Thedefendantsays,intwoassignments,thattheevidenceisinsufficienttosupporttheverdictandthattheStatewasallowedtoaskquestionsoncrossexaminationwhichwereprejudicialandhadnobasisinfact. TheevidenceaccreditedbythejuryandapprovedbythetrialjudgeiscorrectlyandcompletelysetoutintheStatementofFactsintheStatesbrief.WeadoptthatStatementasourresumeofthefactsandsetthestatementoutherein:      8  Around1:00a.m.onDecember12,1994,BerthaBorjareturnedtohertrailerafterwork.StacyAustin,thedefendantsnephewwasonthecouchandthedefendant,BillyAustinwasinthebedroom.BillyAustinwasBorjasboyfriend.8  AsBorjabeganundressing,Austinbeganaverbalassault.WhenBorjashowedanattempttoredressandleave,Austinindicatedthatshewasgoingnowhere.8  AustinthencutthephonecordtellingBorjashewouldnotbemakinganycalls.AfterAustinandhisnephewputontheirshoesinthelivingroom,thenephewretrievedasawedoffshotgunfromasecondbedroom.8  ThenephewretrievedachainsawfromBorjasbedroom.Austinsaidshewouldnotbeneedingthesawanylonger,andthenephewplacedthesawoutside.8  WhenAustinsnephewreturned,Austintoldhimtostandguardwiththeshotgun.Austinthenretrievedajugofkerosenefromanadjoiningroom.8  Austinsaturatedthelivingroomfloorwithkerosene,andalsodumpedkeroseneonBorjasdress.Thisalonecausedburns.AustintoldBorjathathehadhelpedsetthetrailerup,sohewasgoingtoburnitdown.8  Austinaskedhisnephewforthelighter,andorderedhisnephewoutside.Austinattemptedtoignitethelighterbutitonlymadeaspark.Whenheraisedthelighterasecondtime,Borjarantohimandembracedhim.Shepleadedwithhimandtoldhimshelovedhim.8  Borjapleadedthattheproblemscouldbeworkedout.Austindisagreedraisingthelighterathirdtime.BorjacontinuedpleadingwithAustinandhefinallysatdown.8  Austinsoonthereafterindicatedhewantedtohavesex.Borjadidwhateverhesuggested,soastokeephimcalm.BorjaremainedinAustinscompanyuntilthenextdayactingasthoughnothingwaswrong.WhenAustindrovehertoworklaterthatday,shecalledthepolice.   9    ThedefendantandhisnephewtestifiedthattheeventsshownbytheStatesevidencedidnotoccur. Thedefendantsattackupontheattemptconvictionsinthecaseisbasedupontheassertionthatnosubstantialstepwastakentocompletethecrimesallegedtohavebeenattempted. )   כ InStatev.Reeves,916S.W.2d909(Tenn.1996),theSupremeCourtdealtwiththeissueoftheapplicationofthe substantialstepruleassetoutinTenn.CodeAnn.3012101. +   כInReevestheissuewaswhetherastudenthadtakena  substantialsteptowardpoisoningherteacherwhensheplacedapursecontainingratpoisonontheteachersdesk.TheCourtheld:   r    8 Whenanactorpossessesmaterialstobeusedinthecommissionofacrime,atornearthesceneofthecrime,andwherethepossessionofthosematerialscanservenolawfulpurposeoftheactorunderthecircumstances,thejuryisentitled,butnotrequired,tofindthattheactorhastakena substantialsteptowardthecommissionofthecrimeifsuchactionisstronglycorroborativeoftheactorsoverallcriminalpurpose.      Ӏ Thedefendantpouredkeroseneonthevictimandonthefloorofthetraileraroundthevictimandattemptedtolightacigarettelightertoignitethefuel. Theevidencewassufficientforarationaltrieroffacttofindguiltbeyondareasonabledoubt. Thedefendantssecondissueispresentedbytwosentencesofargumentatthislevel.ThereisnosupportintherecordforthecomplaintandtheissueisϜwithoutmerit.
