Infootnote11oftheopinioninthiscase,wenotedthatthetrialcourt'sinstructionondeliberationwas"arguablymisleadingandpartiallyerroneous"inthatitinformedthejury"itisimmaterialthattheaccusedmayhavebeeninastateofpassionorexcitementwhenthedesign[tokill]wascarriedintoeffect."WecitedtoStatev.Brooks,880S.W.2d390(Tenn.Crim.App.1993),notingthattheinstruction"appearstobeoutofcontext...andtheemphasizedphraseshouldnothavebeenincluded."Weconcluded,however,thatanyerrorintheinstructionwasmerelyharmlessbecauseofthe"overwhelming"proofofdeliberationintherecordandthefactthattheoverallinstructionwas"clearlydistinguishable"fromtheinstructionheldtobeerroneousinBrooks.  ThestateclaimsthatbecausetheinstructioninthepresentcaseissubstantiallydifferentfromtheinstructionheldtobeerroneousinBrooks,anycomparisonbetweenthetwoisunwarranted.Specifically,thestateassertsthattheinstructioninthecasesubjudicesufficientlydistinguishesbetweentheelementsofpremeditationanddeliberation.WhiletheCourtinBrooksbaseditsholdinginpartupontheinstruction'sfailuretodelineatebetweenthetwoelements,ourreferenceinfootnote11totheBrooksinstructionwasnotaddressedtothedistinctionbetweenthesetwoelements.Theinstructioninthepresentcasecorrectlynotedthedifferencebetweenpremeditationanddeliberation.Rather,theinstructionondeliberationmisconstruedthefactthatdeliberationrequires"thattheactbeonecommittedwith'acoolpurpose'andwithoutpassionorprovocation."T.C.A.3913201(b)(1)andSentencingCommissionComments.  Accordingly,whileweacknowledgethestate'scommentsdistinguishingBrooksfromthepresentcase,wedonotbelievethedictaassertedinfootnote11contravenestheCourt'sholdinginBrooks.Althoughweconcludedthatanyerrorintheinstructionwasmerelyharmless,weraisedtheissuesimplytobringittotheattentionoftheSupremeCourtandallinterestedparties.ItisherebyORDEREDthatthestate'spetitionforarehearingiswithoutmeritandis,therefore,respectfullydenied.  Eventhoughwehavedeniedthestate'spetitionbaseduponthemeritstherein,wearenotcertainthisCourthastherequisitejurisdictiontoentersucharuling.AlthoughT.R.A.P.39(b)providesthatapartymayfileapetitionforrehearingwithinten(10)daysafterentryofjudgmentinthecase,T.C.A.3913206(a)(1)(1995supp.)specificallystatesthat"[u]pontheaffirmanceby[thiscourtofacaseinwhichthedeathpenaltywasimposed],theclerkshalldocketthecaseinthesupremecourtandthecaseshallproceedinaccordancewiththeTennesseeRulesofAppellateProcedure."Accordingly,thereappearstoustobeaconflictbetweentherulesandthestatute,whichcouldaffectthejurisdictionofthisCourt.Nonetheless,evenifwehavejurisdictionoverthestate'spetitionforrehearing,wewouldstilldenythepetitiononitsmerits.̀  ENTER,thisthe___dayofApril,1996.     ____________________________________     PAULG.SUMMERS,JUDGE     ____________________________________     DAVIDH.WELLES,JUDGE     ____________________________________     WILLIAMM.BARKER,JUDGE
