Thepetitionallegedthatoneofthevictimsdescribedhisassailantsasbeing"darkcomplected."Theappellantcontendsthathecouldnothavecommittedthecrimebecauseheis"very,verybrightcomplected."Thetrialrecordreflectsthatapoliceofficerrelatedthedescriptionsgivenbythewitness.Hetestifiedthatthewitnesstoldhimbothmenwere"darkcomplected."Consequently,thisevidencewasnotconcealedorwithheldbythestate.Giventhesefacts,thesuitwasbarredbythestatuteoflimitations.
