Theappellantsoughtpostconvictionrelief.Heallegedthathereceivedineffectiveassistanceofcounsel.Thetrialcourtdeniedhispetition.ThisCourtaffirmedthatdenial.Theappellantfiledasecondprosepetitionattackingthelegalityofhissentence.Thetrialcourtdeniedreliefandappointedcounseltorepresenttheappellantonappeal.Onappeal,theappellantarguesinvoluntaryandunknowingplea.Uponreview,weaffirm. Inessence,theappellantchallengeshissentenceasillegal.Hemaintainsthata45yearsentenceisaRangeIIIsentenceforseconddegreemurder.He,however,didnotqualifyasaRangeIIIoffender,heargues. Thetrialcourtfoundthattheappellant'ssentencewaswithinRangeIII.ThecourtheldthatpursuanttoStatev.Mahler,735S.W.2d226,228(Tenn.1987),theappellant"waivedanyrightofappealintheguiltypleaproceedings,andexpresslyagreedtobesentencedwiththeclassificationandparoleeligibilityimposed."Thecourtalsonotedthat"thesentencewasnotillegalbecauseitwaswithintherangeimposedbylawforMurderSecond(inthiscase,15to60years).Id.at227."
