Onthe18thdayofJanuary,1994,theappellantandAngelaJordanvisitedtheJ.C.PenneystoreintheNorthgateMall.ThestoreislocatedinChattanooga.TheappellantandJordanwenttothebathandbeddingdepartment.TheappellantpurchasedtwopillowswhileJordanremovedtwoquiltsandapackageofdrapestoaremoteareaofthedepartment.TheappellantjoinedJordanafterpayingforthepillows.Jordanremovedasackfromherjacket,openedit,andplacedthedrapesandquiltsinthebag.Asecurityofficer,whowitnessedtheentiretransaction,testifiedthattheappellant"handledthemerchandise"beforeitwasplacedinthesack.Theappellantdidnotplaceanyoftheitemsinthesack. WhenJordanandtheappellantleftthedepartment,thesecurityofficerfollowedthem.Thewomendiscoveredtheywerebeingfollowed,andtheyenteredanotherdepartmentratherthanexitthestore.Thesecurityofficerapproachedthewomen.Hetookthewomentotheofficeandcalledthepolice.Thesecurityofficersubsequentlyexecutedthedocumentsnecessaryforissuanceofawarrantfortheappellantsarrest.  I.   Ӏ Whenanaccusedchallengesthesufficiencyoftheconvictingevidence,thisCourtmustreviewtherecordtodetermineiftheevidenceadducedattrialissufficient"tosupportthefindingbythetrieroffactofguiltbeyondareasonabledoubt." &   ׀Thisruleisapplicabletofindingsofguiltbasedupondirectevidence,circumstantialevidence,oracombinationofdirectandcircumstantialevidence. '   ׀ Indeterminingthesufficiencyoftheconvictingevidence,thisCourtdoesnotreweighorreevaluatetheevidence. (   ׀NormaythisCourtsubstituteitsinferencesforthosedrawnbythetrieroffactfromcircumstantialevidence. )   ׀Tothecontrary,thisCourtisrequiredtoaffordtheStateofTennesseethestrongestlegitimateviewoftheevidencecontainedintherecordaswellasallreasonableandlegitimateinferenceswhichmaybedrawnfromtheevidence. *    Questionsconcerningthecredibilityofthewitnesses,theweightandvaluetobegiventheevidence,aswellasallfactualissuesraisedbytheevidenceareresolvedbythetrieroffact,notthisCourt. +   ׀InStatev.Grace, ,   ׀ourSupremeCourtsaid:"Aguiltyverdictbythejury,approvedbythetrialjudge,accreditsthetestimonyofthewitnessesfortheStateandresolvesallconflictsinfavorofthetheoryoftheState." Sinceaverdictofguiltremovesthepresumptionofinnocenceandreplacesitwithapresumptionofguilt,theaccused,astheappellant,hastheburdeninthisCourtofillustratingwhytheevidenceisinsufficienttosupporttheverdictsreturnedbythetrieroffact. -   ׀ThisCourtwillnotdisturbaverdictofguiltduetothesufficiencyoftheevidenceunlessthefactscontainedintherecordareinsufficient,asamatteroflaw,forarationaltrieroffacttofindthattheaccusedisguiltybeyondareasonabledoubt. .    Theevidenceadducedatthetrialwassufficienttosupportafindingbyarationaltrieroffactthattheappellantcommittedtheoffenseoftheftunder$500,beyondareasonabledoubt. 2   ׀TheevidenceestablishestheappellantaidedandabettedJordaninthetheftofthetwoquiltsanddrapes. 3   ׀AreasonabletrieroffactcouldconcludetheappellantquestionedtheclerkandpurchasedthepillowstodistracttheclerkwhileJordanobtainedthequiltsanddrapesandremovedthemerchandisetoaremoteareaofthedepartment.Oncetheappellantpurchasedthepillows,shewentdirectlytoJordan,watchedJordanplacethequiltsanddrapesinthesack,andleftwithJordan.Duringthisperiod,theappellanthadoneormoreoftheseitemsinherpossessionbeforeJordanplacedtheminthesack. Thisissueiswithoutmerit.  II.    Numerousprospectivejurorswereperemptorilychallengedbytheparties.Therewerenoobjectionsregisteredwhenthesejurorswerechallengedandexcusedbythetrialcourt.Thechallengedprospectivejurorswereexcusedfortheday. TherewerethreeAfricanAmericansonthejurypanel,twomalesandonefemale.TheStateofTennesseechallengedthefemaleAfricanAmericanperemptorily.ThetwomaleAfricanAmericansservedonthejurythatconvictedtheappellant.  Theassistantdistrictattorneygeneralreadtheindictmentandtheappellantenteredapleaofnotguilty.Thejurywassworn.Thereafter,thepartiesmadeopeningstatements.Thetrialcourtcalledcounseltothebench.Thepurposeofthesidebarconferencewastodetermineiftheassistantdistrictattorneygeneralwaspreparedtopresentthestate'sevidenceorneededashortrecess.Theassistantdistrictattorneyadvisedthecourthedidnotneedarecessandwaspreparedtoproceed.Duringthesidebarconference,defensecounselstatedhewantedtoknowwhytheassistantdistrictattorneygeneralperemptorilychallengedtheonlyfemaleAfricanAmericanwomanonthepanel.Theassistantdistrictattorneygeneral,notingthatheexcusedtwoCaucasianprospectivejurorsandthefemaleAfricanAmerican,gavearaceneutralreasonforthechallenge.However,headvisedthetrialcourtthatitwastoolatefordefensecounseltoraisetheBatsonissue.Thetrialcourtdeniedthechallenge. Theappellant,relyingonBatsonv.Kentucky, 4   ׀contendsthereasonsgivenbytheStateofTennesseeforstriking"theonlyblackfemalejuror"onthepanelwereinsufficient.Shedoesnotstatewhatreliefsheseeksfortheviolation.Intheconclusionportionofthebrief,theappellantstatesshewants"herconvictions...setaside,andthechargesdismissed;orinthealternative,thatthecaseberemandedforaNewTrialfreeof...prejudicialerror."TheStateofTennesseecontendstheappellantwaivedthisissuewhenshefailedtointerposetheobjectionwhenthejurorwasexcusedorbeforethejurywassworn.Inthealternative,thestatearguesthereasongivenbytheassistantdistrictattorneygeneralwasraceneutralandcompliedwithBatson. WhentheaccuseddesirestochallengetheStateofTennessee'suseofaperemptorychallengetoexcludeajurorbasedonraceorgender,theaccusedmustbringtheobjectionpriortoovertlyortacitlyacceptingthejury,andpriortotheadministrationofthejurysoath. 5   ׀Iftheaccused,asinthiscase,waitsuntilthejuryhasbeenswornbeforeraisingaBatsonobjection,theaccusedisdeemedtohavewaivedtheissue. 6   כAsthisCourtsaidinStatev.JamesTaylor: 7   ׀"[T]heproponentofaBatsonclaimmustpresentthisCourtwithaproperlypresented,legallycognizableclaim....Thedefendanthasnotcitedusto,norcanwefindintherecord,anycontemporaneousobjectiontothemakeupofthejuryatthetimeofjuryselection.Hence,thedefendant'sclaim...comestoolate." 8   ׀ InBatsonv.Kentucky,theUnitedStatesSupremeCourtdeclinedto"formulateparticularprocedurestobefolloweduponadefendant'stimelyobjectiontoaprosecutor'schallenge." 9   ׀Later,theUnitedStatesSupremeCourtstatedthat"astatecourtmayadoptageneralrulethataBatsonclaimisuntimelyifitisraisedforthefirsttimeonappeal,orafterthejuryissworn,orbeforeitsmembersareselected." :   ׀InFordv.Georgia, ;   ׀theCourtsaidastaterulewhichrequiresaBatsonclaimtobe"raisednotonlybeforetrial,butintheperiodbetweentheselectionofthejurorsandtheadministrationoftheiroath,isasensiblerule." <    Thisjurisdiction'srulerequiringaBatsonclaimtoberaisedbeforethejuryisacceptedandswornwasformulatedin1986,thesameyeartheUnitedStatesSupremeCourtdecidedBatson.ThiscasewastriedonJuly6,1995,approximatelynineyearsaftertheformulationofthewaiverrule.Thus,theappellantknew,orshouldhaveknown,thateitherovertlyortacitlyacceptingthejuryandpermittingthetrialcourttoswearthejurorsbeforeraisingtheBatsonclaimwouldresultinthewaiveroftheissue.
