Thestateagreeswiththeappellantinthiscase.Thestatemaintainsthatthetrialcourtmayordertheappellanttopayacertainamounttodefraythecostofhisincarceration,butthatthetrialcourtmaynotdenyhisapplicationfortheworkreleaseprogram solelybecausehisemployerrefusestomailhispaychecktothatoffice. 4    TheappellantssecondoffensefordrivingundertheinfluenceoccurredonAugust19,1994.Althoughnotnotedineitherbrief,ourSupremeCourtonJune20,1994declaredtheentireworkreleasestatuteofTenn.CodeAnn.412128(c)unconstitutionalinStatev.Tester,879S.W.2d823(Tenn.1994).Therefore,atthetimetheappellantcommittedtheoffense,thisstatutehadbeenrenderedunconstitutionalbecauseitviolatedequalprotectionofthelawsguaranteedbytheFourteenthAmendmenttotheUnitedStatesConstitutionandguaranteedbyArticleI,Section8andArticleXI,Section8oftheTennesseeConstitution.Underthe1994versionofTenn.CodeAnn.412128(c),subsection(9)allowedonlythreeTennesseecountiestograntworkreleasetopersonsconvictedofasecondviolationofdrivingundertheinfluence:Shelby,Davidson,andMoore. 5   ׀ In1995,thelegislatureamendedTenn.CodeAnn.412128(c)toremovesubsection(9);andtheamendedstatutebecameeffectiveonMay9,1995.Theamendedstatutecontainedthesamelanguageinsubsection(c)(1)(C)astheunconstitutionalstatute.Theappellantinthiscase,whowassentencedinShelbyCounty,negotiatedapleaagreementonSeptember11,1995;andthetrialcourtapprovedthatagreementonOctober13,1995.Therefore,Tenn.CodeAnn.412128(c)wasapplicabletotheappellantwhenitwasunconstitutionalbecausehewasconvictedinShelbyCounty,whichwasoneofthethreecountiesinwhichthestatuteapplied;andtheamendedstatutewasapplicabletotheappellantaswell.
