Becausethepetitionerisnoteligibleforhabeascorpusrelief,weaffirmthejudgmentofthetrialcourt.  Thepetitionerwassentencedtoconsecutivetermsofthirtyandtwentyyears,effectivein1974,andoneconsecutivetermofthreeyears,effectivein1986.Allthreeofthesestatesentencesweretobeservedafterthepetitionerfinishedservingaprior,federalsentence.TheTennesseeDepartmentofCorrection(TDOC)setthepetitioner'sparoledatesseparatelyforeachsentenceusingguidelinesforcustodialparolesetforthinHowellv.State,569S.W.2d428(Tenn.1978)(althoughtheHowellcasewasdecidedfouryearsafterthepetitioner'ssentencebecameeffectiveandtwoyearsafterthepetitionerbeganserviceonthefirstsentenceofthirtyyears).Theoriginalparoledateonthethirtyyearsentencewassetfor1986.Atthatpointthepetitionerwasgrantedcustodialparoleonthethirtyyearsentenceandbegantoservehistwentyyearsentence.Thethirtyyearsentenceexpiredin1989.  In1994,fiveyearsaftertheexpirationofthethirtyyearsentence,theTDOCrecalculatedthepetitioner'sparoledateforhistwentyyearsentence.DeterminedwithoutthebenefitofcustodialparoleguidelinesinHowell,theresultwasacombinedparoledateforafiftyyearsentence.Thisnewparoledatewaslaterintimethantheoriginal;thus,theeffectoftherecalculationwasalongerperiodofincarceration.Thepetitionerwasgrantedcustodialparoleonthetwentyyearsentenceandhadbegunservinghisremainingthreeyearsentenceatthetimeoftherecalculation.  ThepetitionerfirstfiledaprosepetitionforadeclaratoryjudgmentinChanceryCourtofDavidsonCountyinwhichheobjectedtothecalculationofhisreleaseeligibilitydate.Thestatemovedtodismissthesuitinchancerycourtonthebasisthatthepetitionerhadfailedtostateaclaimonwhichdeclaratoryreliefcouldbegranted.Thechancerycourtdismissedthepetitionandthepetitionerappealed.WhileawaitingtheCourtofAppeals'decision,whichlateraffirmedthechanceryjudgment, 2   ׀thepetitionerfiledthispetitionforawritofhabeascorpusintheDavidsonCountyCriminalCourt,claiminghissentencehadexpired.Thestatemovedtodismissthehabeascorpuspetitionclaimingthat(1)theissuehadalreadybeendecidedinchancerycourtand(2)thecourtofappealshadjurisdictionoverissuesconcerningsentencecalculations.Thecriminalcourtheardargumentsonthemotionanddismissedthepetitionwithoutanevidentiaryhearing.  Thescopeofhabeascorpusreviewisnarrow.Thewritofhabeascorpus,codifiedatTenn.Code.Ann.2921101to130,willissueonlyinthecaseofavoidjudgmentortofreeaprisonerheldincustodyafterhistermofimprisonmenthasexpired.Stateexrel.Hallv.Meadows,389S.W.2d256,259(Tenn.1965).Unlikethepostconvictionpetition,thepurposeofahabeascorpuspetitionistocontestvoid,andnotmerelyvoidable,judgments.SeeStateexrel.Newsomv.Henderson,424S.W.2d186,189(Tenn.1968)."Apetitionercannotcollaterallyattackafaciallyvalidconvictioninahabeascorpusproceeding."Pottsv.State,833S.W.2d60,62(Tenn.1992). Habeascorpusactionmaybebroughtatanytimewhilethepetitionerisincarceratedtocontestanillegalconfinement.Archerv.State,851S.W.2d157,164(Tenn.1993).  Thepetitionerclaimsthathistwentyyearsentencehasnowexpired;heinsiststhathisthirtyyearsentencehasalsoexpired.Hedoesnot,however,assertthatheiseligibleforimmediatereleasefromcustody.Itiswellestablishedlawthathabeascorpusreliefisavailableonlytopersonseligibleforimmediatereleasefromcustody.Taylorv.Morgan,909S.W.2d17,20(Tenn.Crim.App.1995);Tenn.CodeAnn.2921122. 3   ׀Aprisonerdoesnotqualifyforhabeascorpusreliefsimplybecauseoneofseveralconsecutivesentenceshasexpired.Rather,hemustwaituntilhecontendsthathistotaltermofcustodyhasexpired.Stateexrel.Dickensv.Bomar,381S.W.2d287,289(Tenn.1964);Taylor,909S.W.2dat20;Solomonv.State,529S.W.2d743,747(Tenn.Crim.App.1975);Pulleyv.Hunt,440S.W.2d622,623(Tenn.Crim.App.1968).  Thepetitionermakesthefollowingargument:8 8 [H]abeascorpusreliefisappropriateinthiscase.Shouldappellant'scustodialparoledatebereinstated[,]thethirty(30)yearsentencewouldhaveexpiredin1992.Apetitionforawritofhabeascorpusisappropriateiftheinmate'ssentenceofimprisonmenthasexpired.MarkD.Archerv.State,851S.W.2d157(Tenn.1993).TheholdinginArcherdoesmandatehabeascorpusreliefwhen"adefendant'ssentenceofimprisonmentorotherrestrainthasexpired."Archerv.State,851S.W.2dat164.Thislanguage,however,doesnotmeanthataprisonermaybegrantedhabeascorpusreliefonanindividualsentencewhilecontinuingtoserveothersentences.Taylorclearlystandsforthepropositionthat"[t]hesolereliefavailableunderTennessee'shabeascorpusstatuteisdischargefromcustody."909S.W.2dat20.Becausethepetitionerwasnoteligible%  Ԁfordischargefromcustodyatthetimehefiledhispetition,heisnotentitledtorelief.  Wealsoobservethatthepetitionerhasclaimedthathissentencehasbeenmiscalculated.Whilecourtsmayconsiderwhetherundisputedsentencecreditsentitlethepetitionertohabeascorpusrelief,theymaynotconsiderthedisputedcredits.Rowellv.Dutton,688S.W.2d474(Tenn.Crim.App.1985).Generallyspeaking,onceaprisonerisinthecustodyoftheDepartmentofCorrection,timecreditsandparoledates,beinginternaldepartmentalmatters,areinappropriateconsiderationsinahabeascorpusproceeding.SeeCarrollv.Raney,868S.W.2d721,723(Tenn.Crim.App.1993).ThevalidityofanysentencereductioncreditsmustbeaddressedthroughtheavenuesoftheUniformAdministrativeProceduresAct.Tenn.CodeAnn.45101to45324;Statev.DavidN.Kuntz,No.01C019101CR00019,(Tenn.Crim.App.,atNashville,June14,1991).
