à1.€€Whether€the€trial€court€erred€in€sentencing€him€to€a€three€yearÏsentence€out€of€a€possible€range€of€two€to€four€years€for€theÏoffense€of€obtaining€a€controlled€substance€by€fraud.ÌÌà8 à2.€€Whether€the€trial€court€erred€by€refusing€to€place€him€onÏcommunity€corrections.ÌÌÓÓWe€affirm.ÌÌà àIn€April€of€1993,€the€appellant€forged€and€presented€two€stolen€checks.€ÏIn€May€of€1993,€he€stole€jewelry€valued€at€less€than€$€500.00.€€In€July€of€1993,Ïhe€was€arrested€for€forgery€and€released€on€bond.€€Following€his€release€onÏbond,€he€passed€ten€worthless€checks.€€He€then€fled€to€Virginia€and€failed€toÏappear€at€his€forgery€hearing.€€In€March€of€1994,€the€appellant€returned€toÏTennessee.€€While€on€bond€for€the€above€offenses,€he€obtained€twoÏprescriptions€for€Lorcet€and€one€prescription€for€Hydrocodone€by€means€ofÏmisrepresentation.€€Appellant€then€jumped€bail€for€a€second€time€because€heÏ"was€afraid€of€going€to€jail."ÌÌà àAppellant€testified€that€he€drafted€bad€checks€and€pawned€stolenÏproperty€to€support€his€drug€addiction.€€He€had€previously,€but€unsuccessfully,Ïattended€long€term€treatment,€AA,€and€NA.€€He€had€twice€been€on€methadone.€ÏHe€is€HIV€positive€and€has€hepatitis€B.€€He€also€has€a€pending€DUI€œcharge.ÌÌÌÌÓ  Óò òòòLENGTH€OF€SENTENCEóóó óÌÓ  Óà àThe€appellant€argues€that€the€trial€judge€erred€in€sentencing€him€to€aÏmid„range€sentence€for€obtaining€a€controlled€substance€by€misrepresentation.€ÍHe€contends€that€he€should€have€received€the€minimum€sentence€of€two€years.× ƒ1 ××  ×€ÏIn€response,€the€state€enigmatically€concedes€to€application€of€two€mitigatingÏfactors.× ƒ2 ×× àThe€trial€judge€issued€a€mid„range€sentence€without€explanation.€ÏAlthough€neither€party€proffered€specific€sentencing€factors€for€application,€itÍwas€incumbent€upon€the€trial€judge€to€express€which€factors,€if€any,€were€foundÏto€apply.€€Accordingly,€our€review€is€òòdeóó€òònovoóó.ÌÌà àThe€record€supports€application€of€enhancement€factors€sufficient€toÏwarrant€a€mid„range€sentence.€€The€appellant€has€a€previous€history€of€criminalÏbehavior,€and€the€felony€was€committed€while€on€bail€for€another€felony€ofÏwhich€he€was€ultimately€convicted.€€Tenn.€Code€Ann.€ðð€40„35„114(2)›€&€(13)Ï(1995€Supp.).€€In€mitigation,€we€find€that€the€appellant's€conduct€neither€causedÏnor€threatened€serious€bodily€injury.€€Tenn.€Code€Ann.€ðð€œ40„35„113(1)›€(1990ÏRepl.)€€We€are€unpersuaded,€however,€that€his€conduct€was€mitigated€by€hisÏown€voluntary€use€of€drugs.× à(B)€€Confinement€is€necessary€to€avoid€depreciating€theÏseriousness€of€the€offense€or€confinement€is€particularly€suited€toÏprovide€an€effective€deterrence€to€others€likely€to€commit€similarÏoffenses;€orÌÌà8 àThe€trial€judge€found€that€the€appellant€was€not€"a€proper€candidate€forÏrelease"€into€the€community.€€In€support€of€his€findings,€the€trial€judge€cited:€€(1)€Íthe€appellant's€violent€propensity,€(2)€€his€history€of€fleeing€prosecution,€(3)€€theÏfact€that€he€committed€offenses€while€on€bail,€(4)€€the€fact€that€he€committed€hisÏcrimes€over€a€period€of€approximately€one€and€one€half€years,€(5)€€his€history€ofÏhaving€twice€jumped€bail,€(6)€€his€history€of€extensive€criminal€activities,× ƒ4 ××  ×€and€(7)€Ïhis€lack€of€amenability€to€successful€rehabilitation€in€the€community.× ƒ5 ××  ×›ÌÌà
