage€judgmentÏduring€the€very€hearing€at€which€the€trial€court€awarded€an€arrearage€judgment€for€thisÏsum.€€The€judgment€had€not€become€final.€€The€written€consent€of€the€parties€wasÏnever€secured.€There€was€no€written€motion€on€this€matter.€€No€affidavit€was€submittedÏby€Schmidt€that€met€the€requirements€of€Tenn.€Code€Ann.€ðð€26„2„216(a)(1)€as€seen€inÏòòHarringtonóó.€€There€was€no€consideration€of€the€financial€circumstances€of€Schmidt€orÏWright.€€No€hearing€on€such€a€motion€was€ever€conducted.€€The€requirements€of€Tenn.ÏCode€Ann.€ðð€26„2„216(a)(1)€and€òòHarringtonóó€seem€to€have€been€ignored.€€Additionally,Ïit€appears€on€the€face€of€the€record€that€the€installment€payments€set€by€the€trial€courtÏare€entirely€too€low€in€that€the€judgment€can€never€be€effectively€discharged€or€evenÏreasonably€reduced.€€It€further€appears€that€the€meager€installment€proceedings€wereÏirregularly€conducted.€€As€such,€€we€feel€justified,€in€our€discretion,€in€reversing€theÏjudgment€of€the€trial€court€on€this€issue.€€€Accordingly,€in€light€of€òòHarrington€óóand€Tenn.ÏCode€Ann.€ðð€26„2„216(a)(1),€we€reverse€the€decision€of€the€trial€court€granting€SchmidtÏthe€right€to€pay€his€child€support€arrearages€in€installment€payments€and€remand€to€theÏtrial€court€for€consideration€of€this€issue€pursuant€to€the€appropriate€procedure.€€€€€ÌÌà
