Becausetheissuesraisedinthepetitioncanbeconclusivelydeterminedinfavorofthestate,weaffirmthejudgmentofthetrialcourt.̀  OnApril8,1994,thepetitionerpledguiltytoonecountofdisorderlyconduct,amisdemeanor,andfourcountsofdrivingwhileahabitualmotoroffenderorderwasineffect,ClassEfeloniesasdefinedinTenn.CodeAnn.5510616.Thetrialcourtimposedasentenceofelevenmonthstwentyninedaysforthedisorderlyconductoffensetobeservedconcurrently% < Ԁwithconsecutivesentencesofthreeyears,twoyears,andtwoyearsforthefirstthreehabitualmotoroffenderviolations.Atwoyearsentenceforthefourthviolationistobeservedconcurrently.WecalculatetheeffectivesentenceassevenyearsintheTennesseeDepartmentofCorrection.Therewasnodirectappeal.  OnDecember28,1995,thepetitionerfiledthis,hisfirstpetitionforpostconvictionrelief,alleging(1)thathisguiltypleashadnotbeenknowinglymadebecauseasevenyearratherthanasixyearsentencehadbeenimposed;(2)thathisdefensecounselwasineffective;and(3)thathisconvictionviolateddoublejeopardyprinciples.Thepetitionerrequestedtheappointmentofcounsel.Thestatefilednoresponse.  UtilizingthePostConvictionProcedureActeffectiveMay10,1995,thetrialcourtsummarilydismissedthepetitiononthefollowinggrounds:8 8 (1)thecourtfoundthatthepetitionpresentednobasisforrelief;8 8 (2)thetranscriptofthepleahearingshowedthatthecourtinformedthepetitionerhewouldreceiveasevenyearsentenceandthissentencewasinaccordancewiththepleaagreement;8 8 (3)bypleadingguilty,thedefendantwaivedhisrighttoattackdefectsinhiscasesincludinghisclaimsthatthetwofelonydrivingoffensescommittedonthesamedayconstitutedonlyoneoffenseandthathefaceddoublejeopardywhentriedonanindictmentthatthecitycourthadalreadydismissed.  Thepostconvictionlegislationof1995allowsforapreliminarydismissalwhen,amongotherthings,thepetitiondoesnotincludeapossiblegroundforrelief:8 8 Uponreceiptofapetitioninproperform,oruponreceiptofanamendedpetition,thecourtshallexaminetheallegationsoffactinthepetition.Iffactsalleged,takenastrue,failtoshowthatthepetitionerisentitledtorelief...thepetitionshallbedismissed.Tenn.CodeAnn.4030206(f)(1996Supp.)(emphasisadded).  Caselawbeforethe1995Actprovidessomeguidance.Tomakeaclaim"colorable"oractionable,theprosepetitionermustassertabasictheoryofrelief.Lowev.State,805S.W.2d368,372(Tenn.1991).Thiscourthasdefineda"colorable"claim,underthestatutorylawinexistencebeforethe1995Act,as"onethatallegesfactsshowingthattheconvictionresultedfromanabridgmentofaconstitutionalrightandwhichdemonstratesthatthegroundforreliefwasnotpreviouslydeterminedorwaived."HughRonaldCarmleyv.State,No.03C019305CR00167,slipop.at6(Tenn.Crim.App.,atKnoxville,Jan.13,1994).Muchlikethenewstatute,"thetest[was]whetheritappearsbeyonddoubtthatthe[petitioner]canprovenosetoffactsinsupportofhisclaimwhichwouldentitlehimtorelief."Swansonv.State,749S.W.2d731,734(Tenn.1988)(secondalterationinoriginal)(quotingBaxterv.Rose,523S.W.2d930,939(Tenn.1975)).SeealsoTenn.Sup.Ct.R.28,2(H)."[A]petitionstatingacolorableclaimforrelief...istobeconsideredonitsmerits."Swanson,749S.W.2dat734.  Thenewstatuterequiresthetrialcourts,atthepreliminarystages,tofirst"determinewhetherthepetitionerisindigentandinneedofcounsel."Tenn.CodeAnn.4030206(e).Thetrialcourt"mayprovidecounselandallowtimeforanamendmenttothepetition."Id.Beforetherecanbeapreliminarydismissal,however,thestatuterequiresthetrialcourttoassume"astrue"thefactsallegedbythepetitioner.Here,thepetitioner,despitethecontentsofthetranscriptofhisguiltypleas,firstinsistedthathissevenyearsentencewascontrarytothesentencepromisedinthepleaagreement.Heassertedthat,becauseofaoneyearincreaseinsentencelengthduringabenchconferencetowhichhewasnotprivy,hispleaswereneitherknowinglynorvoluntarilyentered;hecontendedthatbutforthedeficientrepresentationofhiscounsel,hewouldnothaveconcededhisguilttothechargesthathehadviolatedthehabitualoffenderorderandwouldhaveinsistedonatrial.  Here,itisclearfromthetranscriptofthesentencinghearingthatthetrialcourtcarefullyexplainedhissentencelengthtothepetitioner.Whenaskedifheunderstood,thepetitionerresponded,"Sevenyears,totalofsevenyears."Thetrialjudgeagaininquired,"Totalofsevenyears.Threeplustwo,plustwo?"Thepetitioneragreedtothesentenceontherecord.Itcanbeconclusivelydeterminedfromtherecordthatthepetitioneracknowledgedhisacceptanceofasevenyearsentence.Becausethecomplaintaboutthelengthofthesentenceistheonlybasisfortheallegationthatthepleawasnotvoluntary,thiscourtmustconcludethatthetrialcourtcorrectlyfoundthatthepleawasknowinglymade.  Next,thepetitionerclaimsthathistrialcounselwasineffectiveforallowinghimtopleadguiltytotwocountsofhabitualvehiclemotoroffenderviolation,becausetheoffenseswerecommittedonthesamedayandthus"constitute[d]oneoffenseunderTennesseelaw."Thepetitionergoesontoclaimthatthesetwooffenseswereusedtoqualifyhimasahabitualvehiclemotoroffender.Therecord,however,establishesthatthepetitionerisnotentitledtorelief.Whiledrivingoffensescommittedonthesamedayareconsideredasasingleoffensewhencomputingthenumberofconvictionsrequiredtoqualifyasahabitualmotoroffender,Tenn.CodeAnn.5510604,thesameisnottrueforviolationsofanexistingorder.Therecordshowsthatthetwoviolationsatissuewerefortheabridgementsofanorderalreadyinplace,nottheunderlyingoffensesusedtodeclarethepetitionerahabitualoffender.Thepetitionerhasincorrectlyinterpretedthelaw;thushiscounselcouldnothavebeenineffectiveonthisbasis.  Lastly,thepetitionerclaimsthathiscounselwasineffectivebyfailingtoprotectthepetitioner'srightagainstdoublejeopardy.ThepetitionerclaimsthatoneofthehabitualmotoroffenderviolationshadbeendismissedintheChattanoogaCityCourtbeforebeingrevivedwiththethreeothersintheCriminalCourtofHamiltonCounty.  InStatev.Knight,616S.W.2d593(Tenn.1981),oursupremecourt7jXXdXXd7madethefollowingcommentaboutdoublejeopardy:8 8  Theessenceoftheprohibitionagainstdoublejeopardyis...that[,inthesecondtrial,thedefendant]wouldriskconvictionforanoffenseforwhichhehasalreadybeenplacedontrialandinjeopardy.  Id.at595(citationsomitted).InAbneyv.UnitedStates,431U.S.651(1977),theUnitedStatesSupremeCourtexplainedthereasonfortheprotection:8 8 [T]heStatewithallitsresourcesandpowershouldnotbeallowedtomakerepeatedattemptstoconvictanindividualforanallegedoffense,therebysubjectinghimtoembarrassment,expenseandordeal,andcompellinghimtoliveinacontinuingstateofanxietyandinsecurity,aswellasenhancingthepossibilitythateventhoughinnocenthemaybefoundguilty.Id.at66162.Onceacriminalprosecutionreachesthepointwherejeopardyattaches,thedefendantmaynotberetriedonthesameoffense;however,thispointvariesdependingonwhatlegalactionistaken.Jeopardydoesnotattachatanarraignmentorpreliminaryhearing.Statev.Todd,654S.W.2d379,381(Tenn.1983);Statev.Lee,693S.W.2d361,363(Tenn.Crim.App.1985).Inabenchtrial,jeopardyattacheswhenadefendanthasbeenproperlyindicted;hehasproperlywaivedhisrighttoajurytrial;thecaseisbeforeacourtwithjurisdictionoverthematter;thejudgeisqualifiedandpresent;thedefendanthasenteredhisplea;andthewitness(oneorall)hasbeensworn.Statev.Daniels,531S.W.2d795,80102(Tenn.Crim.App.1975).Testimonybyawitnessisnotnecessary.Id.at802.Inajurytrial,jeopardyattachesatasimilarpoint:whenthedefendantisbeforeacourtwithjurisdiction;thereisaproperindictment;andthejuryhasbeenimpaneledandsworn.Id.at797.Onceagain,itisnotnecessarythattherebeanytestimony.Id.  Therearethreenotableexceptionstotheprohibitionagainstdoublejeopardy:8 8 (1)Whenthedefendantactivelyseeksorconsentstotheprematureterminationoftheproceedings(providedthathehasnotbeencausedtodosobytheoverreachingoftheprosecutionorjudge);8 8 (2)Whentheproceedingswerecausedtoterminatethroughthemisconductofdefensecounselandtherewasnofeasiblealternativetohaltingtheproceedings;and8 8 (3)Wherethereisamanifestnecessityforthedismissalelse"theendsofpublicjusticewouldotherwisebedefeated."Statev.MichaelWayneDownsandStephenAnthonyDowns,No.88275III,slipop.at7(Tenn.Crim.App.,atNashville,Nov.71989),app.grantedandaff'donunrelatedissue,Statev.Bryant,805S.W.2d762(Tenn.1991)(citationsomitted).  Here,however,thepetitionerwasneverinjeopardy.Thecitycourtmusthavehadjurisdictionoverthecriminalprosecutionof"feloniousoperationofamotorvehicle"inorderforthepetitionertoshowthatjeopardyhadattached."[A]municipalorcorporationcourthasnojurisdictiontohearcasesbaseduponviolationofStatestatutesunlesstheLegislaturehasexpresslyconfereredsuchjurisdictionuponsuchcourt."Hillv.Stateexrel.Phillips,392S.W.2d950,952(Tenn.1965).TennesseeCodeAnnotatedsection621501definesthejurisdictionofmunicipalcourts.Whilethesecourtshavebeengrantedjurisdictionovermostmisdemeanorcrimes N   כ,theydonothaveauthoritytohearfelonycases.Thepetitionercontendshischargeincitycourtwasafelony;inourview,theChattanoogaCitycourtdidnothavejurisdictiontoadjudicatethecase.Thus,defensecounselcouldnothavebeenineffectivebyfailingtoraisetheissueofdoublejeopardy.
