ðMikeðð€Coen,€was€a€co„workerÏof€Wilcox€and€attended€the€party€with€his€friend€Jeffrey€Allen,€the€otherÏdefendant.€€The€victim€arrived€at€the€party€at€approximately€1:00€a.m.ÌÌà ` àThe€party€was€noisy,€and€neighbors€called€the€police€several€times€toÐ Ö9&5; Ðcomplain.€€After€several€visits€by€officers,€the€party€ended.€€Everyone€left€theÏapartment€except€for€Wilcox,€the€victim,€and€a€friend€of€Wilcoxððs,€Brian€Fisher.€ÏWilcox€and€Fisher€decided€to€buy€more€beer.€€They€left€the€victim€alone€in€theÏapartment.€€As€he€was€leaving,€Wilcox€noticed€the€defendants€standing€byÏCoenððs€car.ÌÌà ` àAccording€to€the€victim,€the€defendants€then€re„entered€the€apartment€andÏaccosted€the€victim.€€They€forced€her€into€Wilcoxððs€bedroom,€and€while€AllenÏheld€her€down,€Coen€removed€her€shorts€and€underwear.€€The€victim€informedÏthe€defendants€that€she€was€menstruating,€and€Coen€responded€by€pulling€outÏthe€victimððs€tampon€and€throwing€it€across€the€room.€€Allen€placed€his€hand€overÏthe€victimððs€mouth€in€order€to€quiet€her€cries€for€help.€€The€victim€testified€she€bitÏAllenððs€hand€in€an€attempt€to€free€herself.€€The€victim€further€testified€that€both€ofÏthe€defendants€attempted€to€force€her€to€perform€oral€sex,€and€that€bothÏpenetrated€her€vagina€and€anus€with€their€fingers.ÌÌà ` àWhen€Wilcox€returned,€he€noticed€the€door€to€his€bedroom€was€closed.€ÏInitially€thinking€the€defendants€and€the€victim€were€engaged€in€a€voluntaryÏsexual€encounter,€Wilcox€did€nothing.€€However,€shortly€thereafter,€Wilcox€heardÏthe€victim€scream.€€He€forced€open€the€door€to€his€bedroom€and€found€AllenÏsitting€on€the€floor,€holding€his€hand€over€the€victimððs€mouth.€€Coen,€who€hadÏbeen€blocking€the€door,€stated€to€Wilcox,€ð ðWeððre€going€to€teach€the€whore€aÏlesson.ððÌÌà ` àWilcox€retreated€to€the€kitchen€to€enlist€the€aid€of€Fisher.€€Wilcox€returnedÏto€the€bedroom€with€Fisher,€again€having€to€force€it€open.€€Wilcox€told€theÏdefendants€to€leave,€which€they€did.€€On€their€way€out,€the€defendants€instructedÏWilcox€to€remain€quiet€about€the€incident.ÌÌà ` àA€neighbor€had€heard€the€earlier€screaming€and€called€the€police.€€ShortlyÐ Ì84: Ðafter€the€defendants€left,€police€officers€arrived€at€the€apartment.ÌÌà ` àThe€medical€evidence€offered€by€the€state€established€the€presence€ofÏbruising€on€the€victimððs€inner€thigh.€€The€bruising€was€probably€caused€within€twoÏ(2)€days€of€the€examination.€€The€medical€examination€did€not€reveal€anyÏevidence€of€trauma€to€the€vagina€or€anus.ÌÌà ` àThe€defense€presented€the€testimony€of€Coen€and€several€other€personsÏpresent€at€Wilcoxððs€apartment.€€Tressa€Vowell€and€Aaron€House€testified€that€theÏalleged€victim€was€ð ðvery€drunkðð€and€ð ðvery€flirtatiousðð€that€night.€€They€describedÏher€as€wearing€ð ðshort€shortsðð€and€a€ð ðtank€topðð€that€exposed€her€breasts.€€TheÏwitnesses€testified€that€the€alleged€victim€was€ð ðflirting€with,€touching,€whisperingÏthingsðð€to€males€in€the€apartment.€€Vowell€further€testified€that€she€saw€bruisesÏon€the€victimððs€arms€and€inner€thighs€that€night€prior€to€the€alleged€sexual€attack.€ÏBoth€Vowell€and€House€testified€they€remained€outside€the€apartment€untilÏWilcox€returned€and€heard€nothing€unusual€from€inside.€€Bronson€Woods,Ïanother€party€attendee,€testified€essentially€the€same€as€Vowell€and€House.ÌÌà ` àDefendant€Coen€testified€that€after€everyone€else€left€the€apartment,€theÏvictim€waved€him€into€Wilcoxððs€bedroom€where€she€was€kissing€Allen.€€The€victimÏadvised€Coen€she€had€a€tampon.€€When€Coen€removed€it,€the€victim€began€toÏscream€that€she€was€being€raped.€€Coen€stated€he€and€Allen€panicked,€and€AllenÏcovered€the€victimððs€mouth.€€Allen€was€trapped€under€the€victim€at€this€time.€€ItÏwas€at€this€time€that€Wilcox€entered€the€room.ÌÌà
