àThe€petitioner,€Timothy€Brown,€appeals€from€the€Davidson€CountyÏCriminal€Courtððs€denial€of€his€petition€for€post„conviction€relief.€€The€petitioner€wasÏconvicted€in€1993€upon€his€pleas€of€guilty€to€three€counts€of€sale€of€cocaine€in€excessÏof€one„half€gram.€€He€was€sentenced€as€a€Range€II,€persistent€offender€to€twentyÏyears,€fifteen€years€and€fifteen€years,€respectively,€with€one€fifteen„year€sentence€toÏbe€served€consecutively€to€concurrent€sentences€of€twenty€and€fifteen€years,€for€anÏeffective€sentence€of€thirty„five€years.€€No€direct€appeal€of€his€œsentences›€œwas›€made.€€InÏthis€appeal€as€of€right,€the€petitioner€asserts€that€(1)€his€guilty€œpleas›€œwere›€not€enteredÏknowingly€and€voluntarily,€(2)€trial€counsel€was€ineffective€in€advising€him€relative€toÏthe€entry€of€his€guilty€œpleas›€and€(3)€he€is€entitled€to€a€delayed€appeal.€€€ÌÌà àAn€evidentiary€hearing€was€held€regarding€the€petitionerððs€claims€of€anÏinvoluntary€plea€and€the€ineffective€assistance€of€his€retained€counsel.€€The€recordÏreflects€that,€during€plea€negotiations,€the€petitioner€was€offered€a€total€effectiveÏsentence€of€twenty€years€in€exchange€for€his€guilty€pleas€to€the€three€offenses€and€hisÏtestifying€against€a€codefendant€at€trial.€€The€petitioner€turned€down€the€offer€and€theÏcase€proceeded€to€trial.€€After€jury€selection,€the€petitioner€decided€to€plead€guiltyÏwhen€he€noticed€that€a€confidential€informant€had€appeared€to€testify.€€Trial€counselÏinquired€about€the€previous€plea€offer€of€twenty€years€to€which€the€prosecution€repliedÏthat€the€state€had€no€interest€in€pursuing€a€plea€agreement€on€the€day€of€trial.€€AfterÏconferring€with€trial€counsel,€the€petitioner€chose€to€enter€guilty€pleas€with€no€agreedÏsentence€or€recommendations€by€the€state.€€The€petitioner€testified€that€trial€counselÏadvised€him€that€his€total€sentence€would€probably€be€about€twenty€years.€€TrialÏcounsel€testified€that€he€informed€the€petitioner€of€the€entire€range€of€punishment€andÏthat€the€trial€court€would€make€the€final€determination€of€the€sentences.ÌÌà àThe€transcript€of€the€guilty€plea€submission€hearing€reflects€that€theÏpetitioner€fully€understood€that€he€was€entering€the€guilty€pleas€without€sentenceÏrecommendations.€€The€petitioner€also€indicated€that€he€understood€that€he€wasÏfacing€a€possible€sentence€of€ninety€years,€depending€upon€his€offender€status,€andÏthe€imposition€of€consecutive€sentences.€€The€petition€to€œenter›€guilty€œpleas›€that€wasÍsigned€by€the€petitioner€reflects€that€the€pleas€were€entered€without€aÏrecommendation€as€to€sentence.€€The€trial€court€also€inquired€as€to€the€petitionerððsÏunderstanding€that€he€was€waiving€any€right€to€appeal€these€convictions€by€pleadingÏguilty€to€which€the€petitioner€replied€that€he€understood.ÌÌ€€à àAt€the€sentencing€hearing€several€months€later,€the€petitioner€wasÏsentenced€to€thirty„five€years.€€At€the€post„conviction€hearing,€the€petitioner€testifiedÏthat€his€trial€counsel€told€him€that€he€would€appeal€the€petitionerððs€sentences,€but€trialÏcounsel€testified€that€he€made€no€such€statement€and€that€he€did€not€believe€thatÏthere€was€reason€for€such€an€appeal.€€Trial€counsel€acknowledged,€though,€that€heÏdid€not€appeal€the€sentences€and€did€not€advise€the€petitioner€of€any€time€limit€for€theÏappeal€or€of€any€other€procedures€for€appeal.€€ÌÌ€à àAt€the€post„conviction€hearing,€the€trial€court€found€that€the€petitionerððsÏpleas€had€been€knowingly€and€voluntarily€entered€and€that€trial€counsel€did€notÏineffectively€advise€him€to€enter€the€pleas.€€The€trial€court€also€denied€the€petitionerððsÏrequest€for€a€delayed€appeal,€stating€that€the€petitioner€had€waived€any€right€toÏappeal€by€entering€guilty€pleas.€€It€further€concluded€that€the€petitioner€had€waivedÏany€right€to€appeal€the€œsentences›€because€the€petition€to€enter€guilty€pleas€includedÏthe€following€€statement:€€ð ðI€agree€to€accept€any€punishment€which€the€law€permits€theÏCourt€to€impose.ðð€€ÌÌà àOn€appeal,€we€are€bound€by€the€trial€courtððs€findings€of€fact€in€a€post„conviction€case€unless€we€conclude€that€the€evidence€in€the€record€preponderatesÏagainst€those€findings.€€€òòBlack€v.€Stateóó,€794€S.W.2d€752,€755€(Tenn.€Crim.€App.€1990).€ÏIn€this€respect,€the€state€argues€that€the€record€fully€supports€the€trial€courtððsÏdeterminations€relative€to€the€voluntariness€of€the€petitionerððs€pleas€and€theÏeffectiveness€of€trial€counselððs€advice€regarding€those€pleas,€but€concedes€that€theÏpetitioner€should€be€granted€a€delayed€appeal.€€We€agree€in€all€aspects.ÌÌà àAs€previously€indicated,€the€record€reflects€that€the€petitioner€was€wellÏaware€of€his€rights€and€the€alternatives€available€to€him€when€he€entered€his€guiltyÏpleas.€€Likewise,€there€has€been€no€showing€that€trial€counsel€provided€any€improperÏrepresentation€through€the€plea€process.€€ÌÌà àHowever,€the€trial€courtððs€determinations€regarding€the€petitionerððsÏappeal€of€his€sentences€are€not€supported€by€the€record.€€The€plea€hearing€transcriptÏreflects€that€the€trial€court€addressed€the€petitioner€regarding€his€waiver€of€appeal€byÏpleading€guilty€relative€to€his€underlying€convictions€„„€no€mention€being€made€aboutÏthe€sentences€to€be€imposed€at€a€later€date.€€Moreover,€the€order€granting€the€guiltyÏplea€petition€refers€only€to€the€waiver€of€an€appeal€for€the€convictions,€not€theÍsentences.€€œFinally,›€the€petitionerððs€guilty€plea€petition€included€the€following€provisionÏupon€which€the€trial€court€relied€to€find€waiver€of€any€œsentence€appeal:›ÌÓ  ÓÓÓà8 àà à10.€€My€attorney€has€discussed€with€me€whether€€IÏam€eligible€for€alternative€sentencing,€including€probation.€ÏI€understand€my€attorneyððs€statements€on€this€issue.€ÏAlthough,€if€eligible,€I€hope€to€receive€probation€or€otherÏalternative€sentencing,€I€agree€to€accept€any€punishmentÏwhich€the€law€permits€the€Court€€to€impose.€€ÌÌÓ  ÓÓÓIn€context,€this€provision€is€nothing€more€than€a€statement€by€the€petitioner€that€heÏunderstands€that€he€will€not€be€entitled€to€withdraw€his€guilty€plea€merely€because€heÏreceives€an€unanticipated€sentence.€€It€certainly€cannot€be€interpreted€in€this€case€toÏbe€a€presentence€waiver€of€the€right€to€appeal€any€then„unknown€sentences,Ïregardless€of€their€level€of€compliance€with€the€sentencing€laws.ÌÌà àIn€substance,€the€record€shows€that€the€petitionerððs€trial€counselÏessentially€abandoned€the€petitioner€relative€to€any€appeal€of€his€sentences€andÏfailed€to€advise€the€petitioner€of€such€steps€as€would€œpreserve€any›€right€to€appeal.€ÏUnder€these€circumstances,€we€conclude€that€the€petitioner€is€entitled€to€a€delayedÏappeal€pursuant€to€T.C.A.€ðð€40„30„120€in€order€to€have€the€validity€of€his€sentencesÏreviewed.€€ÌÌà àIn€consideration€of€the€foregoing,€we€affirm€the€trial€courtððsÏdeterminations€that€the€petitionerððs€convictions€upon€his€guilty€pleas€were€validlyÍobtained.€€However,€the€trial€courtððs€denying€the€petitioner€a€delayed€appeal€isÏreversed€and€the€case€is€remanded€for€the€trial€court€to€enter€an€order€granting€theÏpetitioner€a€delayed€appeal€after€which€time€the€petitionerððs€time€for€appeal€will€beÏbegin€to€run.€€€€ÌÌÓÓà
