àThe€defendant€was€apprehended€through€the€use€of€a€confidentialÏinformant,€Kim€Orange.€€Officer€Jim€Harris,€director€of€Blount€Metro€Narcotics,Ïarranged€with€Orange€for€her€to€make€cocaine€purchases.€€Orange€was€paid€fiftyÍdollars€($50)€per€purchase.€ÌÌà àà àOn€March€26,€1993,€Orange€contacted€Officer€Harris€and€told€him€sheÏð ðhad€a€cocaine€deal€set€up€for€that€afternoon.ðð€€Officer€Harris€then€met€with€OrangeÏand€furnished€her€some€surveillance€equipment,€including€a€tape€recorder€to€recordÏher€phone€conversations€and€a€radio€transmitter.€€The€purpose€of€the€transmitter€wasÏto€enable€officers€stationed€near€Orangeððs€residence€to€simultaneously€monitor€andÏrecord€her€conversations€with€people€within€her€house.€€Officer€Harris€also€providedÏOrange€the€cash€needed€to€make€the€buy.ÌÌà àà àAfter€giving€her€the€equipment,€Officer€Harris€returned€to€his€office.€ÏShortly€thereafter,€Orange€called€him€and€told€him€that€she€had€recorded€a€phoneÏcall.€€Officers€Harris€and€Scott€Carpenter€then€stationed€themselves€near€OrangeððsÏhouse,€arriving€at€2:20€p.m.€€About€thirty€minutes€later,€Leonard€Brantley€drove€upÏand€went€into€Orangeððs€residence.€€While€he€was€in€the€house,€the€officers€listened€toÏand€taped€his€conversation€with€Orange.€€After€two€minutes,€Brantley€left€and€droveÏaway.€€The€police€did€not€follow€him.€€A€few€minutes€later,€Orange€walked€to€theÏofficersðð€car,€returned€the€surveillance€equipment,€and€delivered€a€plastic€bagÏcontaining€cocaine.ÌÌà àà àThe€testimony€at€trial€established€that€Orange€had€three€phoneÏconversations€with€the€defendant,€two€of€which€were€recorded,€in€which€sheÏrequested€to€purchase€a€ð ðsixteenthðð€of€cocaine,€and€in€which€the€price€of€this€buy€wasÏset.€€The€testimony€further€established€that,€within€less€than€an€hour€of€theseÏconversations,€Brantley€drove€up€to€Orangeððs€house€and€delivered€the€agreed€uponÏamount€of€cocaine€for€the€agreed€upon€price.€€There€was€no€evidence€whatsoeverÏthat€Brantley€had€obtained€the€cocaine€from€anyone€other€than€the€defendant.ÌÌà àAlthough€the€defendant€spends€many€words€arguing€that€the€StateÏnever€proved€that€she€possessed€the€cocaine€either€actually€or€constructively,€weÏdisagree.€€The€second€recorded€phone€call€between€the€informant€and€the€defendantÏreveals€that€the€person€who€will€deliver€the€cocaine€must€first€come€to€theÏdefendantððs€house€to€pick€it€up.€€Specifically,€when€the€informant€asked€if€ð ðtheyðð€haveÍto€come€to€ð ðyour€houseðð€to€get€ð ðit,ðð€the€defendant€replied€yes.€€Thus,€the€jury€couldÏreasonably€conclude€that€the€cocaine€was€located€at€the€defendantððs€residence.€€ð àà à€€The€ð ðnewly€discovered€evidenceðð€in€this€case€consisted€in€part€ofÏOrangeððs€œmisdemeanor›€arrest€for€drug„related€activity€which€she€allegedly€engagedÏin€after€the€trial.€€The€trial€court€found€that€this€was€not€ð ðthe€type€of€evidence€that€isÏcontemplated€by€newly„discovered€evidence€to€justify€a€new€trial.ðð€€The€trial€courtÏwas€correct€in€this€respect€because€the€activity€for€which€Orange€was€arrestedÏoccurred€after€the€trial.€€€The€concept€of€newly€discovered€evidence€involvesÏevidence€which€actually€existed€as€of€the€time€of€trial,€but€went€undiscovered€throughÏno€lack€of€diligence€on€the€part€of€the€defendant€(or€her€counsel).ÌÌÓÓà àà àAlso€presented€as€newly€discovered€evidence€was€Brantleyððs€testimony€ÌÌthat€he€had€not€obtained€the€cocaine€from€the€defendant€on€the€day€in€question,€and€ÌÌthat€he€had€not€delivered€any€cocaine€to€Orange€on€the€day€in€question.€€BrantleyÏhad€ÌÌbeen€served€on€the€morning€of€the€new€trial€hearing€with€an€indictment€charging€him€ÌÌwith€possessing,€selling€and€delivering€cocaine€in€the€same€incident€for€which€the€ÌÌdefendant€was€convicted.€€After€hearing€€Brantleyððs€testimony,€the€trial€court€found€ÌÌÌÒ ô ÒÒ ° Òthat,€number€one,€he€[Brantley]€has€a€serious€felony€record,€[and]Ïnumber€two,€he€has€trafficked€in€drugs€before€and€.€.€.€he€isÏcharged€as€a€co„defendant€or€is€indicted€for€the€same€transactionÏthat€[the€defendant]€was€convicted€of.€€His€demeanor€on€theÏwitness€stand€does€not€do€anything€to€help€his€credibility.€€AndÏwhen€taken€together€with€his€record€and€his€testimony€about€hisÏdealings€in€controlled€substances,€his€testimony€that€he€was€notÏat€Ms.€Orangeððs€home€on€that€day,€I€donððt€think,€is€going€to€carryÏmuch€weight€and€is€not€very€apt€to€affect€the€outcome.ÌÌÌÌÒ
