àOn€March€15,€1994,€the€appellant€was€involved€in€a€two€car€collision€onÏInterstate€40€in€Roane€County.€€The€collision€tragically€resulted€in€the€death€ofÍJames€Basim,€the€driver€of€the€second€car.€€The€investigating€officer€detected€aÏstrong€odor€of€alcohol€about€the€appellantððs€person.€€A€subsequent€testÏrevealed€a€blood€alcohol€content€of€.23€percent,€confirming€the€officerððsÏsuspicion€of€intoxication.€€Moreover,€on€the€date€of€this€offense,€the€appellantððsÏdriving€privileges€were€revoked€due€to€a€recent€conviction€for€driving€under€theÏinfluence.€€ÌÌà àThe€appellant€did€not€testify€at€his€sentencing€hearing.€€However,€heÏmade€the€following€statement€to€the€probation€officer€who€prepared€theÏpresentence€report:€ÌÒ ` ÒÒ ` ÒÓÓI€donððt€know€why€I€awas€[sic]€on€Interstate€where€I€live€is€notÏon€my€way€home.€€Randy€Kirby€Deputy€Sheriff€said€I€hit€aÏtruck€that€was€already€in€a€wreck€on€interstate,€but€wonððt€sayÏanything€else€about€it.€€A€hospital€nurse€said€I€had€aÏdiabetic€black€out,€donððt€remember€anything€else€at€all.€ÏWas€only€a€[sic]€bar€from€9:45€p.m.€[un]til€11:45€p.m.€€OnlyÏhad€4€beers€in€that€time€frame.€€Iððm€not€a€mean€or€violentÏperson.€€Never€been€in€any€trouble€or€any€other€feloney€[sic]Ïcarges€[sic]€or€no€kind€of€trouble€at€all.€€Ò  ÒÒ ° ÒÓÓÌÌà@ àò òòòII.€€The€Length€of€the€Sentenceóóó ó€€€ÌÌà àThe€appellant€first€contends€that€his€sentence€of€four€years€for€vehicularÏhomicide€is€excessive.€€Vehicular€homicide€is€a€class€C€felony.€€Tenn.€CodeÏAnn.€ðð€39„13„213(b)€(1991).€€Because€the€appellant€was€sentenced€as€a€range€IÍstandard€offender,€he€was€potentially€subject€to€a€sentence€of€not€less€thanÏthree€nor€more€than€six€years€incarceration.€€Tenn.€Code€Ann.€ðð€40„35„112(a)(3)€(1990).ÌÌà àReview,€by€this€court,€of€the€length,€range,€or€manner€of€service€of€aÏsentence€is€òòde€novoóó€with€a€presumption€that€the€determination€made€by€the€trialÏcourt€is€correct.€€Tenn.€Code€Ann.€ðð€40„35„401(d)(1990).€€The€presumption€ofÏcorrectness€is€ð àThe€record€indicates€that€the€trial€court€applied€the€enhancement€factorÏset€forth€in€Tenn.€Code€Ann.€ðð€40„35„114(1)(Supp.€1994),€which€encompassesÏdefendants€"with€a€previous€history€of€criminal€convictions€or€criminal€behaviorÏin€addition€to€those€necessary€to€establish€the€appropriate€range."€€The€recordÏsupports€the€application€of€this€factor.€€The€presentence€report€reflects€that,€onÏSeptember€24,€1993,€the€appellant€drove€under€the€influence€of€an€intoxicant€inÏRoane€County.€€He€was€convicted€of€this€offense€on€November€29,€1993,€andÏwas€sentenced€to€48€hours€incarceration,€followed€by€a€probationary€period€ofÏ11€months€and€29€days.€€The€record€also€indicates€that,€on€September€24,Ï1993,€the€appellant€was€driving€on€a€revoked€license.€€Although€the€appellantÏwas€not€convicted€of€this€offense€until€April€18,€1993,€approximately€one€monthÏfollowing€the€commission€of€the€instant€offenses,€a€court€may€consider€theÏunderlying€conduct€in€applying€enhancement€factor€(1).€€òòState€v.€Masseyóó,€757ÏS.W.2d€350,€352€(Tenn.€Crim.€App.),€òòperm.€to€appeal€deniedóó,€(Tenn.€1988);€ÏòòState€v.€Bunnóó,€No.€01C01„9311„CC„00401€(Tenn.€Crim.€App.€at€Nashville,ÍNovember€22,€1994).× ƒ& ××  ×€ÌÌà àThe€trial€court€did€not€apply€any€mitigating€factors.€€The€appellant€arguesÏthat€the€trial€court€should€have€considered€his€ð ðill€healthðð€as€a€mitigating€factor.€ÏThe€record€reveals€that€the€appellant€is€diabetic€and€requires€regularÏmedication.€€However,€the€appellant€fails€to€explain€why€his€ð ðill€healthðð€shouldÏreduce€the€length€of€his€sentence.€€The€burden€of€proving€applicable€mitigatingÏfactors€rests€upon€the€appellant.€€òòState€v.€Mooreóó,€No.€03C01„9403„CR„00098Ï(Tenn.€Crim.€App.€at€Knoxville,€September€18,€1995),€òòperm.€to€appeal€deniedóó,Ï(Tenn.€1996).€€Therefore,€while€Tenn.€Code€Ann.€ðð€40„35„113(8)€(1990)€allowsÏa€court€to€consider€any€physical€condition€that€significantly€reduced€theÏappellant's€culpability,€the€appellant€has€not€sufficiently€established€a€causalÍlink€between€his€physical€ailment€and€the€instant€offense.€€Moreover,€it€isÏunclear€how€the€reduction€of€a€sentence€because€of€the€ill€health€of€a€defendantÏis€consistent€with€the€purposes€of€the€Sentencing€Act.€€Tenn.€Code€Ann.€ðð€40„35„113€(13).€€Indeed,€we€have€previously€suggested€that,€in€general,€specialÏconsideration€in€sentencing€because€of€ill€health€frustrates€the€purpose€of€theÏAct,€to€prevent€crime€and€promote€respect€for€the€law€by€providing€an€effectiveÏgeneral€deterrent€to€those€likely€to€violate€the€criminal€laws€of€this€state.€€òòState€v.ÏMcIntoshóó,€No.€85„27„III€(Tenn.€Crim.€App.€at€Nashville),€òòperm.€to€appeal€deniedóó,Ï(Tenn.€1986);€Tenn.€Code€Ann.€ðð€40„35„102(3)(A).× ƒ' ××  ×€€Thus,€the€appellant's€illÏhealth€is€not€an€appropriate€mitigating€factor.ÌÌà àHaving€found€the€presence€of€one€enhancing€factor€and€no€mitigatingÏfactors,€we€conclude€that€a€sentence€of€four€years€is€justified.ÌÌÌÌà@ àòòò òIII.€€Consecutive€Sentencingóóó óÌÌà àThe€appellant€contends€that€the€trial€court€should€not€have€orderedÏconsecutive€service€of€the€appellant's€sentences.€€First,€the€appellant€arguesÏthat€the€trial€court€failed€to€state€on€the€record€the€rationale€for€consecutiveÏsentencing.€€Second,€the€appellant€asserts€that€there€is€no€statutory€basis€for€theÏimposition€of€consecutive€sentences.ÌÌà
