ThedefendantacknowledgesthatthiscourthaspreviouslyheldthateligibilityforthespecialneedsprovisionoftheCommunityCorrectionsAct,T.C.A.4036106(c),islimitedtopersonswhoseoffensesandsentencesmakethemeligibleforprobation.See,e.g.,Statev.Staten,787S.W.2d934(Tenn.Crim.App.1989);Statev.LannyCrowe,No.01C019503CC00064,WayneCo.(Tenn.Crim.App.July6,1995);Statev.RobertWilson,No.03C019209CR00305,BlountCo.(Tenn.Crim.App.Mar.22,1993).However,thedefendantcontendsthatthiscourthasmisinterpretedthestatute,notingthatatleastonepanelofthiscourthasindicateddissatisfactionwithpreviousprecedent.InStatev.TimothyBlackburn,No.02C019111CC00253,HendersonCo.(Tenn.Crim.App.June30,1993),app.denied,(Tenn.Oct.11,1993),thiscourtagainheldthatcommunitycorrectionseligibilityunderT.C.A.4036106(c)waslimitedtothosewithprobationeligibility,butitstatedthat theresultmaynotbestservethedefendant,theendsofjustice,orthepublic.... Webelieve,though,thattherealsignificanceofBlackburnisthatthiscourtadheredtopriorprecedentandtheTennesseeSupremeCourtdeniedreview.Inthisrespect,wenotethatthecircumstancesinthepresentcasearequitesimilartothoseinStaten.InStaten,thedefendantwassentencedtothestatutoryminimumoftwentyyearsforbankrobberyuponhisguiltyplea.Thedefendantwasheldtobeineligibleforcommunitycorrectionsunderthespecialneedsprovisionbecausetheminimumsentenceforbankrobberywastoohightoallowprobation.Inthepresentcase,thedefendantspunishmentforaClassAfelonycommittedbyaRangeI,standardoffenderwasfifteentotwentyfiveyears,wellabovetheeightyearmaximumsentencethatwillallowforprobationeligibility.
