P@' OPINION    ` Thedefendant,TimothyAcklin,wasconvictedbyaMontgomeryCountyjuryofaggravatedrapeandaggravatedrobbery.ThetrialcourtsentencedhimasaRangeIstandardoffendertotwentyoneyearsforaggravatedrapeandnineyearsforaggravatedrobbery.Thesentenceswereorderedtorunconsecutively.Inthisappealasofright,thedefendantraisestwoissues: ` 8 1.whetherheisentitledtoanewtrialinordertoobtainaDNAexpert;and    ` 8 2.whetherthetrialcourterredinorderinghissentencestorunconsecutively.   Uponourreviewoftherecord,we AFFIRM thejudgmentofthetrialcourt.  @+ FACTS R   ` ThevictimarrivedhomeafterdarkonJanuary23,1995.Sheenteredthebackofherapartmentandthenwentoutthefrontdoortocheckhermail.Sheheardfootstepscomingdownherwalkandsawamanshedidnotknowcomingather.Shescreamedandtriedtoreturnintoherhome,butthemangrabbedher.Hethenforcedherinsideandpushedheragainstawall.Heslappedherface,knockingoffhereyeglasses. ` TheattackerdemandedmoneyandherATMcard.Thevictimtoldhimshehadonly$10andnoATMcard.Theattackersaid,"Ican'tbelieveIcametoClarksvillefortwentyfingdollars,"andslammedherintoawall.Hethenpushedherontothefloorandstraddledherwaistwithhisknees.Hepulledoutapistol,pointeditatherhead,andtoldher,"itwas[her]nighttodie,bitch."Thevictimpledforherlife,andtheattackerhitherintheheadandfacewiththegun. ` Atsomepoint,theattackersaid,"yousawmyfingface,"andputon,inthevictim'swords,a"blacknylonlookingthing"asamask.Healsopulledthe 8:4: victim'sovercoat(whichshewaswearing)overherheadandturnedoffthefloorlamp.Theattackerthenpulleddownthevictim'spantsandunderwearandrapedher. `  ` Subsequently,theattackerpulledthevictimupandtoldhertogetthemoney.Hepushedthegunintoherbackandfollowedherintothekitchen.Shereachedherpurse,tookoutthemoneyandhandedittohim.Hethenpulledherintothebedroom,puttheguntoherhead,andtoldhertolayonthefloorandcounttoonehundred.Asshedidso,heleft. `  ` Afterthevictimfinishedcounting,shecalledherbestfriend,whocalled911.Thevictimwastakentothelocalhospitalwherevaginalswabswerecollected. ` Thevictimtoldthepolicethatherattackerworeacamouflagefieldjacket,blackjeansandsneakers.ShedescribedhimasatallAfricanAmericaninhismidtwenties,withbigeyes,nofacialhair,andmediumbuild.Shealsotoldthepoliceaboutherattacker'smaskandgun. `  ` Fourdayslater,OfficerRoddWatterswasonpatrolinClarksvilleandsawdefendant,whofittheattacker'sphysicaldescription #  1      ׀andwaswearinga &$"& camouflagefieldjacketandbluejeans.OfficerWattersstoppeddefendantandaskedhimforidentification.Defendantsaidhedidnothaveanyidentificationbutprovidedanearbyaddress.Wattersfriskeddefendantandfoundapistolandanylonmeshragcommonlywornonthehead. ` Attrial,thevictimtestifiedshecouldnotidentifyherattackerbecauseherglasseshadbeenknockedoffduringtheattack.Whenshownthepistolandmeshragtakenfromdefendant,shetestifiedthatshecouldnotbecertaintheywerethe 4506 onesherattackerused.Shedidfurthertestifythatdefendantscamouflagefieldjacketwasthetypewornbyherattacker. ` Dr.WilliamDriverShippen,Jr.examinedthevictimafterherattackandfoundtenderareastoherscalpandbruisingtohernose.Thevictimalsohadbruisingonherlefthandandlacerationsontheinsideofherlip.Dr.Shippenfoundsperminthevictim'svaginalsecretions. ` MargaretBashtestifiedasanexpertinthefieldofanalysisandcomparisonofDNAsamples.ShetestedtheDNAcontainedinthespermsampleobtainedfromthevictim'svaginalsecretionsandthattheDNAcontainedinabloodsampletakenfromdefendant.Accordingtohertestingprocedures,thesesamplesmatched.ShetestifiedthatonlyoneinninetyeightmillionAfricanAmericanswouldhavethisparticularDNAprofile.@&&& I.DNAEXPERT    ` Inhisfirstissue,defendantcontendsthatheshouldhavebeengrantedanewtrialbasedonthisCourt'sposttrialholdingthatadefendantmaybeentitledtotheappointmentofaDNAexpertuponashowingofaparticularizedneed.SeeState &0"& v.JamesW.Jacobs,No.01C019601CC00048,MontgomeryCounty(Tenn.Crim. ($( App.filedSeptember18,1997,atNashville).ThisCourt'sdecisioninJacobswas |*%* anextensionofourSupremeCourt'sdecisioninStatev.Barnett,909S.W.2d423 H,', (Tenn.1995).InBarnett,ourSupremeCourtdeterminedthatanindigentdefendant .d). relyingonapsychiatricdefensewasentitledtotheassistanceofastatefundedpsychiatricexpertuponathresholdshowingof"particularizedneed."Id.at431. 1,2 TheCourtstated, ` 8 Toestablishparticularizedneed,thedefendantmustshowthatapsychiatricexpertisnecessarytoprotecthisrighttoafairtrial.UnsupportedassertionsthatapsychiatricexpertisnecessarytocountertheState'sproofarenotsufficient.Thedefendantmustdemonstratebyreferencetothefactsandcircumstancesofhisparticularcasethatappointmentofa 95; psychiatricexpertisnecessarytoinsureafairtrial.Whetherornotadefendanthasmadethethresholdshowingistobedeterminedonacasebycasebasis,andindeterminingwhetheraparticularizedneedhasbeenestablished,atrialcourtshouldconsiderallfactsandcircumstancesknowntoitatthetimethemotionforexpertassistanceismade. J  ` InJacobs,afterdeterminingthatthereasoningofBarnettshouldextendto   anindigentdefendant'srequestforaDNAexpert,thisCourtconsideredthedefendant'scontentionthat,becausetheStateintendedtointroduceDNAevidence,herequiredhisownDNAexperttoverifytheresults.Findingthatthisassertiondidnotdemonstratetherequiredparticularizedneed,thisCourtheldthatthetrialcourtdidnotabuseitsdiscretionindenyingthedefendant'srequest.SeealsoStatev.  QuintonCage,No.01C019605CC00179,MontgomeryCounty(Tenn.Crim.App. b filedJanuary26,1999,atNashville)(defendantwhorequestedDNAexperttocounterState'sexpertongroundsthathewouldotherwisenotbeabletopresentameaningfuldefensedidnotsatisfytherequirementofparticularizedneed). ` Intheinstantcase,therewasnopretrialrequestforaDNAexpert.TheissueofwhetherdefendantshouldbeprovidedfundstohireaDNAexpertwasnotraiseduntilthemotionfornewtrial.Amotionfornewtrialisgenerallymadetogivethetrialcourtanopportunitytocorrecterrorsthatoccurredduringthetrial.Ricks '#' v.State,882S.W.2d387,393(Tenn.Crim.App.1994).Heredefendantwas )$) askingthetrialcourttocorrectthefailuretofileapretrialmotion. ` Defendant'seffortwasakintourgingthetrialcourttograntanewtrialonthebasisofnewlydiscoveredevidence.Newtrialsmaybegrantedonsuchgroundswhenadefendantestablishesreasonablediligenceinattemptingtodiscovertheevidence;thematerialityoftheevidence;andthattheevidencewouldlikelychangetheresultofthetrial.Statev.Caldwell,977S.W.2d110,116(Tenn.Crim.App. "6r17 1997).Here,however,defendantmadenoshowingthathehada"particularizedneed"tohireaDNAexpert.Absentsuchashowing,defendantisnotentitledto 9 5; P    statefundsforsuchanexpert.Accordingly,thetrialcourtproperlydenieddefendant'smotionfornewtrial. |  ` Thisissueiswithoutmerit.  h Ѐ@& II.SENTENCING    ` Defendantnextchallengesthetrialcourt'sdecisiontorunhissentences `  consecutively.However,therecordonappealdoesnotcontainatranscriptofthesentencinghearing.Becausetherecorddoesnotcontainatranscriptoftheproceedingsrelevanttotheissuepresentedforreview,thisCourtisprecludedfromconsideringtheissue.Statev.Ballard,855S.W.2d557,561(Tenn.1993).
