àThis€is€an€appeal€as€of€right€pursuant€to€Rule€3€of€the€Tennessee€Rules€ofÏAppellate€Procedure.€€The€Defendant€appeals€from€an€order€of€the€trial€court€denying€himÏpost„conviction€relief.€€The€Defendant€presents€one€issue€for€review:€that€he€wasÏincompetent€to€enter€a€guilty€plea.€€€We€affirm€the€action€of€the€trial€court.ÌÌà àWe€will€first€briefly€review€the€facts€underlying€the€conviction.€€On€April€30,€1991,€aÏcall€was€made€to€911€in€Nashville,€Tennessee€about€a€disturbance€at€a€residence.€€TheÏpoliced€arrived€at€the€home€of€the€victim,€who€may€have€been€the€Defendantððs€girlfriend,Ïalthough€it€is€unclear€from€the€record.€€The€Defendant€was€breaking€up€with€his€girlfriendÏand€was€œapparently€intoxicated.›€€When€police€officers€arrived€at€the€scene,€a€womanÏdirected€them€to€a€man€in€her€dining€room€who€had€a€gun.€€The€Defendant€emerged€andÏaimed€a€pistol€at€the€officerððs€head.€€He€attempted€to€pull€the€trigger€of€the€gun,€but€theÏofficer€put€his€finger€in€the€hammer€of€the€gun€to€prevent€it€from€firing.€€The€Defendant€wasÏshot€twice€by€another€arresting€officer€and€received€treatment€for€his€injuries.ÌÌà àWe€also€review€the€procedural€history€of€this€case.€€The€Defendant€was€indictedÏfor€œthe€burglary›€and€kidnapping€of€the€victim€and€for€œthe€attempted›€murder€of€the€policeÏofficer.€€Pursuant€to€a€plea€agreement,€on€October€3,€1991,€€the€Defendant€attempted€toÍplead€guilty€to€aggravated€assault€in€exchange€for€a€œsix„year›€sentence€to€be€served€atÏone„hundred€percent.€€The€trial€court€determined€that€the€sentence€was€not€authorizedÏand€the€proceedings€were€postponed€to€renegotiate€the€sentence.€€In€the€interim,ÏDefendantððs€counsel€submitted€a€motion€for€a€psychiatric€examination€and€the€prosecutorÏobtained€a€superseding€indictment.€€The€trial€court€granted€the€motion€to€evaluate€theÏDefendant.ÌÌà àThe€Defendant€received€an€outpatient€evaluation€from€DeDe€Wallace€MentalÏHealth€Center,€œwhich›€referred€him€to€the€Middle€Tennessee€Mental€Health€InstituteððsÏ(MTMHI)€forensic€unit€for€a€thirty„day€inpatient€evaluation€to€assess€his€competency€toÏenter€a€plea.€€The€evaluating€team€at€MTMHI€concluded€that€œhe›€was€competent€to€enterÏa€plea.€€On€March€5,€1992,€the€Defendant€pled€guilty€to€aggravated€assault€and€wasÏsentenced,€out€of€œhis€range,›€as€a€Range€III€offender€to€fourteen€years€at€forty„fiveÏpercent.ÌÌà àIn€December,€1993,€the€Defendant€filed€a€petition€for€post„conviction€relief.€ÏCounsel€was€œappointed,›€and€an€amended€petition€for€post„conviction€relief€was€filed€inÏJanuary,€1995.€€In€his€post„conviction€petition,€œhe›€alleged€that€he€did€not€knowingly€andÏvoluntarily€enter€into€his€guilty€plea€and€did€not€understand€the€collateral€effects€of€theÏplea.€€The€trial€court€conducted€œan€evidentiary›€hearing€on€the€merits.€€The€DefendantððsÏpetition€was€denied,€and€he€appeals€to€this€court.ÌÌà àIn€the€case€òòsubóó€òòjudiceóó,€the€Defendantððs€counsel€requested€a€psychiatricÏevaluation€of€the€Defendantððs€competency€to€stand€trial.€€The€trial€court€ordered€theÏevaluation,€in€compliance€with€Tennessee€Code€Annotated€section€33„7„301.€€HeÏunderwent€an€extensive€inpatient€evaluation€for€nearly€30€days.× ƒ! ××  ×€€Upon€the€unanimousÏœagreement€of›€the€treatment€team,€œthey€determined›€œhe€was€competent›€to€stand€trial.€ÏBefore€entering€his€guilty€plea,€the€trial€court€followed€the€guidelines€in€Rule€11(c),ÏTennessee€Rules€of€Criminal€Procedure,€€informing€the€Defendant€of€his€constitutionalÏrights€and€the€consequences€of€the€plea.€òòSee€alsoóó€òòState€v.€Mackeyóó,€553€S.W.2d€337,Ï341€(Tenn.€1977).ÌÌà àAt€the€post„conviction€hearing,€the€Defendant€testified€that€he€had€no€recollectionÏof€pleading€guilty,€signing€the€form€or€speaking€with€the€trial€judge.€€His€currentÏpsychiatrist,€Dr.€Pruitt,€€testified€to€a€litany€of€past€diagnoses€made€of€the€Defendant.€€Dr.ÏPruitt€testified€that€the€Defendant€likely€has€some€form€of€schizophrenia.€€He€stated€that,Ïbased€on€the€Defendantððs€prior€history€of€mental€œdisorder€and›€particularly€œbecause€he›Ïdemonstrated€some€thought€disturbances,€the€Defendant€was€likely€incompetent€whenÏhe€entered€the€guilty€plea.€€However,€Dr.€Pruitt€did€not€have€contact€with€the€DefendantÏuntil€the€fall€of€1994,€œapproximately›€one€and€a€half€years€after€the€March€5,€1992€plea.€€ÌÌœà àThe›€State€produced€the€supervising€psychiatrist,€Dr.€White,€and€the€psychologist,ÏDr.€Azimi,€who€tested€the€Defendant€during€his€evaluation€at€MTMHI.€€Dr.€White€testifiedÏthat€he€did€not€observe€overt€signs€of€nor€did€he€diagnose€the€Defendant€with€a€mentalÏillness.€€€He€œdiagnosed›€the€Defendant€œonly€with›€substance€abuse€and€borderlineÏintellectual€functioning.€While€at€MTMHI,€Dr.€White€continued€the€Defendant€onÏmaintenance€doses€of€antidepressant€and€antianxiety€medications.€€He€€reported€noÏobservations€by€the€evaluation€team€of€behavior€associated€with€a€thought€disorder.€Dr.ÏAzimi€testified€that€he€tested€the€Defendant€over€a€three„day€period.€€One€of€œthe€tests›Ïwas€invalid€because€there€was€evidence€œthat€the€Defendant€reported€a›€grossÏexaggeration€of€œsymptoms.›€ÌÌà àThe€March€5,€1992€record€reveals€no€overt€statements€or€actions€œon›€the€part€ofÏthe€Defendant€that€suggest€he€was€incompetent€at€the€time€he€pled€guilty.€€He€had€anÏevaluation€just€prior€to€œentering€the›€plea€that€determined€œhe›€was€competent€to€stand€trial.€ÏAlthough€there€is€evidence€of€a€long€history€of€psychiatric€problems,€the€presence€of€suchÏa€history€does€not,€standing€alone,€render€an€accused€incompetent€to€enter€a€plea.€ÏWhat€is€relevant€is€the€Defendantððs€ability,€at€the€time€of€entering€the€plea,€to€have€aÏreasonable€capacity€to€understand€the€proceedings€and€to€consult€with€counsel.ÌÌà àThere€is€evidence€in€the€record€that€the€Defendant€discussed€the€plea€withÏcounsel.€€Defense€counsel€testified€that€before€the€proceedings,€the€Defendant€wasÏconcerned€with€his€girlfriendððs€feelings€about€the€plea€and€that€he€changed€his€mindÏseveral€times.€€That€is€some€indication€that€he€contemplated€the€nature€andÏconsequences€of€his€actions.€€ÌÌà àFurthermore,€the€Defendant€evidenced€no€symptoms€or€actions€to€suggest€heÏwas€impaired€when€he€entered€his€plea.€€The€trial€court€adequately€informed€him€aboutÏthe€waiver€of€his€constitutional€rights€upon€taking€his€guilty€plea.€€In€assessing€theÏcircumstances€at€the€time€the€plea€was€accepted,€the€record€certainly€supports€a€findingÏthat€the€Defendant€knowingly,€understandingly€and€voluntarily€entered€his€plea.ÌÌà àThe€trial€court€evaluated€the€evidence€and€weighed€conflicting€testimony€and€theÏcredibility€of€the€witnesses€and€determined€that€the€Defendant€had€failed€to€prove€that€heÏwas€incompetent€to€enter€his€guilty€plea.€€Because€the€trial€judgeððs€findings€areÏsupported€by€œthe›€record,€we€will€not€disturb€œhis›€judgment€on€appeal.€€The€judgment€ofÏthe€trial€court€is€affirmed.ÌœÌÓÓÌà
