InSeptember1994,hisprobationwasrevokedwhenthetrialcourtfoundthathehadviolatedthetermsofhisprobationbybeingconvictedofdrivingundertheinfluenceandfailingtopayrestitution.Atthattime,hewasplacedintheTennesseeDepartmentofCorrectionIntensiveSupervisionProgram. InApril1996,appellantsprobationwasrevokedonceagain.Thetrialcourtfoundthathehadviolatedtheconditionsoftheintensiveprobationprogramby:(1)usingnarcotics;(2)violatingcurfew;(3)failingtopayϜsupervisionfees;(4)failingtoperformcommunityservicework;and(5)failingtopaycourtcosts,finesandrestitution.Thetrialcourtorderedthatappellantservethebalanceofhissentenceinconfinement.Fromthisruling,hebringsthisappeal.̜Ǜ@ TESTIMONYONDRUGTESTRESULTS  Appellantcomplainsthatthetrialcourterredinallowinghisprobationofficertotestifyatthehearingthatappellanthadtestedpositiveformarijuanaonsixoccasions.Heclaimsthatthereisnoevidencetoverifythe natureofthetestingprocessoritsreliability.Therefore,heclaimsthattherevocationofprobationbasedonthistestimonyamountstoadenialofdueprocess. Initially,wenotethattrialcounselmadenoobjectiontothetestimonyatthehearing.Therefore,theissueiswaived.Tenn.R.App.P.36(a);Statev.Gregory,862S.W.2d574,578(Tenn.Crim.App.1993). Furthermore,iftherewaserrorinallowingthetestimony,itwasharmlessinlightofappellantstestimony.Hecandidlyadmittedthathewasusingdrugs.Moreover,hetestifiedthatheviolatedseveraloftheotherenumeratedconditionsofintensiveprobation.Allowingtheprobationofficertotestifytothedrugtestresultsdoesnot affirmativelyappeartohaveaffectedtheresultofthehearing.Tenn.R.Crim.P.52(a).Thisissueiswithoutmerit.@ REVOCATIONOFPROBATION/CONFINEMENT  Inhissecondassignmentoferror,appellantarguesthatthetrialcourtabuseditsdiscretioninrevokinghisprobation.Hefurtherclaimsthatevenifrevocationwaswarranted,thetrialcourterredinorderingconfinementforthebalanceoftheoriginalsentence. Revocationofprobationissubjecttoabuseofdiscretionstandardofreview,ratherthanadenovostandard.Statev.Harkins,811S.W.2d79,82(Tenn.1991).Discretionisabusedonlyiftherecordcontainsnosubstantialevidencetosupporttheconclusionofthetrialcourtthataviolationofprobationhasoccurred.Id.Proofofaviolationneednotbeestablishedbeyondareasonabledoubt,andtheevidenceneedonlyshowthatthetrialjudgeexercisedaconscientiousandintelligentjudgment.Statev.Leach,914S.W.2d104,106(Tenn.Crim.App.1995). Inthepresentcase,thetrialcourtclearlyhadabasisforrevocation.Appellantsowntestimonyrevealsthathedidnotcomplywiththespecificconditionsoftheintensiveprobationprogram.Herefusedtocompletetherequiredcommunityservicework.Headmittedtousingmarijuanafrequentlyandusedanymoneyheearnedtoperpetuatehishabit.Hiseffortsatseekingdrugtreatmentwerenegligible,atbest.Furthermore,heviolatedhiscurfewandfailedtopaycourtcostsandrestitution. Ifthetrialcourtfinds thatthedefendanthasviolatedtheconditionsofhisprobationandsuspensionbyapreponderanceoftheevidence,thetrialjudgeshallhavetheright...torevoketheprobation...andcausethedefendanttocommencetheexecutionofthejudgmentasoriginallyentered...Tenn.CodeAnn.4035311(d);seeStatev.Duke,902S.W.2d424,427(Tenn.Crim.App.1995).Theevidencethatappellantviolatedthetermsofhisprobationisoverwhelming.Thetrialcourtdidnotabuseitsdiscretioninrevokingappellantsprobationandreinstatinghisoriginalsentence.Thisissuehasnomerit.
