àThe€defendant€was€indicted€for€assault€and€vandalism€under€fiveÏhundred€dollars€($500).€€A€jury€found€him€guilty€of€the€vandalism€offense,€a€Class€AÏmisdemeanor,€and€assessed€a€fine€of€one€thousand€five€hundred€dollars€($1500).€ÏHe€was€found€not€guilty€of€the€assault€charge.€€The€court€below€sentenced€theÏdefendant€to€incarceration€for€eleven€œmonths,›€twenty„nine€œdays›€with€a€releaseÏeligibility€date€at€ten€œpercent.›€€In€this€direct€appeal,€the€defendant€contends€that€theÏevidence€was€not€sufficient€to€support€the€verdict€and€that€the€trial€court€erred€by€notÏsentencing€him€to€immediate€probation.€€After€a€review€of€the€record,€we€affirm€theÏjudgment€below.ÌÌà àà àJennifer€œLouthan,€age€sixteen,›€testified€that€she€and€the€œdefendant,€ageÏtwenty„three,›€had€been€engaged€to€be€married.€€On€the€afternoon€of€April€12,€1995,Ïshe€drove€over€to€the€defendantððs€fatherððs€residence,€where€the€defendant€lived,€withÏher€girlfriend€Renee€Mink.€€Ms.€Louthan€was€driving€a€small€pick„up€truck€which€herÏfather€had€bought€for€her€use.€€Ms.€Louthan€and€the€defendant€got€into€an€argumentÏin€which€the€defendant€demanded€that€she€return€the€jewelry€he€had€given€her.€ÏFollowing€this€argument,€according€to€Ms.€Louthan,€she€backed€to€the€top€of€theÏdriveway€where€the€defendant,€who€was€in€his€car,€bumped€her€truck€twice€fromÍbehind.€€Subsequently,€he€got€out€of€his€car,€came€over€to€her€truck€while€she€andÏMs.€Mink€sat€in€it€and€beat€out€the€back€window.€€Ms.€Louthan€testified€that€theÏdefendant€had€then€struck€her€twice€in€the€head€and€then€leaned€into€the€truck€andÏproceeded€to€attack€her€radio.€€Ms.€Mink€testified€to€the€same€effect.ÌÌà àà àThe€defendant€took€the€stand€and€denied€that€he€had€broken€out€theÏtruck€window€and€further€denied€striking€Ms.€Louthan.€€He€testified€that€the€truckÏwindow€had€already€been€broken€when€Ms.€Louthan€arrived€at€the€house.€TheÏdefendantððs€œfather›€testified€that€he€had€heard€the€argument€and€had€watched€theÏlatter€portion€of€the€meeting€between€his€son€and€his€fiancee€and€stated€that€he€hadÏnot€seen€his€son€either€break€out€the€window€or€strike€the€girl.€€Otis€œHatfield›,€a€friendÏof€the€defendantððs€father,€testified€similarly.€€Debbie€A.€œGoins›€testified€that€she€hadÏdriven€by€the€defendantððs€fatherððs€house€as€Ms.€Louthan€was€pulling€into€theÏdriveway€and€that€the€back€window€of€the€truck€was€already€broken€out.ÌÌà àà àA€defendant€challenging€the€sufficiency€of€the€proof€has€the€burden€ofÏillustrating€to€this€Court€why€the€evidence€is€insufficient€to€support€the€verdictÏreturned€by€the€trier€of€fact€in€his€or€her€case.€€This€Court€will€not€disturb€a€verdict€ofÏguilt€for€lack€of€sufficient€evidence€unless€the€facts€contained€in€the€record€and€anyÏinferences€which€may€be€drawn€from€the€facts€are€insufficient,€as€a€matter€of€law,€forÍa€rational€trier€of€fact€to€find€the€defendant€guilty€beyond€a€reasonable€doubt.€€òòState€v.ÏœTuggle›óó,€639€S.W.2d€913,€914€(Tenn.€1982).ÌÌ€à àà àIn€a€challenge€to€the€sufficiency€of€the€convicting€evidence,€we€mustÏreview€the€evidence€in€the€light€most€favorable€to€the€prosecution€in€determiningÏwhether€ð àQuestions€concerning€the€credibility€of€witnesses,€the€weight€and€valueÏto€be€given€to€the€evidence,€as€well€as€factual€issues€raised€by€the€evidence€areÏresolved€by€the€trier€of€fact,€not€this€Court.€€òòCabbageóó,€571€S.W.2d€832,€835.€€A€guiltyÏverdict€rendered€by€the€jury€and€approved€by€the€trial€judge€accredits€the€testimonyÏof€the€witnesses€for€the€State,€and€a€presumption€of€guilt€replaces€the€presumption€ofÏinnocence.€€òòState€v.€Graceóó,€493€S.W.2d€474,€476€(Tenn.€1973).ÌÌà àà àThe€instant€case€is€a€classic€example€of€a€swearing€contest.€€The€juryÍbelieved€Ms.€Louthanððs€version€of€how€her€truck€window€came€to€be€broken.€€ThisÏwas€the€juryððs€prerogative€and€we€will€not€disturb€its€verdict.€€The€defendantððsÏargument€that€the€juryððs€decision€to€acquit€him€on€the€assault€charge€proves€that€itÏhad€reasonable€doubt€as€to€the€vandalism€charge€is€without€basis€in€law€or€fact.€€TheÏevidence€was€sufficient€to€prove€that€he€vandalized€Ms.€Louthanððs€truck€and€thisÏissue€is€without€merit.ÌÌà àà àThe€defendant€next€contends€that€the€trial€court€erred€by€not€putting€himÏon€immediate€probation.€€We€disagree.€€The€trial€court€denied€immediate€probationÏð ðbecause€of€the€prior€[criminal]€record,€the€history€of€alcohol€abuse,€and€theÏdeterrence€factor.ðð€€Ô% € Ô€The€defendant€has€two€prior€convictions€for€DUI.€€He€alsoÏadmitted€during€cross„examination€in€the€guilt€phase€of€the€trial€that€he€had€beenÏdriving€without€a€driverððs€license€at€the€time€of€the€offense.€€He€told€the€officerÏpreparing€the€presentence€report€that€he€had€started€using€alcohol€at€age€sixteenÏand€that€he€continues€to€use€it€ð ðnow€and€then.ðð€€The€ð ðdeterrence€factorðð€referred€to€theÏcourtððs€particular€concern€that€ð ða€message€needs€to€go€out€that€violence€is€not€theÏway€to€settle€conflicts.ðð€ÌÌà àà àWhen€a€defendant€complains€of€his€or€her€sentence,€we€must€conduct€aÏòòdeóó€òònovoóó€review€with€a€presumption€of€correctness.€€T.C.A.€ðð€40„35„401(d).€ThisÍpresumption,€however,€ð àOur€review€of€the€record€establishes€that€the€trial€court€considered€theÏsentencing€principles€and€all€relevant€facts€and€circumstances€and€the€defendantððsÏsentence€is€therefore€cloaked€with€the€presumption€of€correctness.€€In€sentencing€theÏdefendant,€the€trial€court€considered€the€sentencing€purposes€set€forth€in€T.C.A.€œÌðð›€40„35„102,€€and€ð ðhighlightedðð€the€following:ÌÓÓà àà8 àœÌÒ ô ÒÒ ¦ ÒÒ ô ÒÒ Ü Ò[O]ne›,€every€defendant€shall€be€punished€by€the€imposition€ofÏa€sentence€justly€deserved€in€relation€to€the€seriousness€of€theÏoffense.€€Number€two,€to€assure€fair€and€consistent€treatmentÏof€all€defendants€by€eliminating€unjustified€disparity€inÏsentencing€and€providing€a€fair€sense€of€predictability€of€theÏcriminal€law€and€its€sanctions.€€And€three,€to€prevent€crime€andÏpromote€respect€for€the€law€by€providing€an€effective€deterrentÏto€those€likely€to€violate€the€criminal€laws€of€the€state.̛̜ÌÒ ÒOne,›€confinement€is€necessary€to€avoid€depreciating€theÍseriousness€of€the€offense,€or€confinement€is€particularlyÏsuited€to€provide€an€effective€deterrence€to€others€likely€toÏcommit€similar€offenses.€.€.€.€However,€the€sentence€imposedÏshould€be€no€greater€than€that€deserved€for€the€offenseÏcommitted.€€Inequalities€in€sen‚tences€should€be€avoided€andÏthe€sentence€imposed€should€be€the€least€severe€measureÏnecessary€to€achieve€the€purposes€for€which€the€sentence€isÏimposed.̛̜ÌÒ àThe€burden€of€establishing€suitability€for€probation€rests€with€theÏdefendant.€€T.C.A.€ðð€40„35„303(b);€òòState€v.€Charltonóó,€746€S.W.2d€467,€469€(Tenn.ÏCrim.€App.€1987).€€Factors€applicable€to€determining€the€defendantððs€suitability€forÏprobation€include€the€circumstances€of€the€offense,€his€criminal€record,€social€historyÏand€present€condition,€and€the€deterrent€effect€upon€and€best€interest€of€theÏdefendant€and€the€public.€€òòState€v.€Ñ X ÑœGennoeóó,›€851€S.W.2d€833,€837€(Tenn.€Crim.€App.Ï1992).€€ÌÌà àà àIt€is€clear€from€the€record€of€this€cause€that€the€defendant€does€not€haveÏa€great€deal€of€respect€for€our€laws:€he€started€drinking€while€underage;€he€has€beenÏconvicted€for€DUI€twice,€yet€continues€to€drink;€he€has€driven€his€car€upon€the€publicÏhighways€without€a€license€to€do€so;€and€he€engaged€in€an€act€of€vandalism€whileÏupset€with€his€fiancee.€€As€set€forth€above,€the€trial€courtððs€decision€to€denyÏimmediate€probation€is€presumed€correct.€€Our€òòdeóó€òònovoóó€review€of€the€recordÍestablishes€that€the€evidence€does€not€preponderate€against€the€courtððs€impliedÏfinding€below€that€the€defendant€did€not€carry€his€burden€of€proving€his€suitability€forÏprobation.€€We€therefore€conclude€that€the€factors€relied€upon€by€the€trial€court€inÏdenying€probation€were€proper.œ×
