ŠŠ ˆ9(00 Šą ` ąAll€charges€in€this€case€stem€from€a€single€incident€which€occurred€onŠ `  ŠNovember€9,€1996.€€On€that€date,€James€Sharp€and€his€wife,€Shirley€Sharp,€theŠ P š Švictims,€were€returning€home€from€a€celebration€in€honor€of€Ms.€Sharpššs€birthday.€Š @ ą ŠMr.€Sharp€was€driving€their€vehicle,€a€1991€Oldsmobile,€and€had€stopped€at€aŠ 0Š Štraffic€light€near€Jackson,€Tennessee€at€approximately€midnight.€€Mr.€SharpŠ  Ą Štestified€that€while€waiting€for€the€light€to€change,€he€noticed€another€vehicleŠ °  Šapproaching€them€at€the€intersection€from€the€opposite€direction.€€Mr.€Sharp€Š    Šturned€to€his€wife,€who€was€riding€in€the€passenger€seat€of€their€car,€and€when€heŠ š  Šglanced€back,€š šall€[he]€could€see€was€just€blinding€lights€coming€into€.€.€.€theŠ ą€ Šwindshieldšš€of€his€vehicle.€€Confused€by€the€lights€and€the€š štremendous€roar,šš€Mr.Š Šp ŠSharp€first€guessed€that€an€airplane€was€crashing€into€his€car.€€However,€heŠ Ą` Šrealized€shortly€thereafter€that€the€oncoming€vehicle€which€he€had€noticed€justŠ °P Šmoments€before€had€jumped€the€median€and€was€heading€toward€him€š šfullŠ   @ Šthrottle.šš€€Mr.€Sharp€testified€that€the€driver€of€the€vehicle€š šnever€let€up€on€theŠ "0 Šacceleratoršš€and€hit€his€car€head„on.Š €$  ŠĢą ` ąAfter€the€collision,€Mr.€Sharp€realized€that€the€steering€column€of€his€carŠ `(  Šhad€been€knocked€loose€and€that€he€was€holding€the€disconnected€steeringŠ P*š " Šwheel.€€His€first€thoughts€were€for€his€wife,€who€had€been€pinned€on€theŠ @,ą"$ Šfloorboard€between€the€dashboard€and€the€seat€of€the€car.€€Her€head€had€hit€theŠ 0.Š$& Šwindshield.€€In€addition€to€other€injuries,€she€was€bleeding€profusely€fromŠ  0Ą&( Šlacerations€to€her€head€and€face,€her€legs€were€broken,€and€she€was€strugglingŠ 2°(* Šfor€breath.€€Although€Mr.€Sharp€survived€his€injuries,€Ms.€Sharp€died€at€theŠ 4 *, Šhospital.Š š5,. ŠĢŠ  Š9p02 Šą ` ąAfter€the€crash,€a€woman€who€had€witnessed€the€collision,€Virginia€Hurd,Š `  Šapproached€Mr.€Sharp€to€try€to€help.€€Ambulances€and€law€enforcementŠ P š Špersonnel€arrived€shortly€thereafter.€€Officer€Mabry€of€the€Jackson€PoliceŠ @ ą ŠDepartment€was€among€those€called€to€the€scene€of€the€accident.€€He€stated€thatŠ 0Š Šwhen€he€arrived,€he€saw€the€Sharpsšš€car€on€the€street€and€a€red€pick„up€truck€inŠ  Ą Ša€grassy€area€next€to€the€road.€€The€pick„up€was€on€its€side,€and€Officer€MabryŠ °  Šobserved€a€white€male€inside,€later€identified€as€the€Defendant,€who€appeared€toŠ    Šbe€unconscious.€€Mabry€stated€that€he€could€see€the€Defendant€breathing€andŠ š  Šnoted€that€the€Defendant€was€bleeding€from€his€forehead.€€Mabry€also€testifiedŠ ą€ Šthat€he€noticed€numerous€broken€beer€bottles€inside€the€truck.€€OfficerŠ Šp ŠBlankenship,€also€of€the€Jackson€Police€Department,€who€arrived€at€the€sceneŠ Ą` Šwith€Officer€Mabry,€introduced€photographs€taken€of€the€vehicles€after€theŠ °P Šaccident.€€He€stated€that€there€were€no€skidmarks€from€the€Defendantššs€truck€andŠ   @ Šš šno€sign€of€any€attempt€to€brake€at€all.ššŠ "0 ŠĢą ` ąMr.€Sharp€and€the€Defendant€were€both€transported€to€the€hospital€in€theŠ p& Šsame€ambulance.€€Sharp€testified€that€the€Defendant€was€placed€in€theŠ `(  Šambulance€first,€and€when€the€emergency€medical€technicians€opened€the€doorŠ P*š " Šfor€him€to€enter,€he€š šcould€hardly€breathe€for€the€smell€of€alcohol.šš€€OfficerŠ @,ą"$ ŠBlankenship€reported€that€he€spoke€with€the€Defendant€at€the€hospital€and€notedŠ 0.Š$& Ša€š šstrong€odor€of€an€alcoholic€beverage€coming€from€his€personšš€and€that€theŠ  0Ą&( ŠDefendantššs€speech€was€slurred.€€Blood€alcohol€content€tests€revealed€that€theŠ 2°(* ŠDefendant€had€a€blood€alcohol€content€of€0.14%€when€his€blood€was€drawn€atŠ 4 *, Šthe€hospital€after€the€accident.€€In€addition,€Officer€Blankenship€reported€that€heŠ š5,. Šobtained€a€package€of€š šrolling€papersšš€and€two€clear€bags€of€a€leafy,€greenŠ ą7€.0 Šsubstance€from€the€Defendantššs€pocket€at€the€hospital.€€Analysis€of€the€substanceŠ Š9p02 Šconfirmed€that€it€was€marijuana.€€At€the€hospital,€lacerations€to€the€DefendantššsŠ `  Šface€and€head€were€sutured,€and€according€to€the€physician€who€treated€theŠ P š ŠDefendant€on€the€night€of€the€accident,€the€relatively€minor€lacerations€were€theŠ @ ą ŠDefendantššs€only€injuries.€€Š 0Š Š€Ģą ` ąOfficer€Mark€Peddy€of€the€Jackson€Police€Department€testified€that€he€wasŠ °  Šin€the€Defendantššs€presence€for€several€hours€on€the€night€of€the€accident.€€HeŠ    Šrecalled€that€while€at€the€hospital,€the€Defendant€told€him€that€he€and€two€friendsŠ š  Šhad€been€to€Tremors,€a€nightclub€in€Jackson.€€Peddy€testified€that€the€DefendantŠ ą€ Šš šdid€not€know€where€[his€friends]€were€at€that€time.€€He€did€not€know€how€he€hadŠ Šp Šgotten€to€be€where€he€was.€.€.€.€€[H]e€.€.€.€did€not€even€remember€leavingŠ Ą` ŠTremors.ššŠ °P ŠĢą ` ąAt€trial,€the€Defendant€presented€a€different€story.€€He€claimed€that€he€andŠ "0 Šhis€two€friends,€Tim€Jones€and€Chris€Herbison,€left€Tremors€together€in€his€truck.€Š €$  ŠHe€admitted€that€he€had€smoked€marijuana€that€evening€and€that€they€had€allŠ p& Šbeen€drinking€heavily,€but€insisted€that€they€were€not€š štotallyšš€intoxicated€whenŠ `(  Šthey€left€the€club.€€He€also€claimed€that€Herbison€had€stopped€drinking€atŠ P*š " ŠTremors€so€that€he€could€be€the€š šdesignated€driver.šš€€The€Defendant€reportedŠ @,ą"$ Šthat€at€the€time€of€the€accident,€the€three€of€them€were€headed€to€the€Doll€House,Š 0.Š$& Šanother€club,€and€that€Herbison€was€driving.€€He€maintained€that€he€was€ridingŠ  0Ą&( Šin€the€passenger€seat€of€his€truck.€€He€claimed€that€when€they€approached€theŠ 2°(* Šintersection€where€the€accident€occurred,€Herbison€was€driving€too€fast,€and€heŠ 4 *, Šwarned€Herbison€to€š š[s]low€down.šš€€The€Defendant€testified€that€upon€impact,€heŠ š5,. Šwas€knocked€unconscious.€€He€reported€that€after€the€accident,€Jones€andŠ ą7€.0 ŠHerbison€ran€from€the€vehicle,€leaving€him€to€face€charges€for€the€crime.€Š Š9p02 ŠAlthough€he€admitted€that€he€had€been€found€unconscious€in€the€driverššs€seat€ofŠ `  Šthe€truck,€he€explained€that€Jones€and€Herbison€had€caused€him€to€slide€into€thatŠ P š Šposition€as€they€exited€the€truck,€which€was€lying€on€its€side.Š @ ą ŠĢą ` ąBoth€Tim€Jones€and€Chris€Herbison€testified€at€trial.€€Both€testified€that€theyŠ  Ą Šand€the€Defendant€began€drinking€on€the€afternoon€of€the€accident€at€theŠ °  ŠDefendantššs€home€in€McKenzie,€Tennessee.€€They€left€McKenzie€in€theŠ    ŠDefendantššs€truck€to€go€to€Tremors€in€Jackson.€€On€the€way,€they€stopped€at€aŠ š  Šbar€owned€by€the€Defendantššs€mother€and€purchased€beer€to€drink.€€In€addition,Š ą€ Šthey€each€testified€that€both€Herbison€and€the€Defendant€smoked€marijuana€whileŠ Šp Šdriving€to€Jackson.Š Ą` ŠĢą ` ąAccording€to€Jones,€the€Defendant€was€already€intoxicated€when€theyŠ   @ Šarrived€at€Tremors.€€They€all€continued€to€drink€at€the€club,€and€Jones€maintainedŠ "0 Šthat€he€and€Herbison€decided€not€to€ride€home€with€the€Defendant€because€of€theŠ €$  ŠDefendantššs€intoxication€and€his€poor€driving€habits€on€the€way€to€Jackson.€Š p& ŠHerbison€testified€that€while€at€Tremors,€the€Defendant€š šgot€into€a€heatedŠ `(  Šargument,€and€[a€bouncer]€escorted€him€out€the€door.šš€€When€asked€about€thisŠ P*š " Šincident,€the€Defendant€denied€that€he€had€been€escorted€from€the€club.€Š @,ą"$ ŠHowever,€another€patron€of€Tremors,€Elizabeth€Anderson,€testified€that€she€hadŠ 0.Š$& Šalso€seen€the€Defendant€being€escorted€from€the€club€by€a€bouncer.€Š  0Ą&( ŠĢą ` ąHerbison€described€the€Defendant€as€š šhighly€intoxicatedšš€at€the€time€he€leftŠ 4 *, ŠTremors.€€Herbison€testified€that€he€walked€outside€with€the€Defendant,€told€theŠ š5,. Šbecause€the€Defendant€was€driving€at€a€high€speed€and€it€appeared€that€he€wasŠ ą7€.0 Šnot€going€to€stop,€he€paused€at€the€intersection.€€As€the€truck€passed€him,€heŠ Š9p02 Šnoted€that€there€was€only€one€male€inside€the€vehicle.€€The€truck€crossed€theŠ `  Šmedian,€struck€the€victimsšš€car,€and€š šflipped.šš€€Jenkins€stated€that€the€driver€neverŠ P š Šreduced€his€speed.€€After€the€collision,€Jenkins€approached€both€the€victimsšš€carŠ @ ą Šand€the€Defendantššs€truck€to€offer€help.€€Jenkins€insisted€that€he€found€only€theŠ 0Š ŠDefendant€inside€the€truck,€which€was€littered€with€beer€bottles€and€smelledŠ  Ą Šstrongly€of€alcohol.Š °  ŠĢą ` ąCharles€Hurd€and€his€wife,€Virginia€Hurd,€were€approaching€theŠ š  Šintersection€where€the€accident€occurred€when€they€witnessed€the€collisionŠ ą€ Šbetween€the€Defendantššs€truck€and€the€victimsšš€car.€€Both€testified€that€theŠ Šp ŠDefendant€was€speeding€and€that€he€did€not€attempt€to€brake€before€hitting€theŠ Ą` Švictimsšš€car.€€After€the€collision,€the€Hurds€immediately€approached€the€vehicles,Š °P Šshined€the€headlights€of€their€vehicle€on€those€involved€in€the€accident,€andŠ   @ Šattempted€to€help€the€victims€and€the€Defendant.€€Both€Mr.€and€Mrs.€HurdŠ "0 Štestified€that€only€the€Defendant,€who€was€briefly€knocked€unconscious,€was€inŠ €$  Šhis€truck€after€the€accident.€€Although€the€Hurds€stopped€at€the€site€of€theŠ p& Šaccident€immediately€after€the€collision€and€remained€there€until€medical€and€lawŠ `(  Šenforcement€personnel€arrived,€neither€Mr.€nor€Mrs.€Hurd€saw€any€individualsŠ P*š " Šemerge€from€the€Defendantššs€truck€and€flee€the€scene€of€the€accident.€€Š @,ą"$ Šą ` ą€€€€Š 0.Š$& Šą ` ąOfficer€Urig,€an€accident€reconstructionist€with€the€Jackson€PoliceŠ  0Ą&( ŠDepartment,€also€testified€at€trial.€€He€stated€that€the€Defendantššs€truck€and€theŠ 2°(* Švictimsšš€car€made€contact€passenger€side€to€passenger€side.€€Urig€testified€thatŠ 4 *, Šbased€upon€the€damage€he€observed€to€both€vehicles€at€the€scene,€theŠ š5,. Špassenger€seat€of€the€Defendantššs€truck€was€not€š ša€survivable€positionšš€in€theŠ ą7€.0 Šaccident.€€He€€maintained€that€the€minimum€rate€of€speed€at€which€the€truck€wasŠ Š9p02 Štraveling€at€the€time€of€the€accident€was€sixty€miles€per€hour€and€that€š šthere€wasŠ `  Šno€braking€of€any€kind€from€the€truck.šš€€€With€regard€to€evidence€at€the€scene,€heŠ P š Šexplained€that€although€officers€could€have€possibly€obtained€fingerprint€samplesŠ @ ą Šfrom€the€dashboard€of€the€Defendantššs€truck,€retrieved€blood€samples€from€theŠ 0Š Švehicles,€and€determined€who€owned€a€leather€jacket€found€inside€theŠ  Ą ŠDefendantššs€vehicle,€they€chose€not€to€do€so€because€š šin€[his]€opinion,€there€wasŠ °  Šonly€one€person€involved.šš€€€Š    ŠĢą ` ąThe€Defendantššs€mother,€Judy€Sawyer,€testified€for€the€defense.€€SheŠ ą€ Šintroduced€€an€audio€tape€on€which€she€recorded€a€conversation€she€had€hadŠ Šp Šwith€Tim€Jonesšš€wife,€Michelle€Jones.€€During€the€conversation,€Ms.€Jones€stated,Š Ą` Šš šI€just€told€him€I€thought€he€was€sitting€in€jail€for€something€his€best€friend€did.€Š °P ŠThen,€Timmy€turned€around€and€said,€ššLook€whoššs€sitting€in€jail€for€it.šššš€€Later€inŠ   @ Šthe€conversation,€Sawyer€asked€Ms.€Jones,€š šSo€you€really€think€he€was€drivingŠ "0 Šthen?šš€to€which€Ms.€Jones€responded,€š šI€think.€€John€said€that€he€noticed€that€hisŠ €$  Šhands€and€his€arms€and€his€face€being€pretty€scratched€up,€and€Jeanie€said€thatŠ p& Šshe€did€too.šš€€Sawyer€testified€that€she€could€not€identify€John€or€Jeanie,€but€Š `(  Šexplained€that€the€tape€showed€Ms.€Jonesšš€belief€that€her€husband€had€beenŠ P*š " Šdriving€the€Defendantššs€truck€at€the€time€of€the€accident.€€In€support€of€thisŠ @,ą"$ Šassertion,€Sawyer€pointed€to€Ms.€Jonesšš€comments€about€her€husbandššs€cuts€and€Š 0.Š$& Šhis€behavior€after€the€accident,€specifically,€that€he€was€š šlaughing€and€making€funŠ  0Ą&( Šbecause€he€wasnššt€in€jail.ššŠ 2°(* ŠĢą ` ąMichelle€Jones€also€testified€at€trial€and€was€questioned€about€herŠ š5,. Šconversation€with€Ms.€Sawyer.€€She€stated€that€at€the€time€of€the€accident,€sheŠ ą7€.0 Šand€her€husband€were€separated,€and€she€had€not€spoken€with€him€for€fiveŠ Š9p02 Šmonths.€€She€did€not€recall€telling€Ms.€Sawyer€that€her€husband€was€allowing€theŠ `  ŠDefendant€to€š šsit€.€.€.€in€jailšš€for€his€own€act,€but€she€admitted€that€she€hadŠ P š Šwondered€if€Mr.€Jones€had€been€involved.Š @ ą ŠĢą ` ąTim€Jones€testified€that€he€had€a€cut€on€his€cheek€on€the€night€of€theŠ  Ą Šaccident€which€he€had€received€at€work.€€Both€Herbison€and€Cindy€Boone,€theŠ °  ŠDefendantššs€wife,€reported€having€noticed€the€cut€that€night.€€Jones€explained€thatŠ    Šhe€and€Herbison€worked€for€West€Tennessee€Siding€and€Trim€putting€up€vinylŠ š  Šsiding€and€often€had€cuts€and€scratches€on€their€hands€and€faces.€€At€trial,Š ą€ ŠHerbison€showed€the€jury€cuts€on€his€hands€which€he€claimed€to€have€recentlyŠ Šp Šreceived€while€working.€Š Ą` Š€Ģą ` ąThe€defense€also€called€Stacy€Freeman,€who€was€present€at€theŠ   @ ŠDefendantššs€home€on€November€10,€1996.€€She€recalled€that€while€she€was€atŠ "0 Šthe€Defendantššs€home,€Diane€Maynord,€Tim€Jones,€and€Chris€Herbison€stoppedŠ €$  Šby€to€pick€up€Jonesšš€truck,€which€he€had€left€at€the€Defendantššs€house€the€nightŠ p& Šbefore.€€She€testified€that€when€they€arrived,€she€and€Jones€engaged€in€theŠ `(  Šfollowing€conversation:€š šI€said,€ššDo€you€know€that€[the€Defendant€is]€in€theŠ P*š " Šhospital?šš€€And€[Jones]€said,€ššFrom€what?šš€€I€said,€ššYššall€killed€a€woman€last€night.ššššŠ @,ą"$ ŠFreeman€claimed€that€Jones€responded€by€asking,€š šAnd€you€mean€that€womanššsŠ 0.Š$& Šdead?šš€€When€questioned€about€this€incident,€Jones€denied€having€ever€madeŠ  0Ą&( Šsuch€a€statement.Š 2°(* ŠĢÓ  ÓI.€€SUFFICIENCY€OF€THE€EVIDENCEŠ š5,. Šweigh€or€re„evaluate€the€evidencešš€in€the€record€below.€€ņņEvansóó,€838€S.W.2d€atŠ ą7€.0 Š191€(citing€ņņCabbageóó,€571€S.W.2d€at€836).€€Likewise,€should€the€reviewing€courtŠ Š9p02 Šfind€particular€conflicts€in€the€trial€testimony,€the€court€must€resolve€them€in€favorŠ `  Šof€the€jury€verdict€or€trial€court€judgment.€€ņņTuggleóó,€639€S.W.2d€at€914.Š P š ŠĢą ` ąContrary€to€the€Defendantššs€assertions,€the€State€presented€ampleŠ 0Š Ševidence€from€which€the€jury€could€have€adduced€the€Defendantššs€guilt.€Š  Ą ŠWitnesses€to€the€collision€testified€that€the€Defendant€was€the€only€individual€inŠ °  Šhis€truck€both€before€the€accident€and€immediately€afterwards.€€Police€officersŠ    Šfound€only€the€Defendant,€who€was€unconscious,€in€his€truck€upon€their€arrivalŠ š  Šat€the€scene.€€One€officer€testified€that€when€he€spoke€with€the€Defendant€at€theŠ ą€ Šhospital€after€the€crash,€the€Defendant€admitted€that€he€did€not€know€where€hisŠ Šp Šfriends€were€and€could€not€even€remember€leaving€the€nightclub€where€they€hadŠ Ą` Šbeen€earlier€in€the€evening.€€An€accident€reconstructionist€testified€that€theŠ °P Špassenger€seat€of€the€Defendantššs€truck,€where€he€claimed€to€be€riding€at€theŠ   @ Štime€of€the€accident,€was€not€a€survivable€position.€€Š "0 ŠĢą ` ąFurthermore,€patrons€of€Tremors€reported€seeing€the€Defendant€leave€theŠ p& Šestablishment€alone.€€Tim€Jones€and€Chris€Herbison€reported€that€they€were€notŠ `(  Šwith€the€Defendant€at€the€time€of€the€accident€and€instead€spent€the€night€at€aŠ P*š " Šmotel€in€Jackson.€€This€was€verified€by€both€the€manager€of€the€motel€and€theŠ @,ą"$ Šwoman€who€drove€them€home€the€following€morning.€€Š 0.Š$& ŠĢą ` ąIn€fact,€the€only€evidence€that€the€Defendant€presented€to€support€hisŠ 2°(* Šcontentions€consisted€of€a€recorded€conversation€between€his€mother€andŠ 4 *, ŠMichelle€Jones,€in€which€Jones€questioned€whether€her€husband€may€have€beenŠ š5,. Šdriving€at€the€time€of€the€accident,€and€the€testimony€of€Stacy€Freeman,€whoŠ ą7€.0 Šclaimed€that€after€she€reported€the€accident€to€Tim€Jones,€he€asked€her€whetherŠ Š9p02 Šš šthat€woman€[was]€dead,šš€a€statement€which€Jones€denied€ever€making.€€AnyŠ `  Šquestion€as€to€the€Defendantššs€guilt€raised€by€this€evidence€and€questions€ofŠ P š Šwitness€credibility€were€appropriately€presented€to€the€jury€for€resolution.€Š @ ą ŠQuestions€of€this€nature€are€questions€of€fact€and€are€traditionally€resolved€by€theŠ 0Š Šjury.€€The€jury€considered€both€the€Defendantššs€version€of€the€accident€and€thatŠ  Ą Špresented€by€the€State€and€apparently€concluded€that€the€Defendantššs€testimonyŠ °  Šwas€not€credible.€€Because€we€may€not€š šre„weigh€or€re„evaluate€the€evidenceššŠ    Šin€the€record,€we€will€not€disturb€this€finding€on€appeal.€€ņņSeeóó€ņņEvansóó,€838€S.W.2dŠ š  Šat€191€(citing€ņņCabbageóó,€571€S.W.2d€at€836).€€This€issue€is€therefore€without€merit.Š ą€ ŠĢÓ  ÓII.€€NEWLY€DISCOVERED€EVIDENCEŠ Ą` ŠÓwwÓą ` ąThe€Defendant€next€contends€that€the€trial€court€erred€by€denying€hisŠ °P Šmotion€for€a€new€trial€based€upon€newly€discovered€evidence.€€At€the€hearing€onŠ   @ Šthe€motion€for€a€new€trial,€two€new€witnesses€testified.€€Victor€Trailer,€who€wasŠ "0 Šincarcerated€with€the€Defendant,€testified€that€in€November€1996,€he€saw€theŠ €$  Šaftermath€of€an€accident€and€two€white€males€š šwalking€at€a€rapid€speedšš€awayŠ p& Šfrom€the€area€in€which€the€accident€had€occurred.€€He€could€recall€neither€theŠ `(  Šexact€date€nor€the€time€of€day€or€night€when€he€saw€the€accident.€€He€stated€thatŠ P*š " Šš šit€seemed€like€it€was€getting€dusky„darkšš€or€š šit€might€have€been€a€cloudy€day€orŠ @,ą"$ Šsomething,šš€although€he€could€not€be€sure.€€He€was€also€unable€to€identify€whatŠ 0.Š$& Štypes€of€vehicles€had€been€involved€in€the€collision.€€Trailer€explained€that€he€didŠ  0Ą&( Šnot€previously€report€his€knowledge€to€police€because€he€was€š šinto€criminalŠ 2°(* Šactivityšš€at€that€time.Š 4 *, ŠĢą ` ąHenry€Wilson,€who€was€also€incarcerated€at€the€same€facility€where€theŠ ą7€.0 ŠDefendant€was€housed,€testified€that€he€too€saw€the€aftermath€of€the€accident€atŠ Š9p02 Šissue€in€this€case.€€He€stated€that€he€saw€two€Caucasian€males€standing€š šat€theŠ `  Štruckšš€on€November€9,€1996,€but€he€could€not€be€sure€whether€they€were€in€theŠ P š Štruck.€€In€his€signed€affidavit,€he€stated,€š šit€was€about€11:30€p.m.€or€twelveŠ @ ą Šoššclock,€but€it€was€two€people€that€were€running€from€the€truck.šš€€However,€at€theŠ 0Š Šhearing€on€the€motion€for€a€new€trial,€he€denied€ever€seeing€the€two€peopleŠ  Ą Šš šrunning€from€the€truck.šš€€Wilson€claimed€that€the€individuals€did€not€appear€to€beŠ °  Špolice€officers,€but€he€stated€that€the€two€appeared€to€be€š šlooking€at€the€truck€andŠ    Šthe€car€like€they€were€checking€the€damage€or€something.šš€€He€claimed€that€heŠ š  Šdid€not€stop€because€he€assumed€no€one€was€hurt€since€two€individuals€wereŠ ą€ Šstanding€near€the€wreck.€€Wilson€could€not€describe€the€vehicles€involved€in€theŠ Šp Šaccident,€but€he€did€state€that€the€truck€which€he€saw€was€lying€on€its€side.Š Ą` ŠĢą ` ąš šThe€decision€to€grant€or€deny€a€new€trial€on€the€basis€of€newly€discoveredŠ   @ Ševidence€is€a€matter€which€rests€within€the€sound€discretion€of€the€trial€courtŌȐ’Ō.ŌȐ’H‚Ōšš€Š "0 ŠņņState€v.€Goswickóó,€656€S.W.2d€355,€358€(Tenn.€1983).€€Thus,€our€standard€ofŠ €$  Šreview€is€abuse€of€discretion.€€ņņState€v.€Meadeóó,€942€S.W.2d€561,€565€(Tenn.€Crim.Š p& ŠApp.€1996).€€š šIn€seeking€a€new€trial€on€the€basis€of€newly€discovered€evidence,Š `(  Šthe€defendant€must€first€establish€(1)€reasonable€diligence€in€attempting€toŠ P*š " Šdiscover€the€evidence;€(2)€the€materiality€of€the€evidence;€and€(3)€that€theŠ @,ą"$ Ševidence€would€likely€change€the€result€of€the€trial.šš€€ņņId.óó;€ņņGoswickóó,€656€S.W.2d€atŠ 0.Š$& Š358„60.Š  0Ą&( ŠĢą ` ąIn€denying€the€Defendantššs€motion€for€a€new€trial,€the€trial€judge€stated,Š 4 *, ŠÓÓą8 ` ąNow,€these€two€witnesses€š!š€Mr.€Trailer€and€Mr.€Wilson€š!š€first€of€all,Š š5,. Šą8 ` ąą ø ąLetššs€take€Mr.€Trailer€first.€€Mr.€Trailer€thinks€it€happenedŠ Š9p02 Šabout€dusk€š!š€at€the€end€of€the€day.€€He€is€far€off€on€the€time.€€ItŠ `  Šhappened€at€11:30€or€twelve€oššclock.€€Heššs€not€sure.€€He€canššt€giveŠ X ų Šother€testimony€about€the€description€of€the€vehicles€or€whatŠ P š Šhappened€or€anything€else.€€He€didnššt€stop.€€He€didnššt€come€forwardŠ H č Šwith€this€testimony€until€months€and€months€after€the€accident.Š@ ą` ü!` ü! Šą8 ` ąą ø ąNow,€Mr.€Wilson€got€the€time€exactly€right€š!š€just€practically,Š 8Ų Šbut€Mr.€Wilsonššs€testimony€would€be€very€damaging€to€the€defendant€Š 0Š Šbecause€he€said€he€saw€two€white€males€some€period€of€time€afterŠ (Č Šthe€accident,€and€he€doesnššt€even€know€when€the€accidentŠ  Ą Šoccurred,€but€it€had€already€happened.€€And€they€were€just€kind€ofŠ ø  Šhanging€around€š!š€as€if€they€were€involved€in€it€š!š€looking€around.€Š °  ŠThatššs€entirely€inconsistent€with€Mr.€Booneššs€theory€that€they€got€outŠ Ø  Šof€there€some€way€and€ran€away.€€Had€that€been€the€case,€you€canšštŠ    Šstack€up€Mr.€Wilsonššs€testimony€with€the€idea€that€these€two€men€gotŠ ų˜  Šout€of€that€truck€and€ran€away.€€So€even€if€the€testimony€were€toŠ š  Šhave€been€given€by€Trailer€and€Wilson,€no€way€would€that€haveŠ čˆ Šchanged€the€outcome€of€the€case.€€And€Mr.€Trailerššs€testimony€wasŠ ą€ Šsimply€that€he€saw€two€white€males€walking€in€the€area€š!š€and€š!šŠ Ųx Šwalking€fast.€€And€that€doesnššt€prove€anything.€€Like€Mr.€Trailer€saidŠ Šp Šhimself,€š šI€didnššt€have€much€to€tell€about€it,šš€and€he€didnššt.ŠČh` ü!` ü! Šą8 ` ąą ø ąSo€the€testimony€of€these€witnesses€beyond€a€reasonableŠ Ą` Šdoubt€would€not€have€effected€[sic]€the€outcome€of€the€trial.€€€€€€€€€€€ŠøX` ü!` ü!
