XXX™óÔòòÚ  Ú1Ú  ÚóóÝ  Ý×  ×€€After€plea€negotiations,€the€State€recommended€a€sentence€ofÐ Fæ Ðdeferred€judgment€for€one€year€and€100€hours€of€public€service€work€in€exchange€for€aÏguilty€plea.€€The€trial€court€declined€to€accept€this€plea€agreement.€€After€furtherÏnegotiations,€the€State€recommended€a€one€year€sentence€of€probation,€200€hours€ofÏpublic€service€work,€and€the€mandatory€minimum€fine€in€exchange€for€a€guilty€plea.€ÏAgain,€the€trial€court€rejected€the€plea€agreement.€€The€defendant€then€pled€guilty€andÏsubmitted€the€case€to€the€trial€court€for€sentencing.ÌÌà ¨ àà àAt€the€sentencing€hearing,€the€defendant€maintained€that€the€marijuanaÏfound€at€her€house€was€for€her€personal€use.€€She€also€testified€that€she€bought€a€ratherÏlarge€quantity€of€marijuana€so€she€could€share€some€with€her€friends€because€it€wasÏcheaper€to€buy€in€bulk.€€To€that€end,€she€testified€that€she€used€the€baggies€and€scalesÐ "0Â&* Ðthat€were€found€in€her€house€in€order€to€distribute€the€proper€amount€of€marijuana€to€herÏfriends€and€ensure€she€was€not€ð ðbeing€cheated.ðð€€Moreover,€she€testified€that€she€boughtÏthe€drugs€from€a€college€student€named€Edward€Johnson,€but€she€could€not€rememberÏhis€phone€number.€€In€her€statement€contained€in€the€presentence€report,€she€stated,€ð ðIÏwould€consider€helping€get€the€person€I€bought€the€marijuana€from,€[i]f€the€D.A.ððs€officeÏwill€help€me.ððÌÌà ¨ àà àAt€the€conclusion€of€the€evidence,€the€trial€court€told€the€defendant,€ð ðItððsÏapparent€to€the€Court€that€you€are€a€drug€seller€and€distributor.€€Although€you€claim€thatÏthe€marijuana€was€for€your€own€personal€use,€the€presence€of€scales€and€plastic€bagsÏconvinces€the€Court€that€you€lie€in€this€regard.ðð€€The€trial€court€also€found€that€theÏdefendant€did€not€cooperate€with€the€presentence€officer€in€making€a€forthright€statementÏor€truthfully€disclosing€the€name€of€the€person€from€whom€she€bought€the€marijuana.€€TheÏtrial€court€found€no€enhancing€factors,€but€stated€that€this€type€of€offense€was€ð ðrampantððÏin€Coffee€County€and€needed€to€be€discouraged€and€that€the€defendant€has€a€ð ðððsorryððÐ 0#Ð Ðsocial€history.ðð€€Accordingly,€the€trial€court€ordered€the€defendant€to€pay€the€minimum€fineÏof€œñˆñtwo€thousand€dollars€(ñˆñ$2000ñ‰ñ)ñ‰ñ›€and€gave€her€a€sentence€of€two€years,€one€month€to€beÏserved€in€county€jail€and€the€balance€served€on€community€corrections.ÌÌà ¨ àà àThe€defendant€challenges€the€length€of€her€sentence,€arguing€that€sheÏshould€have€received€the€minimum€sentence.€€She€also€argues€that€she€should€not€spendÏany€time€in€jail€and€instead€should€be€placed€on€probation€or€at€least€solely€on€communityÏcorrections.€€In€this€regard,€she€contends€that€she€is€entitled€to€a€presumption€ofÏalternative€sentencing€and€that€the€record€contains€insufficient€evidence€to€rebut€thatÏpresumption.ÌÐ àWhen€a€defendant€complains€of€his€or€her€sentence,€we€must€conduct€a€deÏnovo€review€with€a€presumption€of€correctness.€€T.C.A.€ðð€40„35„401(d).€€The€burden€ofÏshowing€that€the€sentence€is€improper€is€upon€the€appealing€party.€€T.C.A.€ðð€40„35„¼401(d)€Sentencing€Commission€Comments.€€This€presumption,€however,€ð ðis€conditionedÏupon€the€affirmative€showing€in€the€record€that€the€trial€court€considered€the€sentencingÏprinciples€and€all€relevant€facts€and€circumstances.ðð€€òòState€v.€Ashbyóó,€823€S.W.2d€166,Ð ˜8  Ð169€(Tenn.€1991).ÌÌà ¨ àà àIn€determining€the€length€of€a€sentence,€T.C.A.€ðð€40„35„210(c)€provides€thatÏfor€Class€E€felonies,€such€as€the€one€in€the€instant€case,€the€minimum€sentence€withinÏthe€range€is€the€presumptive€sentence.€€If€there€are€enhanc‚ing€and€mitigating€factors,€theÏcourt€must€start€at€the€minimum€sentence€in€the€range€and€enhance€the€sentence€asÏappropriate€for€the€enhancement€factors€and€then€reduce€the€sen‚tence€within€the€rangeÏas€appropriate€for€the€mitigating€factors.€€If€there€are€no€mitigating€factors,€the€court€mayÏset€the€sentence€above€the€minimum€in€that€range€but€still€within€the€range.€€The€weightÏto€be€given€each€factor€is€left€to€the€discretion€of€the€trial€judge.€€òòState€v.€Sheltonóó,€854Ð %¨ ÐS.W.2d€116,€123€(Tenn.€Crim.€App.€1992).ÌÌà ¨ àà àHere,€because€the€defendant€was€sentenced€to€a€Class€E€felony€as€aÏRange€I€standard€offender,€her€possible€sentence€ranged€from€one€to€two€years.€ÏAlthough€the€trial€court€found€no€statutory€enhancing€factors,€the€presentence€reportÏreflects€that€the€defendant€admits€to€ð ðcasual€useðð€of€marijuana€since€1970.€€TheÏdefendant€also€testified€that€at€least€some€of€the€marijuana€found€in€her€house€was€forÏher€own€use.€€Because€the€defendant€admits€to€prior€criminal€activity,€her€sentenceÏshould€be€enhanced€under€T.C.A.€ðð€40„35„114(1).€€We€agree€with€the€trial€court€that€oneÏmitigating€factor€is€applicable,€that€is,€that€the€defendantððs€behavior€neither€caused€norÐ x7.2 Ðthreatened€serious€bodily€injury.€€òòSeeóó€T.C.A.€ðð€40„35„113(1).€€Even€so,€it€is€obvious€thatÐ `  Ðthe€trial€court€gave€this€mitigating€factor€little€weight,€as€do€we.€€Thus,€balancing€theÏenhancing€factor€against€the€mitigating€factor,€a€sentence€of€two€years€seems€appropriateÏunder€the€circumstances€of€this€case.ÌÌà ¨ àà àIn€determining€whether€the€defendant€should€be€incarcerated,€theÏguidelines€enumerated€in€T.C.A.€ðð€40„35„103€should€be€considered.€€These€guidelinesÏinclude€the€need€ð ðto€protect€society€by€restraining€a€defendant€who€has€a€long€history€ofÏcriminal€conduct,ðð€the€need€ð ðto€avoid€depreciating€the€seriousness€of€the€offense,ðð€theÏdetermination€that€ð ðconfinement€is€particularly€suited€to€provide€an€effective€deterrenceÏto€others€likely€to€commit€similar€offenses,ðð€or€the€determination€that€ð
