Itisnotnecessarythatweaddressthefactsinanydetail.MembersoftheNashvilleMetropolitanPoliceDepartmentwereconductinganundercoverstreetleveldrugenforcementoperation.Duringthisoperation,theDefendantsoldcocainetoundercoverpoliceofficers.Immediatelythereafter,whenotherpoliceofficersattemptedtoarresttheDefendant,hefledandtheofficershadtochasehimdowntoarresthim.Afterhearingproofofthesefacts,thejuryreturnedaverdictofguiltyofsellingcocaineandevadingarrest.Weconcludethattheevidenceissufficienttosupportthejurysverdict,andtheDefendantdoesnotargueotherwise. TheDefendantarguestwoissuesonthisappeal:(1)Thatreversibleerrorwascommittedwhenapoliceofficertestifiedthatthepolicehadreceivednumerouscomplaintsofstreetdrugdealingnearacertainelementaryschool;and(2)thatthetrialcourterredinsentencinghimasaRangeIImultipleoffender. NearthebeginningoftheStatesproof,theassistantdistrictattorneyaskedapoliceofficerwitnessiftherewasanyparticularareaoftownthattheundercoverdrugoperationwasfocusedonthatevening.Theofficerresponded, wehavethen,and,ofcourse,westilldo,numerouscomplaintsofstreetdrugdealingnearKirkpatrickElementarySchool,neartheJamesCaycepublichousing.TheDefendantobjectedtothe numerouscomplaintsfromunnamedsources,asbeinghearsay.Thetrialcourtstated, Okay.Idontknowthatitisassertedforthetruthofthematter,butratherforwhytheofficerdidwhathedid,ifwemakethatclarification.Theassistantdistrictattorneythenresumedquestioningoftheofficer.TheDefendantinsiststhatthisexchangeentitleshimtoanewtrial. TheDefendantarguesthatthetestimonywasinadmissablehearsayandthatitwasnotrelevant.Hearguesthatifitwasremotelyrelevanttoexplainwhytheofficerswereconductinganundercoverdrugoperationatthatlocation,thetestimonyisunfairlyprejudicialbecausethejurycouldviewthetestimonyas aninvitationtoremoveadrugdealerwhomaybesellingdrugstoschoolchildrenfromthestreetbyconvictingwhoeverhappenstobeontrial.Thepoliceofficerstestimonywasunresponsivetothequestionasked.Thetestimonyinquestionconsistsofjustthreetypedlinesonpagefourofonehundredandthirtyfivepagesofthetranscriptofthetrial.Laterintheofficerstestimony,thedistrictattorneymentionedKirkpatrickElementarySchoolinaquestiontotheofficer.Noobjectionwasmade.Assumingthetestimonywasinadmissableashearsay,wasirrelevant,orifrelevant,thatitsprobativevaluewasoutweighedbythedangerofunfairprejudice,weconcludethatanysucherrorinallowingthetestimonywasharmlessanddoesnotentitletheDefendanttoanewtrial.Thisissuehasnomerit. TheDefendantnextarguesthatthetrialcourterredinsentencinghimasaRangeIImultipleoffender.InsentencingtheDefendantinRangeII,thetrialcourtreliedupontheDefendantstwopriorconvictionsforattemptedaggravatedrobbery.TheDefendantarguesthatthesetwopriorfelonieswerecommittedaspartofasinglecourseofconductwithintwentyfourhoursand,therefore,constituteonlyoneconvictionforthepurposeofpriorconvictionsindeterminingmultipleoffenderstatus.Tenn.CodeAnn.4035106(b)(4).TheStatearguesthatthetwoattemptedaggravatedrobberyconvictionswereactsresultinginthreatenedbodilyinjurytothevictimsand,therefore,arenottobeconstruedasasinglecourseofconduct.Id. Itisapparentfromthisrecordthatthetwopriorattemptedaggravatedrobberyconvictionswerecommittedaspartofasinglecourseofconductwithintwentyfourhoursofeachother.Infact,itisapparentthatthetwocrimeswerecommittedatthesametimewhentheDefendantattemptedtorobtwoseparatevictimsatgunpointsimultaneouslyonorneartheLegislativePlazaacrossfromthePerformingArtsCenterindowntownNashville.However,itisalsoclearfromthisrecordthatthesetwopriorcrimesthreatenedbodilyinjurytothevictims.TheDefendantwasattemptingtorobthetwovictimsatgunpoint.Beforethevictimscouldturnovertheirvaluables,aTennesseeStateCapitolPoliceOfficerdrovebyandtheDefendantfled.ThepoliceofficerwasabletoapprehendtheDefendant. IncludedintheSentencingCommissionCommentsconcerningthecodesectioninquestionisthefollowingstatement: Asanotherexample,iftheDefendantwasconvictedofrobbingseveralpeopleinthesamestore,suchwouldconstituteseparateconvictionsforenhancementpurposesforanewviolationofthelaw.Thisisinaccordwiththepolicyofgivinggreaterweighttocrimesofviolence.WecannotconcludethatthetrialcourterredindeterminingthatthetwoattemptedaggravatedrobberyconvictionsqualifiedasseparatepriorconvictionsforthepurposeofsentencingthisDefendantasamultipleoffender.Thisissuehasnomerit.
