Drivingwhileintoxicated,afineof$500andconfinementforthirty(30)daysintheShelbyCountyCorrectionalCenter,twentyeightdaysofthesentencewassuspended; b.) Leavingthesceneofanaccident,afineof$500;and c.) Drivingafterhavingbeendeclaredahabitualvehicleoffender,aRangeI,standardoffendersentenceconsistingofa$500fineandconfinementforone(1)yearintheShelbyCountyCorrectionalCenter. Oneissueispresentedforreview.TheappellantcontendsthetrialcourtabuseditsdiscretionbyrefusingtosentencehimpursuanttotheTennesseeCommunityCorrectionsAct.Tenn.CodeAnn.4036101,et.seq.Afterathoroughreviewoftherecord,thebriefssubmittedbytheparties,andtheauthoritieswhichgoverntheissuepresentedforreview,itistheopinionofthisCourtthatthejudgmentofthetrialcourtshouldbesustained. TheStateofTennesseecontendstheappellanthaswaivedhisrighttoappeal.ThefallacyintheState'sargumentisthatthewaiveroftherighttoappealislimitedtotheagreedsentences.Inthiscase,thequestionofwhethertheappellantshouldbesentencedpursuanttotheCommunityCorrectionsActwasnotpartofthepleabargainagreement.Theagreementstates: SuspensionoftheDefendant'ssentenceis...[t]obedeterminedbytheCourt,afterahearing."Inshort,theappellantwasentitledtoappealasofrighttheissuepresentedforreview.ThedecisionscitedbytheStateofTennesseearefactuallydistinguishable. BaseduponadenovoreviewoftherecordpursuanttoTenn.CodeAnn.4035401(d),thetrialcourtdidnotabuseitsdiscretionbyrefusingtosentencetheappellantpursuanttotheCommunityCorrectionsAct.Theappellantcandidlyadmittedhehasbeenaddictedtodrugsfortwentyyears.Hehasbeeninamethadoneprogramforyears. Theappellanthasanextensiverecord.Itspansaperiodoftwentyyears.Hewasarrestedforatheftrelatedoffensein1974.Thepresentoffensesoccurredin1994.Hehasbeenconvictedoftheftunder$500,recklessdriving,leavingthesceneofanaccident,drivingwhileundertheinfluence,drivingwhilehislicensewaseitherrevokedorsuspended,possessionofacontrolledsubstance,twocounts,possessionofalegenddrug,andcarryingadeadlyweapon.Theappellantadmittedhehaddrivenamotorvehicleonnumerousoccasionsafterbeingdeclaredahabitualmotoroffender.Eachtimehedroveamotorvehicleaftertheentryoftheorderconstitutedaseparatecriminaloffense. Theappellanthasbeengrantedprobationonseveraloccasions.Thislargessehasnothelpedtheappellanttoreformhisproclivitytocommitcriminaloffenses.Iftheappellantisleftinthecommunity,theappellantwillcontinuetocommitcriminalacts.Theappellantspriorcriminalhistorysupportsthisconclusion.
