Onappeal,theappellantcontends:(1)thatthetrialcourterredindismissinghispetitionwithoutorderingcompliancewithTenn.CodeAnn.4030114(b),and(2)thatapplicationofthethreeyearstatuteoflimitations"shouldnoteffect[sic]thedeterminationofPetitioner'scasewhereonit's[sic]facetherecordissilentorabsent." 1   כ Theuniquefactsofthiscaseareirrelevanttoourdisposition.Theappellantclaimsthathis1961pleaisconstitutionallyinfirm.Hecontendsthatthepleawasunknowinglyenteredduetohiscounsel'sineffectiveassistance.Theappellant'sclaimofaninvoluntaryplea,however,hasbeencognizablesince,atleast,1977.SeeStatev.Mackey,553S.W.2d337(Tenn.1977)(holdingrecordmustaffirmativelydemonstratepleawasbothvoluntaryandknowledgeable).Hisrighttoreceivetheeffectiveassistanceofcounselduringthepleaprocesswascognizablein1985.SeeHillv.Lockhart,474U.S.52(1985)(holdingStricklandtestappliestopleaprocess).Accordingly,theappellanthashadmorethananadequateopportunitytopresenthisnowstaleclaims.
