ƒ$ ××  ×€€The€trialÏcourt€imposed€concurrent€sentences€of€life€imprisonment,€twenty„five€years,Ïtwelve€years,€and€four€years€respectively.€€On€November€21,€1994,€theÏappellant€filed€a€petition€for€post„conviction€relief.€€The€post„conviction€courtÏappointed€counsel,€who,€on€May€31,€1995,€filed€an€amended€petition.€€OnÏSeptember€6,€1995,€the€post„conviction€court€conducted€an€evidentiary€hearingÏand€dismissed€the€appellantððs€petition.€€On€appeal,€the€appellant€allegesÏineffective€assistance€of€counsel,€specifically€contending€that€trial€counsel€failedÏto€adequately€investigate€evidence€that€the€appellant€was€intoxicated€at€the€timeÏof€the€murder.€€The€State€asserts€that€the€appellant€has€failed€to€carry€hisÏburden€of€proof.ÌÌà àFollowing€a€thorough€review€of€the€record,€we€affirm€the€post„convictionÏcourtððs€dismissal€of€the€appellantððs€petition.ÌÌà@ àòòò òI.€€Factual€Backgroundó óóóÌà àFollowing€the€appellantððs€arrest,€his€family€retained€an€attorney,€Mr.€LloydÏLevitt,€who€had€been€engaged€in€the€practice€of€law€for€eight€years€and€hadÏpreviously€represented€defendants€charged€with€murder.€€Subsequently,€theÏState€notified€the€appellant€that€it€would€seek€the€death€penalty.€€Accordingly,€atÏa€pre„trial€hearing€on€December€16,€1991,€Mr.€Levitt€asked€that€the€trial€courtÏappoint€to€the€appellantððs€case€an€attorney€possessing€experience€in€capitalÏlitigation.€€The€trial€court€ultimately€appointed,€as€lead€counsel,€Mr.€John€Cavett.€ÏMr.€Cavett€had€been€practicing€law€since€1981€and€had€previously€providedÏrepresentation€in€one€death€penalty€case.€€Mr.€Cavett€and€Mr.€Levitt€alsoÏreceived€some€assistance€from€Ms.€Ardena€Garth,€the€Public€Defender€forÏHamilton€County.€€Moreover,€defense€counsel€received€a€ð ðtremendous€amountÏof€assistanceðð€from€the€Capital€Case€Resource€Center.ÌÌà àAt€the€post„conviction€hearing,€Mr.€Cavett€testified€on€behalf€of€theÏappellant.€€He€stated€that,€prior€to€the€entry€of€the€appellantððs€plea,€he€met€withÏthe€appellant€at€least€five€times,€and€spent€approximately€66.4€hours€on€theÏappellantððs€case.€€He€carefully€reviewed€documents€pertaining€to€theÏappellantððs€case,€including€two€confessions€by€the€appellant€to€authorities€inÍFlorida€and€Tennessee.€ÌÓÓà8 àI€did€a€lot€of€research€at€the€time€to€make€sure€that€I€recalled€andÏunderstood€the,€the€law€concerning€the€death€penalty,€theÏaggravating/mitigating€factors€as€well€as€the€body€of€law€thatÏsurrounds€picking€juries€in€death€penalty€cases€...€.€€I€also€spentÏsome€time,€you€know,€researching€some€issues€related€to€theÏmotions€to€suppress€...€.€€I€also€spent€some€time€researching€theÏprocedure€for€having€a€psychologist€appointed€ex€parte.€...€€And,€ofÏcourse,€I€spent€a€lot€of€time€conferring€with€Mr.€Levitt€and€ArdenaÏGarth€about€the€case.€...€€I€think€the€bulk€of€my€time€involvedÏconferences€in€which€we€were€analyzing€the€case;€conferencesÏwith€[the€appellant]€about€the€propriety€of€entering€a€plea;Ïconferences€with€him€about€...€[the€possible]€outcome€of€theÏmotions€that€were€pending€and€so€forth€...€.ÌÌÓÓMr.€Cavett€stated€that€he€thoroughly€reviewed€the€facts€of€the€case€with€theÏappellant.€€He€further€observed€that€Mr.€Levitt€had€also€ð ðexpended€aÏconsiderable€amount€of€timeðð€working€on€the€appellantððs€case.€€Mr.€CavettÏutilized€the€considerable€results€of€Mr.€Levittððs€investigations.€€Moreover,Ïcounsel€arranged€an€evaluation€of€the€appellant€by€a€psychologist.€€Mr.€CavettÏcould€not€recall€whether€or€not€he€discussed€with€the€appellant€the€possibilityÏthat€the€appellant€had€been€intoxicated€at€the€time€of€the€offense.€€He€certainlyÏdid€not€recall€being€informed€of€any€involuntary€intoxication.ÌÌà àAccording€to€Cavett,€from€the€time€of€his€appointment,€he€wasÏconsidering€any€possible€mitigating€factors,€in€anticipation€of€the€penalty€phaseÏof€the€trial.€€Additionally,€with€respect€to€mitigation,€Mr.€Cavett€recounted€that€Mr.ÏLevitt€had€developed€a€ð ðclose,€ongoingðð€relationship€with€members€of€theÍappellantððs€family.€€The€record€further€reflects€that,€at€the€submission€hearing,Ïdefense€counsel€were€prepared€to€subpoena€approximately€fifty€witnesses€forÏthe€guilt€and€penalty€phases€of€the€trial.€€Mr.€Cavett€conceded,€ð ð[I]t€was€not€aÏcase€that€I€felt€was€going€to€be€won€at€trial€on€guilt€or€innocence€...€.ðð€€Moreover,ÏMr.€Cavett€believed€that,€had€the€appellant€elected€to€proceed€to€trial,€he€mayÏhave€received€the€death€penalty:ÌÓÓà8 à[W]hat€kept€going€through€my€mind€was€that€the€victim€wasÏmurdered€and€they€stole€one€dollar€from€him,€and€I€rememberÏhaving€visions€of€a€prosecutor€...€hammering€and€hammering€andÏhammering€away€at€the€fact€that€this€person€was€killed€for€oneÏdollar,€but,€you€know,€they€also€took€his€car.€...€[The€appellant]€didÏhave€some€strong€mitigating€factors€...€but€given€the€factsÏconcerning€the€case,€...€he€had€a€definite€risk€of€getting€the€deathÏpenalty.ÌÌÓÓMr.€Cavett€stated€that€the€appellant€pled€guilty€in€order€to€escape€the€possibilityÏof€the€death€penalty.ÌÌà àLloyd€Levitt€also€testified€at€the€post„conviction€hearing:ÌÓÓà8 à[The€appellant]€was€definitely€the€focus€of€my€practice€at€that€time,Ïbecause€it€was€such€a€serious€case.€...€Iððm€sure€Iððve€put€in€excessÏof€well€over€100€hours€on€the€case€...€.ÌÌÓÓIndeed,€at€the€pre„trial€hearing€on€December€16,€1991,€Mr.€Levitt€informed€theÏtrial€court€that€he€had€devoted€approximately€twenty„five€percent€of€his€practiceÏto€the€appellantððs€case.€€Moreover,€Mr.€Levitt€testified€at€the€post„convictionÏhearing€that€he€had€ÌÓÓà8 àreviewed€all€the€statements€that€[the€appellant€and€his€co„defendant]€had€given,€interviewed€numerous€witnesses,€talked€toÏfamily€members.€€I€had€a€lot€of€family€members€lined€up€asÏpotential€witnesses€in€the€case€as€far€as€[the€appellantððs]Ïcharacter.ÌÌà8 à...€[W]e€at€some€point€in€time,€I€think€after€the€death€penalty€noticeÏwas€filed,€asked€the€Court€to€let€us€retain€an€expert€...€Eric€Engum,Ïwho€has€got€excellent€credentials,€heððs€a€neuropsychologist.€€HeÏdid€an€examination€of€[the€appellant],€and€some€of€the€things€heÏhad€in€there€would€have€helped€more€on€the€sentencing€part€of€theÏcase€that€the€guilt€part€of€the€case€...€it€would€not€have€provided€usÏa€defense,€and€so€yeah,€Iððve€done€quite€a€bit€of€work€on€the€case,Ïinterviewing€witnesses,€reviewing€stateððs€evidence.ÌÌÓÓMr.€Levitt€stated€that€Mr.€Cavett€and€Ms.€Garth€duplicated€much€of€hisÏinvestigation€in€order€to€ensure€that€he€had€not€overlooked€anything.€€HeÏobserved:€ÌÓÓà8 àI€just€felt€strong€that€basically€[the€appellant]€had€made€a€horribleÏmistake€and€I€wanted€to€fight€for€him,€and€I€think€we€did€fight€forÏhim,€I€really€believe€that,€we€fought€hard€for€him.ÌÌÓÓMr.€Levitt€did€not€believe€that€the€appellant€had€ever€informed€him€that€he€wasÏintoxicated€at€the€time€of€the€offense.€€Mr.€Levitt€testified,€ð ðThere€is€no€way€weÏcould€have€avoided€a€first€degree€murder€conviction€in€that€case,€in€my€opinion.ðð€ÏHe€further€opined€that€the€appellant€could€probably€have€avoided€the€deathÏpenalty,€but€that,€given€the€circumstances€of€the€case,€a€risk€that€the€jury€wouldÏimpose€the€death€penalty€had€existed.ÌÌà àThe€record€additionally€reflects€that,€at€the€pre„trial€hearing€on€DecemberÏ16,€1991,€the€prosecuting€attorney€testified,€under€oath,€that,€in€the€appellantððsÍcase,€his€office€was€essentially€operating€pursuant€to€an€ð ðopen€file€policy.ðð€ÏMoreover,€he€observed€that€Mr.€Levitt€had€been€doing€an€ð ðexcellentðð€job.ÌÓÓà8 à[F]rom€what€Iððve€seen€so€far,€[defense€counsel]€are€aware€of€all€theÏissues€in€the€guilt€or€innocent€phase.€€Now€as€to€their€involvementÏin€the€sentencing€phase,€I€know€that€Mr.€Levitt€has€done€„„„€heÏturned€over€to€me€I€think€it€may€be€as€many€as€25€letters€or€moreÏfrom€everybody€within€the€community,€explaining€why€his€clientÏshould€not€be€sentenced€to€death.€...€€So€he€has€done€someÏsignificant€work€already€in€the€sentencing€phase.ÌÌÓÓThe€co„defendantððs€attorney,€an€attorney€with€considerable€experience€inÏcapital€litigation,€also€stated€to€the€trial€court€at€this€hearing€that,€while€he€wouldÏrecommend€the€appointment€to€the€appellantððs€case€of€an€attorney€experiencedÏin€capital€litigation,€Mr.€Levittððs€performance€had€been€ð ðexcellent.ðð€€He€stated,Ïð ðMr.€Levitt€is€a€highly€„„„€not€only€a€very€competent€lawyer,€but€a€very€„„„€a€lawyerÏwho€has€the€law€and€the€courts€at€heart.ððÌÌà àAt€the€post„conviction€hearing,€the€appellant€testified€on€his€own€behalf.€ÏHe€asserted€that€immediately€prior€to€the€offense,€he€and€his€co„defendant€hadÏbeen€drinking.€€The€appellant€had€also€smoked€approximately€five€or€sixÏmarijuana€cigarettes.€€After€smoking€the€cigarettes,€he€learned€that€his€co„defendant€had€laced€the€cigarettes€with€cocaine.€€Significantly,€however,€theÏappellant€could€not€recall€whether€the€cigarettes€had€impaired€his€mentalÏfaculties.€€He€did€recall€informing€his€attorneys€that€he€had€been€drinking€andÏsmoking€marijuana€prior€to€the€murder,€but€did€not€remember€mentioning€theÍcocaine.€€With€respect€to€his€plea€of€guilty,€the€appellant€testified:ÌÓÓà8 àI€thought€at€the€time€it€would€be€in€my€best€interest€if€I€was€able€toÏtake€a€life€sentence,€but,€you€know,€upon€me€doing€a€little€researchÏinside€the€Department€of€Corrections,€Iððve,€Iððve€concluded€„„€this€isÏmy€own€personal€thought€„„€that€maybe€I€shouldnððt€have€acceptedÏa€life€sentence,€you€know,€this€is€just€me.ÌÌÓÓHe€stated€that€his€attorneys€could€not€have€done€anything€more€to€assist€him,Ïother€than€represent€him€at€trial.€€Indeed,€the€transcript€of€the€submissionÏhearing€similarly€reflects€that€the€appellant€was€satisfied€with€the€representationÏthat€he€received.€€Finally,€the€appellant€wrote€to€Mr.€Levitt,€following€the€entry€ofÏhis€plea,€stating,€ð ðI€would€like€to€thank€you€once€again€for€doing€all€that€youÏcould€do€concerning€my€case€...€.ððÌÌÌÌà@ àò òòòII.€€Analysisóóó óÌà àIn€post„conviction€proceedings,€the€appellant€bears€the€burden€of€provingÏthe€allegations€in€his€petition.€€òòDavis€v.€Stateóó,€912€S.W.2d€689,€697€(Tenn.Ï1995).€€Moreover,€on€appeal,€this€court€is€bound€by€the€post„conviction€courtððsÏfindings€of€fact€unless€the€evidence€in€the€record€preponderates€against€thoseÏfindings.€€òòDavisóó,€912€S.W.2d€at€697.€€òòSee€alsoóó€òòBlack€v.€Stateóó,€794€S.W.2d€752,Ï755€(Tenn.€Crim.€App.€1990).ÌÌà
