Inthisappealasofright,thedefendantcontendsthathisconvictionscannotstandbecauserecklessendangermentisnotalesserincludedoffenseofattemptedfirstdegreemurder.TheStateconcedesthedefendantspoint,butarguesthatthedefendantsindictmentswereamendedwiththedefendantsconsenttoincludetheoffenseofrecklessendangerment.Thedefendantalsocontendsthat,evenifhisconvictionsforrecklessendangermentcanstandundertheindictments,hecanproperlybeconvictedonlyofthemisdemeanorversionofthatoffense.Afterareviewoftherecord,weaffirmtheconvictions.  Wefirstnotethatneitherofthedefendantsissueswasraisedinhismotionfornewtrial,andarethereforewaived.T.R.A.P.3(e).However,evenconsideredonthemerits,wefindnoreversibleerror.    Thefirstindictmentagainstthedefendantreadsasfollows:       ` RobertW.BentleyonMarch15,1994,inShelbyCounty,Tennessee,andbeforethefindingofthisindictment,didunlawfullyattempttocommittheoffenseofFirstDegreeMurder,asdefinedinT.C.A.[]3913202;inthathe,thesaidRobertW.Bentley,didunlawfully,intentionally,deliberatelyandwithpremeditationattempttokillAlicia%  Horton,inviolationofT.C.A.[]3912101,againstthepeaceanddignityoftheStateofTennessee. D   Thesecondindictmentisidentical,otherthanthenameofthevictim.  Noamendmentstotheindictmentsweremadepriortotrial.However,afterthecloseofallproof,defensecounselrequestedajuryinstructionontheoffenseofrecklessendangerment, ,   ׀apparentlythinkingthatitwasalesserincludedoffenseofattemptedfirstdegreemurder.TheStatemadenoobjection.Thecourtrespondedthatitwouldincludeaninstructiononthe classEfelony,recklessendangerment.Theonlyobjectionnotedbydefensecounselatthatpointwasthetrialcourtsrefusaltoalsoincludeachargeonaggravatedassault.  Thejurychargegivenbythejudge(asevidencedbyacopyinthetechnicalrecordbutnottranscribedfromtheactualinstructionsgiven)includedthefollowing:    ӜAnypersonwhocommitstheoffenseofrecklessendangermentisguiltyofacrime.Foryoutofindthedefendantguiltyofthisoffense,thestatemusthaveprovenbeyondareasonabledoubttheexistenceofthefollowingessentialelements:  8 L   (1)thatthedefendantengagedinconductwhichplacedormighthaveplacedanotherpersoninimminentdangerofdeathorseriousbodilyinjury;and(2)thattheoffensewascommittedwithadeadlyweapon;and(3)thatthedefendantactedrecklessly. D   ThisisaportionoftheTennesseePatternJuryInstructiononfelonyrecklessendangerment.Noinstructionwasgivenonmisdemeanorrecklessendangerment.  Thejuryinstructiononrecklessendangerment,givenwiththeconsentofbothparties,constituted,ineffect,anamendmenttothedefendantsindictments.Whilenooneattrialspecificallyaddressedthenecessityofamendingtheindictmentstoincludetheoffenseofrecklessendangerment,thisoversightwasmerelytheresultofthetrialcourt,defensecounselandtheStateallmistakenlyconcludingthatrecklessendangermentisalesserincludedoffenseofattemptedfirstdegreemurder.However,indictments maybeamendedinallcaseswiththeconsentofthedefendant.Tenn.R.Crim.P.7(b).Thedefendanthere,throughhiscounsel,notonlyconsentedtobeingtriedonthechargeofrecklessendangerment,butactivelysoughtthisresult.Forthepurposesofthisappeal,wefindthedefendantsactionstohaveconstitutedconsenttoaneffectiveamendmenttohisindictments. .   ׀Hewillnotnowbeheardtocomplainaboutconvictionsonanoffensewhich,withouthisowncounselsintervention,wouldnothavebeenchargedtothejury.SeeT.R.A.P.36(a)( Nothinginthisruleshallbeconstruedasrequiringreliefbegrantedtoapartyresponsibleforanerrororwhofailedtotakewhateveractionwasreasonablyavailabletopreventornullifytheharmfuleffectofanerror.)Thisissueiswithoutmerit.  Thedefendantalsocomplainsthathewasimproperlysentencedforcommittingafelonybecausethejuryverdictfoundhimguiltymerelyof recklessendangerment,aclassAmisdemeanor,ratherthanof recklessendangermentwithadeadlyweapon,aclassEfelony.However,thejuryverdictactuallyrecites(twice)that We,thejury,findthedefendantguiltyofrecklessendangermentasincludedintheindictment.Theindictmentswereeffectivelyamended,assetforthabove,toincludeonlythefelonyversionofrecklessendangerment.Nomentiontothejurywasevermade,asfarasisrevealedbytherecord,ofmisdemeanorrecklessendangerment.Moreover,thejudgmentsenteredbythetrialcourtdescribethedefendantsconvictionoffensesasrecklessendangermentandspecifytheconvictionclassasEfelony.Thus,thedefendantwassentencedappropriately.Thisissueiswithoutmerit.
