OnFebruary18,1992,theDefendantenteredapleaofguiltytotheClassBfelonyoffenseofsellingcocaine.Byjudgmententeredonthesameday,hewasfoundguiltyoftheoffenseandwassentencedtoeightyearsintheTennesseeDepartmentofCorrection,tobeservedasaRangeIstandardoffender.Theentiresentencewassuspendedandtheeightyearswasorderedtobeservedonprobation.ByorderenteredonMay10,1993,theDefendantwasfoundtobeinviolationofhisprobation.HisprobationwasrevokedandtheeightyearsentencewasorderedtobeservedinϜconfinementintheTennesseeDepartmentofCorrection. OnFebruary13,1995,theDefendantfileda motiontocorrectanillegalsentence.TheDefendantarguesthathissentenceofeightyearsintheDepartmentofCorrectionisillegalbecauseeffectiveJuly1,1992,TennesseeCodeAnnotatedsection3917417(c)wasamendedtoprovidethatsellingcocaineinanamountoflessthan.5gramsisaClassCfelonywithaRangeIsentenceofthreetosixyears. Obviously,theeightyearsentencewhichtheDefendantreceivedwasnotanillegalsentence.AtthetimetheDefendantwasconvictedandsentenced,theTennesseeGeneralAssemblyhadnotyetenactedthelegislationwhichreducedthecrimeofsellingasmallquantityofcocainefromaClassBfelonytoaClassCfelony.ThelegislationwhichsubsequentlypassedwasnoteffectiveuntilJuly1,1992,somefourmonthsaftertheDefendantwasconvictedandsentencedunderthepriorlaw.TheDefendantsattorneyconcedesthathehasfoundnolegalauthoritytosupporttheDefendantsargument.WefindthattheDefendantsargumentistotallywithoutmeritandconcludethatthetrialjudgecorrectlydeniedtheDefendantsmotion. +   ׀ TheDefendantalsofileda motionforstreettime,inwhichheaskedthetrialjudgetocredithiseightyearsentencewiththetimethathespentonprobationbetweenϜthetimeofhisoriginalsentencingandthetimehisprobationwasrevoked.Insupportofthismotion,theDefendantcitesthestatutewhichauthorizestheparoleboard,uponrevocationofparole,toallowallorpartoftheinmatestimespentonparoletobeconsideredasserviceofthesentence. ,   ׀Weconcludethatthisstatuteisclearlyinapplicabletoprobationrevocation. Ifthetrialjudgedeterminesthatadefendanthasviolatedtheconditionsofhisprobation,Tennesseelawauthorizesthetrialjudgetorevoketheprobationand causetheDefendanttocommencetheexecutionofthejudgmentasoriginallyenteredorotherwiseinaccordancewith4035310. .   ׀Tenn.CodeAnn.4035311(d).Webelievethestatutesareclear,andwenotethatthiscourthasheldthataninmateisnotentitledtocreditonhissentencefortimespentonprobation.Youngv.State,539S.W.2d850,855(Tenn.Crim.App.),perm.toappealdenied,id.(Tenn.1976).WethereforecannotconcludethatthetrialjudgeerredbydenyingtheDefendants motionforstreettime.
