àThe€petitioner,€William€Lee€Bramlett,€appeals€as€of€right€from€theÏHumphreys€County€Criminal€Courtððs€dismissal€of€his€petition€for€post„conviction€relief.€€ÏThe€petitioner€pled€guilty€to€four€counts€of€grand€larceny,€two€counts€of€obtainingÏmoney€under€false€pretenses,€statutory€rape,€contributing€to€the€delinquency€of€aÏminor,€vandalism,€forgery,€passing€a€forged€instrument,€and€three€counts€of€passingÏworthless€checks.€€In€exchange€for€his€pleas,€he€received€an€effective€sentence€of€tenÏyears€for€the€various€convictions,€to€be€served€under€the€Community€Corrections€Act€ofÏ1985,€and€the€state€agreed€œto€the›€œdismissal€of›€several€other€charges.€€His€communityÍcorrections€sentence€was€eventually€revoked,€and€the€trial€court€ordered€that€he€serveÏhis€ten„year€sentence€in€the€Department€of€Correction.€€On€July€19,€1991,€the€petitionerÏfiled€a€òòproóó€òòseóó€petition€for€post„conviction€relief.€€Although€somewhat€rambling,€theÏpetition€alleged€that€the€petitioner€received€ineffective€assistance€of€counsel€andÏentered€an€involuntary€plea.€€The€trial€court€summarily€dismissed€the€petition.€€ThisÏcourt€reversed€the€summary€dismissal€and€remanded€the€case€for€the€appointment€ofÏcounsel.€€òòWilliam€Lee€Bramlett€v.€Stateóó,€No.€01C01„9202„CC„00049,€HumphreysÏCounty€(Tenn.€Crim.€App.€May€19,€1994).€€After€the€appointment€of€counsel€and€anÏevidentiary€hearing,€the€trial€court€denied€the€petition€because€it€concluded€that€theÏpetitioner€understood€the€terms€of€his€original€plea€and€that€his€original€counsel€wasÏeffective€in€his€pretrial€preparation.€€The€petitioner€contests€these€findings€and€claimsÏthat€the€trial€court€improperly€refused€to€grant€his€request€for€a€copy€of€the€transcriptÏfrom€his€guilty€plea€submission€hearing.€ÌÌà àThe€petitioner€was€the€only€person€to€testify€at€the€post„convictionÏhearing.€€He€complained€that€his€trial€attorney€failed€to€explain€the€specifics€of€hisÏœcommunity›€œcorrections›€sentence.€€He€said€that€his€attorney€never€told€him€that€he€couldÏbe€resentenced€if€he€violated€the€terms€of€his€sentence.€€Although€he€recalled€meetingÏwith€his€attorney€and€a€corrections€officer€at€his€attorneyððs€office,€he€said€that€theÏcorrections€officer€only€told€him€that€he€would€be€required€to€serve€ninety€days€onÏhouse€arrest€and€would€be€required€to€enroll€in€a€GED€program.€€He€said€that€hisÍattorney€told€him€that€once€he€served€ninety€days€on€house€arrest,€paid€restitution,€andÏperformed€two€hundred€hours€of€public€service,€the€rest€of€his€sentence€would€beÏserved€on€probation.€€The€petitioner€also€complained€that€his€attorney€failed€to€Ïinvestigate€the€facts€of€his€case€adequately.ÌÌà àDuring€cross„examination,€the€petitioner€recalled€that€when€he€enteredÏhis€plea€he€knew€what€the€charges€were€against€him€and€knew€the€charges€to€whichÏhe€was€pleading€guilty.€€He€said€that€he€understood€that€he€had€œthe›€right€to€a€jury€trial,Ïthe€right€to€choose€whether€to€testify€and€the€right€to€cross„examine€witnesses.€€HeÏalso€said€that€he€understood€that€there€would€not€be€a€trial€if€he€pled€guilty.€€TheÏpetitioner€testified€that€he€understood€that€in€exchange€for€his€plea€he€would€receiveÏtwo€five„year€sentences€ð ðrun€togetherðð€with€all€of€his€other€sentences€to€be€servedÏconcurrently.€€He€again€criticized€his€attorney€for€telling€him€that€he€would€only€have€toÏserve€ninety€days€on€house€arrest€and€that€the€rest€of€his€sentence€would€be€onÏprobation.€€He€said€that€the€trial€judge€never€informed€him€that€he€may€end€up€servingÏthe€entire€ten„year€sentence.€€ÌÌà àThe€petitioner€recalled€being€told€that€he€would€serve€ten€years€at€thirtyÏpercent€when€he€violated€house€arrest.€€He€said€that€he€thought€he€would€have€toÏserve€thirty€percent€of€his€sentence€but€complained€that€he€had€already€served€fourÏyears€and€would€not€be€eligible€for€parole€again€for€another€two€years.ÌÌà àUnder€questioning€from€the€court,€the€petitioner€testified€that€he€enteredÏthe€plea€in€order€to€take€care€of€his€family€and€avoid€going€to€prison.€€He€admitted€thatÏthe€trial€court€explained€to€him€that€he€was€receiving€a€community€correctionsÏsentence€and€not€a€probationary€sentence.€€However,€he€said€that€he€did€notÏremember€the€court€ever€explaining€the€difference€between€the€two.€€He€also€admittedÏthat€he€signed€the€last€page€of€the€presentence€report,€a€behavioral€contractÏagreement,€and€a€restitution€agreement.€€The€paragraphs€directly€above€theÏdefendantððs€signature€on€the€presentence€report€œand›€the€restitution€agreement€warnÏthat€a€violation€of€the€terms€of€the€agreements€can€result€in€incarceration€andÏtermination€from€the€community€corrections€program.€€ÌÌà àThe€trial€court€concluded€that€the€petitioner€had€been€fully€advised€and€Ïwell€represented€by€counsel€when€he€entered€his€plea.€€In€reaching€its€decision,€theÏcourt€noted€that€it€did€not€increase€the€petitionerððs€sentence€when€he€violated€the€termsÏof€his€community€corrections€sentence,€although€an€increase€would€have€beenÏjustified.ÌÌò òà@ àIÌó óà àThe€petitioner€contends€that€the€trial€court€erred€by€denying€him€post„conviction€relief€based€upon€his€claim€of€ineffective€assistance€of€counsel.€€He€arguesÍthat€in€the€absence€of€proof€from€the€state,€the€trial€court€should€have€granted€him€reliefÏon€the€ineffective€assistance€of€counsel€claim€based€on€the€allegations€in€the€òòproóó€òòseóóÏpetition€and€on€the€petitionerððs€testimony€concerning€his€attorneyððs€failure€toÏinvestigate€possible€defenses€and€failure€to€advise€him€of€his€rights.ÌÌà àThe€burden€was€on€the€petitioner€in€the€trial€court€to€prove€his€allegationsÏthat€would€entitle€him€to€relief€by€a€preponderance€of€the€evidence.œ× ƒ/ ××  ×›€€òòBrooks€v.€Stateóó,Ï756€S.W.2d€288,€289€(Tenn.€Crim.€App.€1988).€€On€appeal,€we€are€bound€by€the€trialÏcourtððs€findings€unless€we€conclude€that€the€evidence€preponderates€against€thoseÏfindings.€€òòBlack€v.€Stateóó,€794€S.W.2d€752,€755€(Tenn.€Crim.€App.€1990).€€In€this€respect,Ïthe€petitioner€has€the€burden€of€illustrating€how€the€evidence€preponderates€againstÏthe€judgment€entered.€€òòIdóó.€Ìà àÌà àIn€òòBaxter€v.€Roseóó,€523€S.W.2d€930,€936€(Tenn.€1975),€our€supreme€courtÏdecided€that€attorneys€should€be€held€to€the€general€standard€of€whether€the€servicesÏrendered€were€within€the€range€of€competence€demanded€of€attorneys€in€criminalÏcases.€€Further,€the€court€stated€that€the€range€of€competence€was€to€be€measured€byÏthe€duties€and€criteria€set€forth€in€òòBeasley€v.€United€Statesóó,€491€F.2d€687,€696€(6th€Cir.Ï1974)€and€òòUnited€States€v.€DeCosteróó,€487€F.2d€1197,€1202„04€(D.C.€Cir.€1973),€òòcert.óóÍòòdeniedóó,€444€U.S.€944€(1979).€€Also,€in€reviewing€counsel's€conduct,€a€"fair€assessmentÏof€attorney€performance€requires€that€every€effort€be€made€to€eliminate€the€distortingÏeffects€of€hindsight,€to€reconstruct€the€circumstances€of€counsel's€challenged€conduct,Ïand€to€evaluate€the€conduct€from€counsel's€perspective€at€the€time."€€òòStrickland€v.ÏWashingtonóó,€466€U.S.€at€689,€104€S.€Ct.€at€2065;€òòseeóó€òòHellard€v.€Stateóó,€629€S.W.2d€4,€9Ï(Tenn.€1982)€(counsel's€conduct€will€not€be€measured€by€"20„20€hindsight").€€Thus,€theÏfact€that€a€particular€strategy€or€tactic€failed€or€even€hurt€the€defense€does€not,€alone,Ïsupport€a€claim€of€ineffective€assistance.€€Deference€is€made€to€trial€strategy€or€tacticalÏchoices€if€œthey›€are€informed€ones€based€upon€adequate€preparation.€€œòòHellardóó,›€629ÏS.W.2d€at€œ9;›œ€òòDeCosteróó,›€487€F.2d€at€1201.€€ÌÌà àAlso,€we€note€that€the€approach€to€the€issue€of€the€ineffective€assistanceÏof€counsel€does€not€have€to€start€with€an€analysis€of€an€attorney's€conduct.€€If€prejudiceÏis€not€shown,€we€need€not€seek€to€determine€the€validity€of€the€allegations€aboutÏdeficient€performance.€€òòStrickland€v.€Washingtonóó,€466€U.S.€at€697,€104€S.€Ct.€at€2069.ÏIn€this€vein,€the€petitioner€had€the€burden€of€demonstrating€that,€but€for€his€counselððsÏerrors,€he€would€have€insisted€on€having€a€trial.€€òòSeeóó€òòHill€v.€Lockartóó,€474€U.S.€52,€59,Ï106€S.€Ct.€366,€370€(1985);€òòBankston€v.€Stateóó,€815€S.W.2d€213,€215€(Tenn.€Crim.€App.Ï1991).€€ÌÌà àThe€petitioner€argues€that€his€trial€counsel€was€deficient€for€failing€toÏadvise€him€of€his€rights€and€failing€to€investigate€his€cases.€€However,€he€has€failed€to€Ïdemonstrate€that€he€was€prejudiced€by€the€alleged€deficiencies.€€According€to€theÏpetitionerððs€testimony,€he€understood€that€he€was€waiving€his€right€to€a€trial,€right€toÏcross„examine€witnesses€against€him,€and€the€right€not€to€testify€when€he€entered€hisÏplea.€€The€petitioner€also€testified€that€the€trial€court€informed€him€he€was€receiving€aÏcommunity€corrections€sentence€and€that€he€pled€guilty€to€avoid€going€to€prison.€€TheÏpetitioner€does€not€claim€that€his€counselððs€errors€caused€him€to€plead€guilty.€€To€theÏcontrary,€the€petitionerððs€attorney€informed€the€court€during€the€post„conviction€hearingÏthat€if€the€petition€for€post„conviction€relief€was€granted,€the€petitioner€would€seek€toÏenter€into€another€plea€agreement.œ× ƒ0 ××  ×›€€Under€these€circumstances,€the€trial€court€did€notÏerr€in€denying€post„conviction€relief€on€the€ground€of€ineffectiveness€of€trial€counsel.ÌÌà@ àò òIIÌó óà àThe€petitioner€also€contends€that€the€trial€court€erred€by€denying€his€post„conviction€petition€because€the€record€does€not€demonstrate€that€he€was€adequatelyÏadvised€by€the€court€as€to€his€rights€or€his€understanding€of€the€terms€of€the€pleaÏbargain.€€He€argues€that€in€the€absence€of€proof€to€the€contrary,€this€court€must€assumeÍthat€the€trial€court€failed€to€advise€him.€€The€state€counters€that€the€petitioner€failed€toÏmeet€his€burden€of€proving€that€his€plea€was€involuntary€and€that€the€petitionerððs€ownÏtestimony€was€sufficient€to€establish€that€he€entered€a€knowing€and€voluntary€plea.€€WeÏagree.€ÌÌà àThe€issue€concerning€invalid€guilty€pleas€is€controlled€by€òòState€v.€Nealóó,Ï810€S.W.2d€131€(Tenn.€1991)€and€òòJohnson€v.€Stateóó,€834€S.W.2d€922€(Tenn.€1992),Ñ€1ÑÇwhich€bear€upon€the€procedural€and€substantive€requirements€for€the€entry€of€a€guiltyÏplea€in€order€that€a€valid€judgment€of€conviction€may€be€obtained€and€for€subsequentÏreview€of€the€validity€of€a€conviction€based€upon€a€guilty€plea.€€These€cases€stem,€inÏpart,€from€òòBoykin€v.€Alabamaóó,€395€U.S.€238,€243,€89€S.€Ct.€1709,€1712€(1969)€in€whichÏthe€Supreme€Court€stated€that€entry€of€a€guilty€plea€effectively€constituted€a€waiver€ofÏcertain€consti‚tutional€rights:€€the€right€against€compulsory€self„incrimina‚tion,€the€right€toÏconfront€one's€accusers,€and€the€right€to€trial€by€a€jury.€€òòBoykinóó€held€that€a€valid€waiverÏof€such€a€right€required€the€intentional€relin‚quishment€or€abandonment€of€a€knownÏright€and€that€such€a€waiver€may€not€be€presumed€from€a€silent€record.€€òòId.óó€€TheÏpetitionerððs€testimony€reflects€that€he€understood€at€the€time€he€entered€his€plea€thatÏhe€was€waiving€his€constitutional€rights€to€be€free€from€compulsory€self„incrimination,Ïto€a€trial€by€jury,€and€to€confront€and€cross„examine€witnesses.€€Therefore,€no€òòBoykinóóÏviolation€occurred.€€€ÌÌà àAlso,€there€is€nothing€in€the€record€before€us€to€indicate€that€the€petitionerÏwas€coerced€into€entering€his€plea.€€When€the€post„conviction€court€asked€theÏpetitioner€how€he€was€coerced€into€pleading€guilty,€the€petitioner€replied€that€he€pledÏguilty€because€he€wanted€to€take€care€of€his€family€and€avoid€going€to€prison.€€TheÏœpresentence›€report€and€the€restitution€agreement€the€petitioner€signed€explicitlyÏwarned€the€petitioner€that€he€could€be€incarcerated€if€he€failed€to€comply€with€the€termsÍof€his€sentences.€€The€record€supports€the€trial€courtððs€finding€that€the€petitionerÏknowingly€and€voluntarily€entered€his€pleas.€€€€€€Ìò òÌó óà@ àò òIIIó óÌà àFinally,€the€petitioner€contends€that€the€trial€court€erred€by€not€grantingÏhis€request€for€a€transcript€of€his€guilty€plea€submission.€€When€the€post„convictionÏcourt€inquired€as€to€why€the€petitioner€needed€a€transcript€of€the€guilty€pleaÏsubmission,€the€petitionerððs€attorney€responded€that€the€transcript€was€needed€to€showÏthat€the€petitioner€was€not€advised€that€he€could€be€resentenced€if€he€violated€hisÏcommunity€corrections€sentence.€€The€trial€court€refused€to€grant€the€transcriptÏbecause€it€concluded€that€the€petitioner€was€not€entitled€to€relief€even€if€the€court€failedÏto€give€him€such€advice.€€We€agree€with€the€trial€courtððs€conclusion€under€theÏcircumstances€in€this€case.ÌÌà àUnder€T.C.A.€ðð€40„30„113(1990)€[repealed€1995],€a€post„conviction€courtÏhas€the€authority€to€furnish€an€indigent€petitioner€with€ð àIn€the€context€of€this€case,€the€trial€courtððs€failure€to€advise€the€petitionerÏthat€he€could€be€resentenced€for€violating€the€terms€of€the€community€correctionsÏprogram€does€not€rise€to€the€level€of€constitutional€error€that€would€entitle€the€petitionerÏto€post„conviction€relief.€€As€previously€noted,€the€petitionerððs€testimony€establishedÏthat€he€understood€that€he€was€receiving€an€effective€ten„year€community€correctionsÏsentence.€€The€presentence€report€and€the€restitution€agreement€the€petitioner€signedÏexplicitly€warned€the€petitioner€that€he€could€be€incarcerated€if€he€failed€to€comply€withÏthe€terms€of€his€sentence.€€Although€the€petitioner€sought€a€copy€of€his€guilty€pleaÏsubmission€transcript€to€prove€that€he€was€not€advised€of€the€potential€for€resentencingÏunder€the€Community€Corrections€Act,€it€is€significant€that€his€resentencing€was€for€theÏsame€term€of€years.€€Moreover,€he€never€claimed€that€he€would€not€have€pled€guilty€ifÏhe€had€been€advised€of€the€potential€for€resentencing€upon€revocation.€€We€agree€withÏthe€trial€courtððs€assessment€that€the€petitioner€entered€a€knowing€and€voluntary€pleaÏeven€if€the€trial€court€failed€to€advise€him€that€he€could€be€resentenced€under€theÏCommunity€Corrections€Act.€€Thus,€the€trial€court€was€justified€in€denying€theÏpetitionerððs€request€for€a€transcript€of€the€plea€submission€hearing.ÌÌà
