Theappellantfiledapetitionforpostconvictionreliefallegingthathereceivedineffectiveassistanceofcounselwhichresultedinaninvoluntaryandunknowingplea.Inhispetitionheclaimedhistrialcounselwasineffectiveforfailingtoallowhimtoparticipateinhisdefenseandforfailingtoadequatelyexplaintheconsequencesofhisguiltyplea.Afterahearing,thetrialcourtdismissedthepetitionfindingtheappellant'strialcounseleffectiveandtheappellant'spleaknowingandvoluntary.Heappealsthedismissalofhispetition.Uponreview,weaffirm.     Inorderfortheappellanttobegrantedreliefbecauseofineffectiveassistanceofcounsel,hemustestablishthattheadvicegivenortheservicesrenderedwerenotwithinthecompetencedemandedofattorneysincriminalcasesandthat,butforhiscounselsdeficientperformance,theresultofhistrialwouldhavebeendifferent.Stricklandv.Washington,466U.S.668(1984).Thistwopartstandard,asitappliestoguiltypleas,ismetwhentheappellantestablishesthat,butforhiscounselserror,hewouldnothavepledguiltyandwouldhaveinsistedonatrial.Hillv.Lockhart,474U.S.52,59(1985).   Theappellanttestifiedatthepostconvictionhearingthathewasnotallowedtoparticipateinhisdefenseandwasnotproperlyadvisedofthetermsofhisguiltyplea.Furthermore,heclaimedhecouldnotreadanddidnotunderstandwhathewassigning. 3   ׀Theappellant'strialcounseltestifiedthathemetwiththeappellantonseveraloccasionsandallowedhimtomakethedecisiononwhethertopleadguiltyorgototrial.Furthermore,hestatedthathewasneverinformedabouttheappellant'sinabilitytoread.Hestatedthatregardlessoftheappellant'sreadingability,heorallyexplainedthepleaagreementtotheappellantandfeltconfidentheunderstooditsconsequencesandvoluntarilychosenottoproceedtotrial. Thehearingjudgefoundthattheappellant'strialcounselfullyinformedandadvisedhimduringpleanegotiations.Moreover,thehearingjudgefeltthattheappellantwasnotcredible.Hestatedthathedidnotfindtheappellant'sallegationstobe"trueatall."
