Thedefendantwasconvicteduponherpleaofguiltytosellingcocaine.Shehadabuseddrugsandwasonmedicationatthetimeofsentencing.AndersonCountyhasnocommunitycorrectionsprogram.AcommunitycorrectionsofficerfromRoaneCounty,whichisinanotherjudicialdistrict,testifiedthathisprogramwaswillingtoacceptandsupervisethedefendant.Thetrialcourtrecognizedtheprogramandplacedthedefendantinthatprogram. Thestatecontendsthatalthoughthereisneithercaselawnorlegislationdirectlyonpoint,analogouslawsupportsitspositionthatthetrialcourterred.First,itcitesStatev.NelsonJosephLeClair,No.01C019603CC00104,RutherfordCounty -&+ (Tenn.Crim.App.Jan.31,1997),app.denied(Tenn.Sept.8,1997)(concurringin /z(- resultsonly),inwhichthedefendantappealedthetrialcourtsrefusaltoallowhimtoservehismisdemeanorsentenceinDavidsonCounty,whichhasaworkreleaseprograminsteadoftheRutherfordCountyworkhouse,whichhasnosuchprogram.Thiscourtstatedthatitfoundnosupportforthedefendantsargumentthattherequestshouldhavebeengrantednor anyauthoritygivingatrialjudgetherighttoordera ~8v17 misdemeanorsentencetobeservedinacountyotherthantheoneinwhichtheoffenseoccurred.Id.,slipop.at3.Thecourtaddedthatworkreleaseisaformofprobation  andisaprivilege,notaright.Id.Thestatearguesthattheanalogyappliesinthis   felonycase. Thedefendantrespondsbydistinction.ShenotesthatLeClairinvolveda   misdemeanorandthatTenn.CodeAnn.412103requiresthetrialcourttosentencemisdemeanantstotheworkhouseofthecountyofconvictionifaworkhousesentenceisimposed.Sheassertsthatnosimilarrequirementexistsforcommunitycorrectionssentences.Also,shearguesthatherfelonycommunitycorrectionssentenceismoreanalogoustofelonyprobationunderTenn.CodeAnn.4035309,whichallowssupervisedprobationoutsidethetrialcourtsjurisdictionforresidentsofanotherjudicialdistrict.Finally,shenotesthatLeClairdidnotinvolveeitheroutsideauthorities  agreeingtosupervisethedefendantorthesentencingcourtgrantingsuchasentence. RelativetoprobationunderTenn.CodeAnn.4035309,thestatenotesthatitallowsatrialcourttoplaceadefendantonsupervisedprobationinanotherjudicialdistrictwiththeexpressoptionofeitherretainingjurisdictionortransferringittotheappropriatecourtintheresidentdistrict.Nosimilarstatuteexistsregardingacommunitycorrectionssentence.ItalsocitesStatev.Malone,928S.W.2d41,44 ,)$"& (Tenn.Crim.App.1995),inwhichthiscourtheldthatthedefendantsparolefromonesentenceundertheBoardofParolesjurisdictiondidnotbarthetrialcourtfromrevokinganothersuspendedsentence.ThecourtconcludedthattheBoardofParolesdidnottakeoverthetrialcourtsauthorityrelativetoafullysuspendedsentence.ThestateclaimsthataswiththeBoardofParoles,thetrialcourtinthepresentcasecouldnotplaceitsauthoritywiththeRoaneCountyCommunityCorrectionsProgram.  5.4  :   :   :   :   :   :   ThedefendantrespondsthattheholdinginMaloneisirrelevanttothe   presentinquiry.ShenotesthatthetrialcourtinhercasehasnottransferredjurisdictionoverhersentencetoRoaneCounty. Finally,thestatepointstotheCommunityCorrectionsAct.ItnotesthatunderTenn.CodeAnn.4036102(4),the communityincludesthecountiesthatcompriseajudicialdistrictandthatagoaloftheactisto [p]romoteaccountabilityofoffenderstotheirlocalcommunitybyrequiring...communityservicerestitutiontolocalgovernments,Tenn.CodeAnn.4036104(2).ItassertsthatthedefendantdoesnotoweservicetoRoaneCountybuttoAndersonCounty,thevenueofhercrime. Inkind,thedefendantnotesthatthegoaloftheactcitedbythestatemakesoffendersaccountabletotheirlocalcommunitiesandassistsoffendersin  becomingcontributingmembersoftheircommunity.񛀜SeeTenn.CodeAnn.4036 d\ 104(2).Sheassertsthattheactprovidesnorequirementthatanoffendermustbeconvictedinacountythathasacommunitycorrectionsprogrambeforesuchaprogrammaybeinvoked.Alsoinsupport,shestatesthatthiscourthasaffirmedtheHamblenCountyCriminalCourtinsentencingadefendanttothecommunitycorrectionsprograminSullivanCounty,aseparatejudicialdistrict.SeeStatev.TomHale,No.03C01 `'X $ 9411CR00404,HamblenCounty(Tenn.Crim.App.Aug.4,1995).However,wesensethatthefacilityinvolvedinHalehascontractedwithseveraljudicialdistrictstobepartof *#( theirrespectivecommunitycorrectionsprograms.SeeStatev.RobertJosephBacon, ,%* No.03C019708CR00356,SullivanCounty(Tenn.Crim.App.Aug.17,1998);Tenn.CodeAnn.4036302(a)(2). Asastartingpoint,weheedoursupremecourtsstatementthatanappellatecourt cannotaffirmasentencethatisnotexpresslyauthorizedbytheLegislature.Statev.Davis,940S.W.2d558,562(Tenn.1997).Thus,thetrialcourts 706 sentencingauthoritymustbestatutorilybased.PursuanttoTenn.CodeAnn.4035104(c)(9),atrialcourthastheauthoritytosentenceanoffender toacommunitybasedalternativetoincarcerationinaccordancewiththeprovisions,includingeligibilityrequirements,ofchapter36ofthistitle,whichcontainstheCommunityCorrectionsAct.Inessence,thismeansthatatrialcourtisempoweredtoimposeacommunitycorrectionssentencewithinthelimitsallowedbytheact. ThegoalsoftheCommunityCorrectionsActarestatedinTenn.CodeAnn.4036104asfollows:  8 (1)Maintainsafeandcostefficientcommunitycorrectionalprograms,whichalsoinvolveclosesupervisionofoffenders;  x x 8 (2)Promoteaccountabilityofoffenderstotheirlocalcommunitybyrequiringdirectfinancialrestitutiontovictimsofcrimesandcommunityservicerestitutiontolocalgovernmentsandcommunityagencies;  x x 8 (3)Fillgapsinthelocalcorrectionalsystemthroughthedevelopmentofarangeofsanctionsandservicesavailableforthejudgeatsentencing;  x x 8 (4)Reducethenumberofnonviolentfelonyoffenderscommittedbyparticipatingcountiestocorrectionalinstitutionsandjailsbypunishingtheseoffendersinnoncustodialoptionsasprovidedinthischapter;  x x 8 (5)Provideopportunitiesforoffendersdemonstratingspecialneedstoreceiveserviceswhichenhancetheirabilitytoprovidefortheirfamiliesandbecomecontributingmembersoftheircommunity;  x x 8 (6)Encouragetheinvolvementoflocalofficialsandleadingcitizensintheirlocalcorrectionalsystem;and  x x 8 (7)Promotethedevelopmentofcommunitycorrectionsprogramswhicharetailoredtothespecificneedsofeachparticipatingcounty,andwhicharecreativeandinnovative,withinthisstate.  x x   Unquestionably,theactisessentiallygearedtoprogramswithinagivenjudicialdistrict.Asthestatenotes,theactdefines communityintermsofajudicialdistrict.SeeTenn. 4-3 CodeAnn.4036102(4).However,manyofthegoalsoftheactaremetbyallowingadefendanttoserveacommunitycorrectionssentenceinthedefendantscountyof r8j17 residence,whichhasaprogramwillingtosupervisethedefendant.Althoughsuchasentencedoesnotdirectlybenefitthesentencingjudicialdistrict,itcertainlybenefitsthedefendantscommunity,fillsgapsinlocalcorrectionalsystems,reducesprisonovercrowding,andprovidesopportunitiesforthedefendanttobecomeacontributingmemberofthedefendantsowncommunity. Thestateseekstoanalogizecommunitycorrectionstoworkreleaseandparole,butTennesseecourtshaverecognizedthatcommunitycorrectionsismoresimilartoprobation.SeeStatev.Harkins,811S.W.2d79,82(Tenn.1991)(holdingthat h` acommunitycorrectionssentenceandprobation aresufficientlysimilarinnaturetohavethesamestandardofreviewforrevocationpurposes);Bentleyv.State,938  S.W.2d706,714(Tenn.Crim.App.1996)(holdingthatsimilaritiesbetweenacommunitycorrectionssentenceandprobationjustifyusingsimilarrevocationprocedures).Asthedefendanthasnoted,thetrialcourthasnotcededjurisdictiontoRoaneCounty.
