PlaintiffssingleissueforreviewbythisCourtis:   `   `  WastheCourtinerroringrantingdefendantsmotionfordismissal,therebeingdisputedissuesofmaterialfacttoberesolvedbyajury?   `     Therecordreflectsthefollowingundisputedfacts: In1986,plaintiffspurchasedahome,financedbyNationalMortgageCompany.Theloanagreementprovidedforaportionofeachinstallmentpaidtobecreditedtoanescrowaccounttopaytaxesandinsurance.Plaintiffspurchasedinsurancedirectlyandpaidforitwithoutchargingittotheescrowaccount.Asaresulttheescrowaccountdevelopedasurplus.Plaintiffsdemandedthatthesurplusbecreditedupontheprincipalofthesecureddebt,butthepartiescouldnotagreeupontheamounttobecredited.Plaintiffslegalcounseldemandedacorrectaccounting.Themortgagecompanythreatenedaccelerationoftheloanandforeclosureandengagedtheattorney,DavidMcMackin,todealwithplaintiffsclaims. OnMarch24,1995,plaintiffssuedthemortgagecompanyonly,fordamages,demandingajury.DavidMcMackinwasnotnamedasadefendant.Whiletheactionwaspending,plaintiffsfoundabuyerfortheirhomeandtheirattorneyaskedDavidMcMackin,counselforthemortgagecompany,fora payofffigure(theamountnecessarytosatisfytheϜmortgage).DavidMcMackinadvisedplaintiffscounselthathecouldnotprovidesuchafigurewhilethelitigationwaspendingbecausetherewerechargesdueforfeeofcounselasprovidedbythemortgage.CounselforplaintiffsnotifiedMr.McMackinthatthesuitwouldbedismissed.Mr.McMackinnevertalkedtoplaintiffsaboutthedismissal. OnMarch5,1996,plaintiffsmovedforleavetoaddBoatmensMortgageCompanyasadefendant. OnOctober6,1996,theTrialCourtoverruledthemotiontoaddBoatmensMortgageCompany. OnJanuary29,1997,theTrialCourtenteredanorderoverrulingplaintiffsmotiontocompeldiscovery,partiallygranting thedefendants𛀜motiontodismiss,otherwiseoverrulingϜ defendantsmotiontodismiss,reservingthequestionofthereasonablenessofattorneysfee,andgrantingaT.R.A.P.Rule9appeal. ThereisnorecordthatplaintiffspursuedtheRule9appeal.PlaintiffsfiledtheabovequotednoticeofappealonMarch11,1997. Plaintiffsfiledanarrativestatementoftheevidence,but,onApril23,1997,theTrialJudgesustaineda motionofthedefendantstostrikethestatementoftheevidence.TherecordcontainsnoevidencethattheplaintiffsrequestedthattheTrialJudgeperformhis highjudicialfunctionof settlingthebillofexceptions,T.R.A.P.Rule24(e)and(h),Andersonv.Sharp,195Tenn.274,259S.W.2d521(1953);Rosev.ThirdNationalBank,27Tenn.App.553(1945). TheorderofJanuary2,1996,overrulingthefirstRule60.02motionstates:   `   `  Becausetheplaintiffsdesiredtoputontestimonyinsupportoftheirmotion,thecourtscheduledanevidentiaryhearingat1:00p.m.onthatafternoon.Atoraboutthattimeanevidentiaryhearingwasheldwhereintheplaintiffsputonprooftosupporttheallegationsintheirmotionandthedefendantputonprooftorebutthoseallegations.AfterhearingthistestimonyandargumentofcounselitappearstothecourtthattheplaintiffshavefailedtocarrytheburdenofproofnecessaryunderRule60.02tosetasidetheagreedorderofdismissalthatwasenteredbythisCourtonMay30,1995.Specifically,thecourtfindsthattherewasnoevidenceofanyfraudormisconductonbehalfofthedefendantscounsel,DavidW.McMackin.Thecourtaffirmativelyfindsthatinallofhisdealingswiththeplaintiffs,DavidW.McMackinneverdidanythingtodeceivethemandwasinfactopenandforthrightaboutthepositionhewastakingonbehalfofhisclient,thedefendantinthiscase.   `     PlaintiffssuitagainstDavidMcMackinisbarredbythedoctrineofcollateralestoppelbecausetheplaintiffsareboundbythefinaljudgmentoftheTrialCourtintheirformersuitagainstthemortgagecompany.LovemanCo.v.Bayless,128Tenn.307,160S.W.2d841(1913);Fourakrev.Perry,Tenn.App.1983,667S.W.2d483. AppellantsciteCollinsv.Binkley,Tenn.App.1988,750S.W.2d737,whereinaϜlawyer,whoknewthatplaintiffsweredependinguponhimtoprepareavalidandeffectivetransferoftitle,madeanerrorintheformofacknowledgment.Thecaseisdistinguishableuponthefacts. InStinsonv.Brand,Tenn.App.1987,738S.W.2d186,citedbyappellants,thelawyersforthesellerdeniedanydutytothepurchasers,buttheyadmittedthattheyintendedtochargethepurchaserforpreparingthedocumentsoftransfer,andoneofthelawyerswasnamedastrusteeinthetrustdeed.Thecaseisdistinguishableuponthefacts. Inthepresentcase,theplaintiffs,thesellers,werenotjustifiedinrelyingupontheattorneyforthecompanyholdingthemortgageontheirproperty,especiallywhentheywereplaintiffsinapendinglawsuitagainstthemortgagecompanyaboutoneoftheveryitemsofinformationimpartedtothembythelawyerforthemortgagecompany;andtheywererepresentedbycounselinthatpendinglawsuit.Noevidenceisfoundtosupportajuryverdictorjudgmentagainsttheonlydefendant,DavidMcMackin.Theotherdefendantisnotapartytothisappeal. ThejudgmentoftheTrialCourtisaffirmed.Costsofthisappealaretaxedagainstappellants.ThecauseisremandedtotheTrialCourtforfurthernecessaryproceedings.
