àOn€February€24,€1997,€the€defendant€was€found€guilty€by€a€jury€of€sexualÏbattery.€€The€defendant€was€subsequently€sentenced€as€a€Range€II€multiple€offender€toÏfour€years€to€be€served€in€the€Tennessee€Department€of€Correction.€€The€defendantððsÏmotion€for€a€new€trial€was€denied€by€the€trial€court.€€The€defendant€now€appeals€andÏcontends€that€the€evidence€was€insufficient€to€support€his€conviction€and€that€hisÏsentence€is€excessive.€€After€a€review€of€the€record€and€the€applicable€law,€we€affirm€theÏjudgment€of€the€court€below.ÌÌà œ àà ô àThe€defendant€was€convicted€of€sexual€battery€based€on€his€involvementÏwith€a€sixteen„year„old€employee.€€The€defendant€owned€and€operated€a€barber€shop.€ÏOn€or€about€June€3,€1995,€the€defendant,€while€passing€out€flyers,€approached€the€victimÏand€offered€her€a€job.€€The€victim€accepted€the€offer€and€on€Monday,€June€5,€went€to€theÏdefendantððs€barber€shop€to€begin€her€new€job.€€According€to€the€victim,€upon€arrival€sheÏnoticed€slow€music€playing€in€the€background.€€The€defendant€then€showed€the€victim€hisÏcomputer€and€the€handwritten€pages€to€be€typed.€€As€the€defendant€was€deciphering€hisÏhandwriting€for€the€victim,€he€began€to€rub€her€leg.€€The€victim€told€the€defendant€sheÏwould€work€for€him,€but€she€did€not€want€him€to€touch€her.€€At€this€point,€someoneÏknocked€on€the€door€and,€after€talking€to€the€person€for€a€moment,€the€defendant€shutÏand€locked€the€door.€€The€defendant€then€walked€back€to€the€victim€and€began€to€touchÏher€breasts.€€The€victim€jumped€up,€told€the€defendant€she€was€leaving,€unlocked€theÏdoor,€and€ran€home.€€The€victim€notified€the€police€and€they€set€up€a€recorded€phone€callÏto€the€defendant.€€During€the€course€of€the€phone€call,€the€victim€asked€the€defendantÏwhy€he€had€touched€her€breasts.€€The€defendant€answered,€ð ð[ñçñœñçñC]auseñçñ›ñçñ€they€look€good€toÐ `6-0 Ðme€baby.ððÌÌà œ àà ô àThe€defendant€contends€that€the€evidence€was€insufficient€to€support€aÏconviction€for€sexual€battery.€€The€defendant€argues€that€there€was€not€enough€evidenceÏto€prove€the€elements€of€force€or€coercion€beyond€a€reasonable€doubt.€€ÌÌà œ àà ô àA€defendant€challenging€the€sufficiency€of€the€proof€has€the€burden€ofÏillustrating€to€this€Court€why€the€evidence€is€insufficient€to€support€the€verdict€returned€byÏthe€trier€of€fact€in€his€or€her€case.€€This€Court€will€not€disturb€a€verdict€of€guilt€for€lack€ofÏsufficient€evidence€unless€the€facts€contained€in€the€record€and€any€inferences€which€mayÏbe€drawn€from€the€facts€are€insufficient,€as€a€matter€of€law,€for€a€rational€trier€of€fact€toÏfind€the€defendant€guilty€beyond€a€reasonable€doubt.€€òòState€v.€ñçñœñçñTuggleñçñ›ñçñóó,€639€S.W.2d€913,Ð àWhen€an€accused€challenges€the€sufficiency€of€the€convicting€evidence,€weÏmust€review€the€evidence€in€the€light€most€favorable€to€the€prosecution€in€determiningÏwhether€ð ðany€rational€trier€of€fact€could€have€found€the€essential€elements€of€the€crimeÏbeyond€a€reasonable€doubt.ðð€€òòJackson€v.€Virginiaóó,€443€U.S.€307,€319€(1979).€€We€do€notÐ @)à" Ðreweigh€or€re„evaluate€the€evidence€and€are€required€to€afford€the€State€the€strongestÏlegitimate€view€of€the€proof€contained€in€the€record€as€well€as€all€reasonable€andÏlegitimate€inferences€which€may€be€drawn€therefrom.€€òòState€v.€Cabbageóó,€571€S.W.2dÐ àThe€defendant€contends€that€there€was€no€evidence€of€force€or€coercionÏand,€as€this€is€an€essential€element€of€sexual€battery,€his€conviction€should€be€set€asideÐ `6-0 Ðand€the€cause€remanded€back€to€the€trial€court€for€the€entry€of€an€order€of€guilt€as€to€theÏlesser€included€offense€of€simple€assault.€€òòSeeóó€T.C.A.€ðð39„13„505(a)€(1991);€€ðð39„13„Ð @ à Ð503(a)(1)€(1991).€€However,€there€is€evidence€indicating€that€the€defendant€continued€toÏtouch€the€victim€after€she€asked€him€to€stop.€€He€subsequently€locked€the€door€of€theÏbarber€shop,€walked€up€behind€the€ñçñœñçñvictim,ñçñ›ñçñ€and€squeezed€her€breasts€ð ðreal€hard.ðð€€TheÏdefendant€was€also€much€larger€and€taller€than€the€victim.€€In€light€of€the€foregoing,€aÏrational€trier€of€fact€could€have€found€the€elements€of€force€or€coercion€beyond€aÏreasonable€doubt.€€As€such,€this€contention€is€without€merit.ÌÌà œ àà ô àThe€defendant€next€contends€that€the€trial€court€erroneously€appliedÏenhancement€factor€fifteen€and€that,€due€to€this€error,€his€sentence€should€be€reducedÏfrom€four€to€three€years.€€When€a€defendant€complains€of€his€or€her€sentence,€we€mustÏconduct€a€de€novo€review€with€a€presumption€of€correctness.€€T.C.A.€ðð40„35„401(d).€€TheÏburden€of€showing€that€the€sentence€is€improper€is€upon€the€appealing€party.€€T.C.A.€ðð40„¼35„401(d)€Sentencing€Commission€Comments.€€This€presumption,€however,€ð ÐRange€II€offender,€which€carries€a€sentencing€range€of€two€to€four€years.€€T.C.A.€ðð40„35„¼112(b)(5).€€In€determining€the€defendantððs€sentence,€the€trial€court€found€four€applicableÏenhancement€factors.€€The€court€found€that€the€defendant€had€a€previous€history€ofÏcriminal€convictions€or€criminal€behavior€in€addition€to€those€necessary€to€establish€theÏappropriate€range.€€T.C.A.€ðð€40„35„114(1).€€The€court€also€found€that€the€offense€involvedÏa€victim€and€was€committed€to€gratify€the€defendantððs€desire€for€pleasure€or€excitement.€ÏT.C.A.€ðð€40„35„114(7).€€The€court€found€that€the€felony€was€committed€while€œñèñtheÏdefendant€was€ñèñon›€parole€for€a€prior€felony€conviction.€€T.C.A.€ðð€40„35„114(13).€€The€courtÏfurther€found€that€the€defendant€abused€a€position€of€private€trust.€€T.C.A.€ðð€40„35„¼114(15).€€The€defendant€only€challenges€the€trial€courtððs€application€of€the€last€factor.ÌÌà œ àà ô àThe€defendant€contends€that€someone€in€the€position€of€an€employer€forÐ P7ð-1 Ða€short€period€of€time€is€not€in€a€position€of€private€trust.€€This€issue€is€waived€as€theÏdefendant€has€failed€to€cite€any€authority€to€support€his€argument.€€Rules€of€the€Court€ofÏCriminal€Appeals€of€Tennessee€10(b);€òòState€v.€ñçñœñçñKillebrewñçñ›ñçñóó,€760€S.W.2d€228,€231€(Tenn.Ð ÐS.W.2d€583,€588€(Tenn.€Crim.€App.€1992).€€The€defendant€in€the€case€at€issue€used€hisÏposition€as€the€victimððs€employer€to€lure€her€into€the€barber€shop,€lock€the€door,€and€getÏclose€enough€to€her€to€commit€sexual€battery.€€Therefore,€the€violation€of€a€private€trustÏis€an€applicable€enhancement€factor€in€this€case€and€the€defendantððs€contention€isÏwithout€merit.ÌÌà
