Weaffirm. OnFebruary26,1985,theappellantpledguiltytorobberywithadeadlyweaponandwassentencedtofortyyearsasarangeIIoffender.Nodirectappealwastakenbytheappellantfromthejudgmentofconviction.OnDecember14,1994,theappellantfiledaprosepetitionseekingpostconvictionrelief.Theappellantspetitionraisedtheclaimsof(1)involuntaryguiltyplea,(2)ineffectiveassistanceofcounsel,and(3)improperenhancementasarangeIIoffender. (   ׀Thepostconvictioncourtappointedcounseltorepresenttheappellantandtomakeanynecessaryamendmentstothepetition.Atascheduledhearing,appointedcounselconcededtheStatesdefensethattheappellantsclaimwasbarredbythestatuteoflimitation.Moreover,appointedcounselstatedthat,despitediligentefforts,hewasunabletofindanexceptiontothethreeyearstatuteoflimitation.ThecourtdismissedthepetitionasbeingϜtimebarred. /   כ Onappeal,theappellant,relyingonWatkinsv.State,903S.W.2d302(Tenn.1995),suggeststhatanexceptiontothethreeyearstatuteoflimitationsmayapplytothiscase.InWatkins,thesupremecourtrecognizedthatthestatuteistolledforapersonwhoisofunsoundmindatthetimethecauseofactionaccrues.Accordingly,theappellantarguesthathe couldverywellhavebeenlaboringundersomementalinfirmityduringthetimeperiodwhenthestatutetolled.Thisargumentismisplacedfortworeasons:(1)thereisnoproofintherecordbeforeusthattheappellantwassufferingorhaseversufferedfromamentalillnessand(2)thisissueisraisedforthefirsttimeonappealandis,therefore,waived.SeeRule36Tenn.R.App.P.andButlerv.State,789S.W.2d898(Tenn.1990). Additionally,weagreewiththepostconvictioncourtsdeterminationthatthepetitionistimebarred.Onthedatetheappellantenteredhisguiltyplea,nostatuteoflimitationforpostconvictionproceedingshadbeenenacted.ThelegislatureestablishedathreeyearstatuteoflimitationsonJuly1,1986.Thus,theappellanthaduntilJuly1,1989,tofileanysuchpetition.SeeTenn.CodeAnn.4030102(repealed1995).ThepetitionwasfiledonDecember14,1994.Moreover,noexceptiontothestatuteoflimitationisapplicableinthepresentcase.
