OnMarch27,1995,thePetitionerfiledhispetitionforpostconvictionreliefintheCircuitCourtforDicksonCounty,Tennessee.HesoughtpostconvictionrelieffromcertainsentencesimposedasaresultofguiltypleasenteredonApril8,1981.ThepetitionallegedineffectiveassistanceofcounselinthatcounselallowedthePetitionertoenterintoapleaagreementwhichresultedinillegalsentences.Thepetitionallegesthatthesentencesareillegalbecausetheywereorderedtobeservedconcurrentlywithcertainothersentences,yetthelawrequiredthesentencestobeservedconsecutivelybecausethecrimeswerecommittedwhilethePetitionerwasanescapeefromprison. ThepetitionallegesthattheorderingofthesentencestobeservedconcurrentlyresultedinanillegalsentencebecauseofaviolationofTennesseeCodeAnnotatedsection395719(repealed1989)andRule32(c)(3)(B)oftheTennesseeRulesofCriminalProcedure. TheStateofTennesseefileditsresponsetothepetitionandallegedthatthepetitionshouldbedismissedbecauseitwasbarredbythethreeyearstatuteoflimitationsthenineffect. /   כThetrialcourtagreedwiththeStatespositionand,withoutconductinganevidentiaryhearing,dismissedthepetitionasbeingbarredbythestatuteoflimitations.ItisfromthisorderthatthePetitionerappeals. ItisclearthatthepetitionwasfiledoutsidethethreeyearperiodwithinwhichthePetitionerhadtobringapetitionforpostconvictionrelief.AlthoughthePetitionerarguesthatthestatuteoflimitationsshouldnotbeappliedtohimbecausehewasincarceratedoutofstateforaportionofhissentenceandhehadnoknowledgethathissentencewasillegaluntil1994,weareunabletoconcludethatthethreeyearstatuteoflimitationsshouldnotapplytothispetitionorthattheapplicationofthestatuteviolatesthepetitionersdueprocessrights.SeePhillipsv.State,890S.W.2d37(Tenn.Crim.App.),perm.toappealdenied,id.(Tenn.1994).We,therefore,cannotconcludethatthetrialcourterredbydismissingthepetitionforpostconvictionrelief. Wenotethatthepetitionappearstoallegefactswhich,iftrue,wouldrenderthesentencesillegalandvoid.SeeHendersonv.Stateexrel.Lance,220Tenn.520,419S.W.2d176(1967);seealsoTaylorv.Morgan,909S.W.2d17(Tenn.Crim.App.Ϝ1995).InArcherv.State,851S.W.2d157,163(Tenn.1993),theSupremeCourtnotedthatbecausethetrialcourtinLancewaswithoutauthoritytorenderaconcurrentsentencewhenstatutorilyrequiredtomakethesentenceconsecutive,thejudgmentwasfaciallyvoid,andawritofhabeascorpuscouldissuetoreleaseLancefromhisguiltyplea. Aswehaveobserved,thetrialcourthereindismissedthepetitionwithoutanevidentiaryhearing.TherecordonappealcontainsonlytheDefendantspetition,amemoranduminsupportthereof,theStatesresponse,andthetrialcourtsorder.ϜFromthisrecord,wecannotbecertainthatthesentencesareillegal.Iftheyare,acourthastheauthoritytocorrectanillegalsentenceatanytime,evenifithasotherwisebecomefinal.Statev.Burkhart,566S.W.2d871,873(Tenn.1978).WhatisϜlessclearistheprocedurewhichmust(orevenmay)befollowedtobringtheillegalsentencetotheattentionofthecourt,especiallywhenapetitionforpostconvictionreliefisbarredbythestatuteoflimitations.SeeTaylorv.Morgan,909S.W.2d17(Tenn.Crim.App.1995);Archerv.State,851S.W.2d157(Tenn.1993);JosephHarveyCutrightv.State,No.02C019108CC00175,HendersonCounty(Tenn.Crim.App.,Jackson,filedMar.25,1992),applic.denied,Statev.Cutright,Order,No.02C019108CC00175(Tenn.,Jackson,filedAug.31,1992). Althoughitisclearthatthepetitionforpostconvictionreliefwasbarredbythestatuteoflimitations,thepetitionerwouldgenerallybeabletoobtainrelieffromanillegalsentencebyfilingapetitionforwritofhabeascorpus.Atrialcourtisnotboundbythetitleofapleading,buthasthediscretiontotreatthepleadingaccordingtothereliefsought.Nortonv.Everhart,895S.W.2d317,319(Tenn.1995).However,apetitionforhabeascorpusreliefshouldbefiledwiththecourtorjudgemostconvenientinpointofdistancetothepetitioner,unlessasufficientreasonbegiveninthepetitionfornotapplyingtosaidcourtorjudge.Tenn.CodeAnn.2921105.Thus,ifthetrialcourtinDicksonCountytreatedthepetitioninthecasesubjudiceasapetitionforwritofhabeascorpus,itappearsthepetitioncouldbeproperlydismissedbecausethepetitionallegesthatthepetitionerisincarceratedinanothercountyandgivesnoreasonfornotfilingthepetitioninthecountyofthepetitionersincarceration. Furthermore,itisalsounclearastowhetherthePetitionerwouldbeentitledtohabeascorpusrelief.ThesolereliefavailableunderTennesseeshabeascorpusstatuteisdischargefromcustody.Taylorv.Morgan,909S.W.2dat20.BecausetheDefendanthereinmaybelegallyrestrainedonothervalidsentences,hemaynotbeentitledtohabeascorpusrelief.Tenn.CodeAnn.2921122;see󛀜ChesterRayHallv.State,No.01C019405CC00163,WayneCounty(Tenn.Crim.App.,Nashville,filedJuly26,1995).Wealsonotethatabsentstatutoryauthority,thecircuitcourtforDicksonCountycouldnottransferthiscasetothecourtinthecountywherethePetitionerisincarcerated.Norton,895S.W.2dat320. Theissuebeforeusiswhetherthetrialjudgeerredindismissingapetitionforpostconvictionreliefwhichwasclearlybarredbythestatuteoflimitations.Wecannotconcludethathedid.
