×€€He€claimed€that€around€noonÏon€the€day€of€the€murder,€the€defendant€and€her€brother€RickyÏArwood,€and€Barbara€James€met€him€at€his€mother's€house.€ÏEventually,€all€went€to€Ms.€James'€house,€where€the€victim€hadÏbeen€staying€since€her€separation€from€her€boyfriend.€€All€shotÏpool,€drank,€and€used€drugs€at€Ms.€James'€house€until€the€victimÏarrived€with€a€man€named€Roy€Belcher.€€Because€the€victimÏclaimed€someone€in€Greeneville€wanted€to€kill€her,€theÏdefendant,€who€had€known€the€victim€since€high€school,€and€Ms.ÏJames€tried€to€change€her€appearance€by€cutting€and€dying€herÏhair.€€€ÌÌà àà àEtherton€testified€that€the€defendant€wanted€to€killÏthe€victim€"over€a€pot€deal€that€went€bad,€and€she€wa[s]n'tÏgoing€to€screw€over€her€no€more";€€He€claimed€that€the€defendantÏ"[s]aid€this€was€her€last€time,€and€she's€going€to€take€care€ofÏit."€€Etherton€testified€that€on€the€previous€day,€the€defendantÏhad€said€that€she€intended€to€inject€the€victim€with€insulin€andÏthen€get€rid€of€the€body.€€Although€his€testimony€wasÏcontradictory€about€whether€they€had€been€with€the€victim€theÍnight€before€the€murder,€Etherton€also€stated€that€on€the€nightÏbefore€the€murder€the€defendant€had€poured€liquid€morphine€inÏthe€victim's€beer€but€that€it€had€not€harmed€her.ÌÌà àà àLater€in€the€evening,€the€group€informed€the€victimÏthat€they€knew€a€cabin€where€she€would€be€safe.€€Just€beforeÏthey€left,€Ms.€James€gave€Etherton€a€.20€gauge€shotgun€and€RickyÏArwood€gave€the€defendant€a€knife.€€The€defendant,€the€victim,Ïand€Ms.€James€were€in€the€victim's€Volkswagen€following€EthertonÏand€Ricky€Arwood,€who€were€in€the€defendant's€truck.€€TheÏVolkswagen€stopped€and€Etherton€turned€around€to€check.€€When€heÏsaw€that€the€victim€and€the€defendant€were€arguing€and€fighting,ÏEtherton€took€the€gun€from€the€truck€and€fired€three€shots€intoÏthe€victim's€chest€and€head.€€He€described€the€last€two€shots€asÏan€attempt€to€prevent€the€identification€of€the€body.€€EthertonÏclaimed€that€he€killed€the€victim€only€because€the€defendantÏwanted€her€dead.ÌÌà àà àThe€body€was€left€at€the€scene.€€The€group€took€theÏVolkswagan€to€a€residence€belonging€to€one€of€Etherton'sÏfriends.€€The€defendant€and€Ms.€James€got€rid€of€the€victim'sÏbelongings.€€Later,€the€victim's€brother,€Buddy€King,€discoveredÍa€syringe€in€the€victim's€car.€€ÌÌà àà àDetective€Robert€Caldwell€testified€that€the€victimÏwas€identified€by€fingerprints.€€Two€.20€gauge€shotgun€shellÏcasings€found€near€the€victim's€body€matched€a€shell€found€atÏthe€home€of€Ms.€James.€€A€.20€gauge€shotgun€was€under€a€bed€atÏthe€James'€residence.€€Testing€established€that€the€two€shellsÏfound€near€the€body€were€fired€from€the€shotgun.€€ÌÌà àà àRicky€Arwood€also€testified€for€the€state.€€HeÏremembered€that€Etherton€had€a€shotgun€but€he€thought€they€wereÏdriving€a€brown€car,€rather€than€a€truck,€at€the€time€of€theÏshooting.€€Arwood,€who€claimed€that€he€was€on€medication€andÏunder€the€influence€of€alcohol,€remembered€Etherton€getting€outÏof€their€vehicle€and€then€hearing€three€loud€bangs.€€ÌÌà àà àThe€defendant€testified€that€she€had€experiencedÏdomestic€problems€of€her€own,€that€she€and€the€victim€wereÏlooking€for€a€safe€place,€and€that€she€had€no€idea€where€theyÏwere€going€on€the€night€of€the€murder.€€The€defendantÏacknowledged€that€Ms.€James€had€been€telling€her€that€the€victimÏwas€setting€her€up€on€something€to€do€with€drugs.€€The€defendantÍadmitted€that€when€they€stopped€the€car,€she€had€tried€toÏfrighten€the€victim€with€the€syringe€of€insulin,€claiming€it€wasÏtruth€serum.€€She€testified€that€the€victim€knocked€the€syringeÏout€of€her€hand€at€which€point,€Etherton€ordered€her€out€of€theÏcar€and€fired€three€shots.€€She€acknowledged€that€they€got€ridÏof€the€Volkswagen€and€that€she€had€helped€Ms.€James€dispose€ofÏthe€victim's€personal€effects.€€She€claimed€that€EthertonÏthreatened€her€and€that€she€had€maintained€a€relationship€withÏhim€out€of€fear.ÌÌà@ àIÌà àà àThe€defendant€first€asserts€that€there€wasÏinsufficient€corroboration€to€support€the€conviction€of€firstÏdegree€murder.€€ÌÌà àà àThe€codefendant€Etherton€testified€that€the€defendantÏwanted€to€kill€the€victim€because€she€thought€the€victim€wasÏsetting€her€up€on€a€drug€deal.€€He€claimed€that€the€defendantÏhad€planned€to€kill€the€victim€by€injecting€her€with€insulin€andÏthen€get€rid€of€the€body.€€That€the€defendant€acknowledgedÏhaving€insulin€and€a€syringe€on€the€night€of€the€murder€servedÏas€corroborating€evidence.€€Later,€the€syringe€was€discovered€inÏthe€victim's€car.€€Moreover,€Etherton€had€testified€that€theÍdefendant€had€a€knife€on€the€evening€of€the€murder€and€hadÏstruggled€with€the€victim€before€he€returned€to€theirÏautomobile.€€The€medical€examiner€testified€that€the€three€stabÏwounds€occurred€prior€to€the€gunshot€wounds.€€That,€in€part,Ïcorroborated€Etherton's€claim€that€he€had€shot€the€victim€onlyÏafter€the€other€attempts€had€failed.€€ÌÌà àà àUnder€these€circumstances,€the€defendant's€statementsÏand€the€medical€testimony€provide€sufficient€corroboration€ofÏthe€accomplice's€testimony.€€In€our€opinion,€a€rational€trier€ofÏfact€could€have€found€that€the€evidence€was€sufficient€toÏsupport€the€offense€of€first€degree€murder.€€òòSeeóó€òòJackson€v.ÏVirginiaóó,€443€U.S.€307€(1979).ÌÌà@ àIIÌà àà àNext,€the€defendant€claims€that€the€trial€court€erredÏwhen€it€denied€her€motion€for€a€continuance€made€just€before€theÏbeginning€of€the€trial.€€The€defendant€argues€she€was€too€ill€toÏassist€counsel€in€her€defense.€€ÌÌà àà àThe€law€is€well€settled.€€The€grant€or€denial€of€aÏcontinuance€rests€within€the€sound€discretion€of€the€trialÍcourt.€€òòState€v.€Sealsóó,€735€S.W.2d€849,€853€(Tenn.€Crim.€App.Ï1987).€€Its€determination€will€not€be€overturned€unless€there€isÏ"a€clear€showing€of€an€abuse€of€discretion,€to€the€prejudice€ofÏthe€defendant."€€òòWoods€v.€Stateóó,€552€S.W.2d€782,€784€(Tenn.ÏCrim.€App.€1977);€òòFrazier€v.€Stateóó,€3€Tenn.€Crim.€App.€696,€702,Ï466€S.W.2d€535,€537€(1970).ÌÌà àIt€is€not€disputed€that€the€defendant€suffered€fromÏphysical€disabilities€at€the€time€of€the€trial.€€At€the€time€ofÏtrial,€she€needed€to€have€a€liver€transplant.€€She€had€recentlyÏhad€an€eye€removed.€€Her€course€of€treatment€at€the€time€ofÏtrial€included€antibiotics€taken€intravenously.€€The€case€hadÏbeen€continued€on€several€occasions€due€to€the€continuing€natureÏof€her€medical€problems.€€At€the€last€continuance,€the€trialÏjudge€informed€the€defendant€that€absent€compelling€necessity,Ïshe€was€expected€to€be€ready€for€trial€at€this€setting.€€ÌÌà àà àAt€the€hearing€on€the€motion€for€a€new€trial,€theÏtrial€court€made€the€following€statement€concerning€theÏdefendant's€competency:€ÌÓÓà8 àà0 à[S]he€was€in€far€better€shape€than€I€thought€sheÏwould€be,€she€really€was.€€She€had€a€good€day,Ïnot€only€just€a€good€day€but€she€was€alert,€sheÍwas€able,€she€was€competent,€she€was€aware,€sheÏwas€conversive€with€counsel,€she€conferred€withÏcounsel€throughout€the€trial€at€critical€pointsÏand€not€disruptive€at€all€in€any€fashion.€€SheÏdemeaned€herself€in€proper€fashion.€€She€wasÏhooked€up€to€an€IV.€€That€could€not€prejudiceÏher,€if€anything€it€engendered€whatever€sympathyÏyou€could€engender€for€someone€who€had€committedÏthe€odious€offenses€detailed€by€the€proof.ÌÌÓÓÌà àà àBased€upon€our€own€review€of€the€record,€we€cannotÏconclude€that€the€trial€court€abused€its€discretion€byÏdetermining€that€a€continuance€was€not€required€by€theÏdefendant's€physical€condition.€€òòSeeóó,€òòe.g.óó,€òòState€v.€Robinsonóó,Ï622€S.W.2d€62,€74€(Tenn.€Crim.€App.€1980).€€That€there€had€beenÏseveral€prior€continuances€suggested€that€the€trial€court€hadÏbeen€sensitive€about€the€defendant's€medical€condition.€€TheÏcontinuing€nature€of€the€illness€indicates€that€she€would€haveÏlikely€been€expected€to€have€some€problems€at€any€time€Ìthe€trial€was€set.€€Finally,€the€record€does€not€support€herÏclaim€that€she€could€not€assist€her€counsel.€€She€appears€toÏhave€been€able€to€testify€competently€on€her€own€behalf.€€ÌÌà@ àIIIÌà àà àThe€defendant€also€claims€that€the€trial€court€shouldÏhave€excluded€a€color€photograph€of€the€victim€because€it€wasÍ"gruesome€in€nature€and€served€no€purpose€but€to€inflame€theÏjury."€€The€state€responds€that€the€photograph€gave€the€jury€aÏbetter€understanding€of€the€type€of€wounds€inflicted€and€theÏmanner€in€which€they€occurred.ÌÌà àThe€admissibility€of€photographs€from€the€scene€of€theÏcrime€is€governed€by€Tennessee€Rule€of€Evidence€403€and€òòState€v.ÏBanksóó,€564€S.W.2d€947€(Tenn.€1978).€€The€evidence€must€beÏrelevant€and€its€probative€value€must€outweigh€any€prejudicialÏeffect.€€Tenn.€R.€Evid.€403;€òòState€v.€Banksóó,€564€S.W.2d€at€950„51.€€Whether€to€admit€the€photographs€is€within€theÏdiscretionary€authority€of€the€trial€court€and€will€not€beÏreversed€absent€a€clear€showing€of€an€abuse.€€òòState€v.€Allenóó,Ï692€S.W.2d€651,€654€(Tenn.€Crim.€App.€1985).ÌÌà
