Inthisappeal,asofright,theappellantcontendsthathisconvictionsmustbereversedbecausethetrialcourtacceptedhisguiltypleas"inviolationofRule11,TennesseeRulesofCriminalProcedure,Statev.Mackey,[553S.W.2d337(Tenn.1977)],andBoykinv.Alabama,[395U.S.238,89S.Ct.1709(1969)]."Specifically,theappellantcontendsthat,attheguiltypleahearing,thetrialjudgefailedtoadvisehim oftheminimumandmaximumpenaltieshewasfacinginanyofhiscases.Again,wenotetherecordreflectsthattheappellant,pursuanttothepleaagreement,receivedtheminimumsentencepermissibleineachoftheeightcasesinwhichaguiltypleawasentered. WefirstaddresstheissueraisedbytheStateofwhetherthetrialcourtwaswithouttheauthoritytogranta delayedappeal.Weconcludethatitdidnot,baseduponthefollowing:8 (1)Ajudgmentinacriminalcasebecomesfinalthirtydaysafteritsentry.Statev.Bouchard,563S.W.2d561,563(Tenn.Crim.App.1977)(citationsomitted);Statev.Thomas,No.03C019504CR00109(Tenn.Crim.App.atKnoxville,Nov.15,1995)(citationsomitted).TheappellantsguiltypleaswereenteredonJanuary28,1993.TheNoticeofAppealinthiscasewasfiledonJune12,1995,almosttwoandonehalfyearslater.Accordingly,thetrialcourtwaswithoutjurisdictioninthiscase.8 (2)Generally,noappealliesfromaspecificsentenceimposedpursuanttoapleabargainagreementotherthanbyTenn.R.Crim.P.37(b)(2).Failingtopreserveanappealfromapleaofguiltyusuallyforeclosesanydirectattackuponsuchaplea.SeeStatev.McClintock,732S.W.2d268,269(Tenn.1987).SeealsoTenn.R.App.P.Rule3(b).8 (3)Thetrialcourthadnoauthoritytogranta delayedappeal.AdelayedappealcanonlybegrantedbyatrialcourtuponapetitionfiledunderthePostConvictionActseekingthatrelief,andthen,onlyafteranevidentiaryhearingwherethecourtfindsthatthedefendantwasunconstitutionallydeniedanappealfromhis"originalconviction."Whisnantv.State,532S.W.2d572,575(Tenn.Crim.App.1975).Tenn.CodeAnn.4030120,(repealed1995)(replacedbyTenn.CodeAnn.4030213(1995Supp.).Therecordinthiscaseindicatesthatthetrialcourtdismissedtheappellantspostconvictionpetition.Parenthetically,wenotethatthesubstantiveissueonappeal,i.e.failuretoadviseastominimumandmaximumsentencerangeisnotconstitutionallymandated.Bryanv.State,848S.W.2d72,75(Tenn.Crim.App.1992).8 (4)ThetrialcourtsordercitesasauthorityfortheappealTenn.R.Crim.P.,Rule37(b)(iii).ThisrulepermitsanappealfromaguiltypleainwhichtherewasapleaagreementunderRuleR.Crim.P.,Rule11(e)onlywhen Theerror(s)complainedofwerenotwaivedasamatteroflawbythepleaofguiltyornolocontendere,orotherwisewaived,andifsucherrorsareapparentfromtherecordoftheproceedingsalreadyhad.Thisruleisnotapplicabletothefactsofthiscaseasthetrialcourthadnojurisdiction.Seesupranumber1.8 (5)ThetrialcourtsorderalsocitesasauthorityfortheappealTenn.RulesCrim.P.Rule45.RulesofCriminalProceduredonotapplytoappellateproceedings.RulesofAppellateProceduregovernproceedingsbeforetheSupremeCourt,CourtofAppeals,andCourtofCriminalAppeals.TheonlymethodfortakinganappealasofrighttothisCourtisprescribedbytheRulesofAppellateProcedure,specificallyRules3and4.Accordinglyweconcludethatthetrialcourtwaswithoutauthoritytogranta delayedappeal.SeePorterv.Daniels,No.88276II(Tenn.App.atNashville,Feb.22,1989),petitiontorehear,(Tenn.App.atNashville,Mar.15,1989).
