U     Wefindnomerittotheissueandaffirmthejudgmentofthetrialcourt.  OnApril7,1992,thepetitionerpledguiltytofelonymurder.DuringapartyattheKentuckyresidenceofRonnieOllerandPennyOller,thepetitionerandtheOllersdecidedtodrivetoTennesseetorobthevictim,Dr.GulTelwar,whohadbeentheirformeremployer.Thepetitionerbrokeintoabackwindowofanofficetrailerlocatedonthevictim'scarlotandwaitedforthevictimtoarrive.TheOllersremainedinthecar.Uponthevictim'sarrivalaboutanhourlater,therewasanargumentoveracartitle;thepetitionershotthevictimeighttimes,tookhisbillfoldandseveralcarkeys,andescapedthroughthetrailerwindow.  Severaldayslater,thepetitionergaveavideotapedstatementtopolice.Duringaconferencewithhisattorney,thepetitionerinsistedthatbecausehewasdrunk,hedidnotremembertheeventssurroundingthemurder.Afterresearchingtheissue,defensecounseldecidedthatintoxicationwouldnotbeaplausibledefensetothefelonymurdercharge.Thepetitionerthenpledguiltytofelonymurderandreceivedalifesentence.Therewasnodirectappeal.VW  % 0 Whenapetitionerseekspostconvictionreliefonthebasisofineffectiveassistanceofcounsel,hemustfirstestablishthattheservicesrenderedortheadvicegivenwasbelow"therangeofcompetencedemandedofattorneysincriminalcases."Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Second,hemustshowthatthedeficiencies"actuallyhadanadverseeffectonthedefense."Stricklandv.Washington,466U.S.668,693(1984).Shouldthepetitionerfailtoestablisheitherfactor,noreliefiswarranted.Astoguiltypleas,thepetitionermustestablishareasonableprobabilitythat,butfortheerrorsofhiscounsel,hewouldnothaveenteredthepleaandwouldhaveinsistedongoingtotrial.Hillv.Lockhart,474U.S.52,59(1985).XԀRԀ  Onappeal,thefindingsoffactmadebythetrialcourtareconclusiveandwillnotbedisturbedunlesstheevidencecontainedintherecordpreponderatesagainstthem.Rhodenv.State,816S.W.2d56,60(Tenn.Crim.App.1991);Brooksv.State,756S.W.2d288,289(Tenn.Crim.App.1988).Theburdenisonthepetitionertoshowthattheevidencepreponderatedagainstthosefindings.Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978).  Thepetitionerarguesthatvoluntaryintoxicationisadefensetofelonymurderiftheunderlyingcharge,suchasespeciallyaggravatedburglaryorespeciallyaggravatedrobbery,containedaspecificintentrequirement.Heclaimsthatthecaseshouldhavebeentriedbeforeajury,relyingonthisdefense.Thepetitioneralsocontendsthatbecauseintoxicationwouldhavebeenacompletedefensetobothfirstandseconddegreemurder,hecouldhavebeenconvictedofnothingmorethanvoluntarymanslaughter.  Thetrialcourtfoundthatatapedstatementbythepetitionerprovideddetailsofthekillingthatonlyoneinvolvedintheshootingwouldknow.Implicitinthisfindingisthefindingthatthepetitionerwasnotsointoxicatedthathecouldnotremembertheeventssuroundingthemurderashelatertriedtoclaim.Thetrialcourtalsofoundthatdefensecounselwaseffectiveinhisrepresentationofthepetitioner.O  RDefensecounseltestifiedthatitwashisopinionthatintoxicationwouldnotbeaneffectivedefenseforthepetitioner.Weagree.Atthetimeoftheoffense,felonymurderwasdefinedas"[a]recklesskillingofanothercommittedintheperpetrationof,orattempttoperpetrate"anyoftheenumeratedfelonies.Tenn.CodeAnn.3913202(a)(2)(1991repl.).Voluntaryintoxicationisnotadefensetocrimesinvolvingarecklessmensrea:"Ifrecklessnessestablishesanelementofanoffenseandthepersonisunawareofariskbecauseofvoluntaryintoxication,theperson'sunawarenessisimmaterialinaprosecutionforthatoffense."Tenn.CodeAnn.3911502(b)(1991repl.).Inconsequence,defensecounselcannotbefaultedforfailingtopursueanintoxicationdefense.Itcouldnothavebeensuccessful.  Inourview,therewereotherfactorsthatinfluencedtrialcounsel'srecommendationtothepetitionertoacceptapleaagreement.RonnieOllerhadalreadybeenconvictedofmurderandsentencedtolifeplustwentyyears.BothOllerandhiswifeweretobewitnessesforthestateatthepetitioner'strial.Thestatehadavideotapedconfessionfromwhichthejurycouldassessfirsthandthepetitioner'smentalcapacity.Aguiltyplea,underthesecircumstances,mayhavebeenasoundtacticaldecision.Defensecounselappearstohaveconductedanadequateinvestigation,includinglegalresearch,beforerecommendingtheplea.Therecordalsoestablishesthatthepetitionermadeaknowingandvoluntarypleabaseduponadvicefromhiscounsel.Fromallofthis,wecannotfinddeficiencyintheperformanceofcounsel.Therewasabasisinthelawforhisadvicetothepetitioner.̀  Accordingly,thejudgmentofthetrialcourtisaffirmed.      򀀀      GaryR.Wade,JudgeCONCUR:򀀀DavidG.Hayes,Judge򀀀CurwoodWitt,Judge
