Theappellant'shistoryofcriminalconvictionsandcriminalbehaviorismorethansufficienttooutweighthemitigatingfactor,thattheappellant'sconductneithercausednorthreatenedbodilyinjury,andjustifytheimpositionofamaximumsentenceoftwoyears.Tenn.CodeAnn.4035114(1)(1994Supp.).Theappellant'shistoryofcriminalconvictionsincludesapriorfelonyconvictionforviolationoftheMotorVehicleHabitualOffendersActandsevenpriormisdemeanorconvictions.Additionally,atthesentencinghearing,theappellantadmittedtopastabuseofmarijuana. Theappellant'scriminalhistoryalsoweighsagainsttotalprobation. %   ׀Statev.Bonestel,871S.W.2d163,169(Tenn.Crim.App.1993).Specifically,theappellant'suseofmarijuanasincehisarrestfortheinstantoffensedemonstrateshispoorpotentialforrehabilitation.Id.SeealsoStatev.Bingham,910S.W.2d448,456(Tenn.Crim.App.1995);Tenn.CodeAnn.4035103(5)(1990).Moreover,theappellanthaspreviouslyreceivedsentencesinvolvingprobation,whichhavefailedtodetertheappellantfromfurthercriminalconduct.Id.Theappellant'sfailuretoappearathissentencinghearingontheoriginallyscheduleddatealsoindicatesthattheappellantisnotamenabletorehabilitation.Id.Furthermore,theappellantnowdeniesculpabilityfortheoffensetowhichhepledguilty.Statev.Dowdy,894S.W.2d301,306(Tenn.Crim.App.1994)("adefendant'scredibilityandwillingnesstoacceptresponsibilityfortheoffensearecircumstancesrelevanttodetermininghisrehabilitationpotential").Finally,theappellant'sstatementtothepresentenceofficer,thathewas"tiredofbeinghoundedbyOfficerSimerly,"reflectshisrefusaltoacceptresponsibilityforhisconduct.Id.
