Theissuewithwhichwearefacediswhethercounselhasrenderedineffectiveassistancebyfailingtoadvisepetitionerthataguiltypleacouldleadtorevocationofparoleandconsecutivesentencing. Theappropriatetestfordeterminingwhethercounselprovidedeffectiveassistanceattrialiswhetherhisorherperformancewaswithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930(Tenn.1975).Appellantmustestablishbyapreponderanceoftheevidencethat:(1)theservicesrenderedortheadvicegivenbycounselfellbelow"therangeofcompetencedemandedofattorneysincriminalcases,"and(2)butforcounsel'serrors,hewouldnothavepledguiltyandwouldhaveinsistedongoingtotrial.Hillv.Lockhart,474U.S.52(1985);Porterfieldv.Tennessee,897S.W.2d672,67778(Tenn.1995). Thepetitioniscompetentlydrafted.Swansonv.State,749S.W.2d731(Tenn.1988).Weunderstandtheclaim;however,itfailstostatea"basictheoryofrelief"cognizableuponcollateralreview.Lowev.State,805S.W.2d368,372(Tenn.1991).WefindLowe'srationaleapplicabletothiscase.Therefore,"tostatea'colorableclaim'andsurvivethestate'sinitialmotiontodismiss,"petitionermustshowthathewouldnothavepledguiltyabsenttheallegedomissions.Id.at372. Petitionerkneworshouldhaveknownthathewasonparoleandthathisparolestatuswassubjecttocertainconditions."Furthermore,weareunpersuadedbyclaimsofignorancewithrespecttomattersclearlyobvioustotheeverydaylayman."Sheehanv.State,411So.2d824,828(Ala.Crim.App.1981)."EvenifBoykinrequiresthatadefendantbeawareofcertainconsequencesofaguiltypleaotherthangivingupofconstitutionalrights,weareoftheopinionthatsucharequirementwouldnotapplytoaconsequencesoobviousasseparatepunishmentsforseparatecrimes;aconsequenceofwhichthedefendantmustbepresumedtobeaware."Statev.Young,480P.2d345,34647(Ariz.1971). Wefinditreadilyapparent,eventotheeverydaylayman,thatcriminalconvictionscanleadtoparolerevocation.Wefinditequallyapparentthattheparolerevocatingoffense'ssentencewouldrunconsecutivelytoanexistingparoledsentence.SeeSheehan,411So.2dat828(statingthatmostbasiclogicandreflectionmakesitapparentthatseparateoffensesmeritseparatepunishments).We,therefore,rejectpetitioner'sargumentthathewouldnothavepledguiltyhadcounselinformedhimofinformationheispresumedtopossess.Toholdotherwisewouldbenonsensical.
