Nashville,TN372011649 OPINIONFILED:򀀀AFFIRMEDJOEG.RILEY,JUDGE7uTXXdXXd7@ OPINION  Thepetitioner,JoeThomasBaker,Jr.,appealstheorderoftheCriminalCourtofDavidsonCountydismissinghispetitionforwritofhabeascorpus.Heispresentlyservingconcurrentsentencesoflifeimprisonmentand35yearsforfirstdegreemurderandarmedrobbery.Afterahearing,thetrialcourtfoundthathewasinthelawfulcustodyoftheTennesseeDepartmentofCorrectionanddismissedhispetition.Weaffirm.@ I̜ Bakerarguesthattheauthoritytodeterminethelengthofasentenceisexclusivelyajudicialfunction.HecontendstheBoardofParolesisvestedwiththepowertograntordenyparole;therefore,theBoardisperformingajudicialfunctioninviolationoftheseparationofpowersdoctrine.ThefactthattheBoardofParolesdeterminesthegrantingordenialofparoledoesnotviolatetheseparationofpowersdoctrine.Theauthoritytograntparolesisnotjudicialinnaturebutisadministrative.Woodsv.State,130Tenn.100,169S.W.558(1914).Accordingly,thereisnoviolationoftheseparationofpowersdoctrine.Thisissueiswithoutmerit.@ II BakerclaimsthatT.C.A.4035501createsindeterminatesentencesinviolationofT.C.A.4035211,whichprohibitsindeterminatesentences.HisargumentrestsonthefactthattheBoardofParoleshasthepowertograntordenyparoleuponadefendantseligibilityforreleasepursuanttoT.C.A.4035501.Therefore,Bakercontendsthathissentenceisindeterminateand,asaresult,voidonitsface. AlthoughT.C.A.4035211prohibitsindeterminatesentences,theϜsentenceimposeduponBakerisnotindeterminate.ThemerefactthattheBoardofParolesmaygrantordenyparoledoesnotconvertadeterminatesentenceintoanindeterminatesentence.Paroledoesnotcausethesentencetoexpireorterminatebutismerelyaconditionalrelease.SeeDoylev.Hampton,207Tenn.399,340S.W.2d891(1960).Thisissuehasnomerit.
