FACTS    OnJuly21,1993,aDistrictCourtgrantedtheappelleehabeascorpusrelief.Theorderprovidedthat:8 Thestateshallhave60daysinwhichtoscheduleanewtrial,failingwhich,allchargesagainstthepetitionerwillbedismissed.Pendingsuchnewtrialand/orappealtotheCourtofAppealsofthisorder,unlessstayed,thepetitionershallbeadmittedtopersonalrecognizancebondintheamountof$10,000.00.ThestateappealedtheissuanceofhabeascorpusrelieftotheSixthCircuit.Onappeal,thestateraisedtwoissues:8 1.Whethertheappellee'spetitionwasanabuseofwrit,and8 2.Whethertheappelleereceivedineffectiveassistanceofcounselduringhissecondtrial. PriortotheSixthCircuit'sdisposition,thestatemovedtheDistrictCourtfor"astaypendingappeal."Themotionwasdenied.ThestatesubsequentlymovedtheSixthCircuitto"staythedistrictcourt'sorderreleasingthepetitionerandorderthepetitionerreturnedtocustody." 0   ׀OnAugust11,1993,theSixthCircuitdeniedthestate'smotionforastayoftheappellee'sreleasefromincarceration.OnFebruary22,1995,theSixthCircuitaffirmedtheDistrictCourt'sissuanceofhabeascorpusrelief.MandatewasissuedonMarch16,1995. OnMay1,1995,thestaterequestedaTennesseestatecourttodocketappellee'scaseforretrial.TheappelleerespondedwithaMotiontoDismissassertingthat:(1)onJuly21,1993,theDistrictCourtgrantedthestate60dayswithinwhichtoscheduleanewtrial,"failingwhich,allcharges"wouldbedismissed;(2)theorderwasnotstayed;(3)thestate'stimewithinwhichtorescheduleanewtrialhadelapsed;and(4)thestatewas,therefore,barredfromretryinghim.Thestate'sposturewasthatthe60dayswereheldinabeyanceuntilissuanceoftheSixthCircuit'smandateonMarch16,1995. TheTennesseetrialcourtgrantedtheappellee'smotionfinding: `  z p8  ItistherulingoftheCourtthattheoriginalmandatetoretrythedefendantasofJuly21,1993wasinfullforceandeffectandneverstayed.TherewasnoeffortmadeeithertodismissthiscaseorscheduleitfortrialandatthispointtheCourtisobligedtodismissthedefendant'scasepursuanttotheordersoftheUnitedStatesDistrictCourtfortheMiddleDistrictofTennesseeandsubsequentaffirmationoftheSixthCircuitCourtofAppeals.8  ITISTHEREFOREORDEREDthattheabovecaptionedcausebedismissedforfailureoftimelyschedulingofanewtrial.Thetrialjudge,however,declinedtoruleastowhetherthestatewasbarredfromreindictingtheappellee.Theinstantappealproceedsfromthisdismissal. Duringtheinterimofthisappeal,thestatefiledaFed.R.Civ.P.,Rule60,motionintheDistrictCourt.Themotionsoughtrelieffromthe1993order"totheextentthatitpurport[ed]tobartheStatefromretryingthePetitioner."Inthealternative,thestaterequestedaclarificationofthe1993order.TheDistrictCourtdeniedthestate'srequestforreliefandnotedthatthestatewasimproperlyattemptingtouseRule60toraiseanissuethatshouldhavebeenraisedondirectappeal.Inaddressingthestate'salternativerequestforclarification,theDistrictCourtresponded:8 Finally,respondentseeks"clarification"oftheorderofJuly21,1993.ThisCourtcannotspeakmoreplainlythanitdidinthatorder.  LEGALANALYSIS    Thestatearguesthatthetrialjudgeabusedherdiscretionindismissingtheindictment.Thestate'sargumentispremisedupontwocontentions:(1)theDistrictCourtwaswithoutjurisdictiontobarreprosecution,and(2)the1993orderwasambiguousanddidnotpreventreprosecution. Federalcourtsarevested"thelargestpowertocontrolanddirecttheformofjudgmenttobeenteredincasesbroughtbeforeitonhabeascorpus."Hiltonv.Braunskill,481U.S.770,775(1987).Permanentdischargemay,intheappropriatecase,bewarranted.Burtonv.Johnson,975F.2d690,693(10thCir.1992). TheDistrictCourt'sconditionalorderwasanappealablefinaljudgment.Thestate,however,failedtochallengetheremedy'sproprietyondirectappeal.Accordingly,thestatehaswaivedanyissuesregarding:(1)theproprietyoftheconditionalorder,and(2)the"jurisdiction"oftheDistrictCourttodismissallchargesifconditionswerenotmet. Thestate'sargumentthatthetrialjudgeabusedherdiscretioniswithoutmerit.The1993orderstatedthatallchargeswouldbedismissedifthestatedidnotrescheduleanewtrialwithin60days.Absentagrantofastay,the1993judgmentbecameenforceable"10daysafteritsentry."SeeFed.R.Civ.P.,Rule62(a).Theorderwasnotstayedandthestateneglectedtorescheduleanewtrialuntil1995.Thetrialjudge,therefore,didnotabuseherdiscretionbyfollowingthefederalmandateanddismissingthecharges. WefurthernotethatclarificationoftheDistrictCourt'sorderisnotwithinourprovince.However,thestatefiledaRule60motionspecificallyrequestingrelieffromthebaroffuturereprosecution.TheDistrictCourtdeclinedtoprovidesuchrelief.Accordingly,wemustassumethatabsentfurtherguidanceorclarification,theDistrictCourthaspermanentlybarredreprosecutionoftheappellee'sindictmentstemmingfromthe1977rapecharges. 1   ׀ToholdotherwisewouldcontravenetheapparentintentionsoftheDistrictCourt.
