ðsummons,ðð€but€which€in€substance€isÏworded€more€as€a€show€cause€order,€was€issued€by€the€deputy€court€clerk€onÏMarch€17,€1994€and€listed€the€address€for€the€Defendant€as:€ÌÓӜǛà àà àà àà à121€Clark€StreetÌà àà àà àà àKingsport,€TN€37660Ìà àà àà àà à(Sull€Co€Jail€After€3/8/94)ÌÓÓà àà àà àà àà àÌà àà àThe€ð ðsummonsðð€reflects€that€Defendant€was€served€by€personalÏservice€at€the€Sullivan€County€Jail€by€a€deputy€sheriff€on€March€18,€1994.€€ItÏgave€Defendant€notice€to€appear€in€the€Criminal€Court€of€Sullivan€County€onÏJune€17,€1994€at€9:00€a.m.€and€to€show€cause€why€he€should€not€be€bannedÏfrom€operating€a€motor€vehicle€ð ðaccording€to€the€Petition€which€is€herewith€servedÏupon€you.ðð€€Furthermore,€it€stated€that€if€the€Defendant€failed€to€appear€asÏordered,€judgment€by€default€would€be€rendered€against€him€for€the€reliefÏdemanded€in€the€petition.€€The€petition€was€not€made€a€part€of€the€record€onÏappeal.€€ÌÌà àà àOn€June€17,€1994,€the€Defendant€did€not€appear€and€no€attorneyÏmade€any€appearance€or€otherwise€made€any€defense€on€behalf€of€theÏDefendant.€€On€the€court€date,€the€Defendant€was€no€longer€incarcerated€at€theÏSullivan€County€Jail,€but€had€been€transferred€to€the€Brushy€Mountain€StateÏPrison€in€Morgan€County.€€At€this€hearing€on€June€17,€1994,€the€State€moved€forÏa€judgment€by€default€against€the€œDefendant,›€and€this€motion€was€granted€byÏthe€trial€court.€€ÌÌÌà àOn€June€24,€1994,€a€default€judgment€was€prepared€by€the€officeÏof€the€District€Attorney€General€and€was€forwarded€to€the€trial€court€judge€with€aÏcertificate€of€service€signed€by€an€Assistant€District€Attorney€General€that€aÏcopy€of€the€judgment€had€been€sent€to€the€Defendant€ð ðat€his€last€knownÏaddress.ðð€€The€default€judgment€states€on€its€face,€below€the€signature€for€theÏcertificate€of€service€as€follows:€ð ðReturn€of€Service€ofÏDefault€Judgmentðð€was€signed€July€20,€1994€[sic]€by€Deputy€Sheriff€MarkÏDucker€and€contained€thereon€handwritten€markings€that€the€Defendant€ððDoesnððtÍlive€at€address.ðððð€€Additional€handwritten€markings€near€the€DefendantððsÏaddress€were€ð ðex„wifeððs€house,ðð€ð ðdonððt€live€here,ðð€ð ðcheck€3340€Adline,ððÏð ðGrandmotherððs€Home,ðð€and€ð ðBloomingdale€Pike€area.ðð€ÌÌà àà àIt€is€not€clear€from€the€Stipulation€of€Facts€whether€or€not€theÏaddress€listed€on€the€ð ðReturn€of€Service€of€Default€Judgmentðð€prepared€by€theÏDistrict€Attorney€was€the€121€Clark€Street,€Kingsport,€Tennessee€address.€€ÌÌà àà àThe€envelope€sent€to€the€Defendant€at€121€Clark€Street,€Kingsport,ÏTennessee€37660,€containing€the€copy€of€the€default€judgment€as€per€theÏcertificate€of€service,€was€not€returned€as€undelivered€by€the€Postal€Service€toÏthe€office€of€the€District€Attorney€General.€The€Defendant€maintained€that€heÏnever€personally€received€a€copy€of€the€default€judgment€prior€to€his€arrest€onÏNovember€25,€1994€for€operating€a€motor€vehicle€in€violation€of€the€habitualÏmotor€vehicle€offender€order.€ÌÌà àOn€January€23,€1995,€the€grand€jury€of€Sullivan€County€returned€anÏindictment€charging€the€Defendant€with€Violation€of€the€Habitual€Motor€VehicleÏOffender€Act,€alleging€that€an€offense€was€committed€by€the€Defendant€onÏNovember€6,€1994.€€This€indictment€bears€the€docket€number€S37,280.€€OnÏFebruary€6,€1995,€the€grand€jury€of€Sullivan€County€again€indicted€Defendant,Íthis€time€in€a€two„count€Indictment€charging€him€in€Count€1€with€a€Violation€of€theÏHabitual€Motor€Vehicle€Offender€Act€which€was€alleged€to€have€occurred€onÏNovember€25,€1994.€€Count€2€charged€the€Defendant€with€the€offense€ofÏleaving€the€scene€of€an€accident€with€property€damage,€alleging€that€it€alsoÏoccurred€on€November€25,€1994.€€ÌÌà
