Theappellantcontendsthatthetrialcourt'sreasonabledoubtjuryinstructionviolatedhisconstitutionalrights.Thejuryinstructionatissuereadsasfollows:8 Reasonabledoubtisthatdoubtengenderedbyaninvestigationofalltheproofinthecaseandaninability,aftersuchinvestigation,toletthemindresteasilyastothecertaintyofguilt.Reasonabledoubtdoesnotmeanacaptious,possibleorimaginarydoubt.Absolutecertaintyofguiltisnotdemandedbythelawtoconvictofanycriminalcharge,butmoralcertaintyisrequired,andthiscertaintyisrequiredastoeverypropositionofproofrequisitetoconstitutetheoffense.Theappellantallegesthatthisinstructionunconstitutionallylowersthestate'sburdenofprovingeveryelementoftheoffensebeyondareasonabledoubt.Specifically,heaversthatthelanguage"letthemindresteasily"and"moralcertainty"takentogethersuggesttoareasonablejuroralowerburdenofproofthanwhatisconstitutionallyrequired.Insupportofhisargument,theappellantcitesRickmanv.Dutton,864F.Supp.686(M.D.Tenn.1994).InRickman,theU.S.DistrictCourtfortheMiddleDistrictofTennesseefoundasimilarreasonabledoubtinstructionunconstitutional.
