ðsixteenth.ðð€ÌÌà ` àWalton€testified€that€after€she€called€Appellant€on€June€28,€1995,€AppellantÏcame€to€Waltonððs€apartment€and€asked€what€she€wanted.€€When€Walton€toldÏAppellant€that€she€wanted€a€ð ðsixteenth,ðð€Appellant€placed€a€quantity€of€cocaineÏon€the€table.€€When€Walton€recognized€that€the€amount€was€not€a€full€ð ðsixteenth,ððÏshe€told€Appellant€that€she€would€pay€him€$60€for€the€amount.€€Appellant€thenÏplaced€some€additional€cocaine€on€the€table€and€Walton€paid€him€$80.€€WaltonÏtestified€that€when€Appellant€retrieved€the€additional€amount€of€cocaine,€sheÐ Æ9f01 Ðcould€see€that€Appellant€was€carrying€more€cocaine€than€the€amount€that€he€soldÏto€her.€€Walton€also€testified€that€she€paid€$80€to€Appellant€for€a€ð ðsixteenthðð€ofÏcocaine€on€July€6,€1995.€ÌÌà ` àWalton€testified€that€although€she€had€known€Appellant€for€several€years,Ïshe€had€never€used€drugs€with€him€at€any€time.€€Walton€also€testified€that€whenÏshe€purchased€cocaine€from€Appellant€on€June€28€and€July€6,€1995,€AppellantÏnever€gave€any€indication€that€he€wanted€to€use€the€cocaine€with€her.€ò àAgent€William€Stanton€of€the€Tennessee€Bureau€of€Investigation€testifiedÏthat€the€substance€Walton€obtained€from€Appellant€on€June€28,€1995,€was€.4Ïgrams€of€cocaine€base.€€Agent€Stanton€also€testified€that€the€substance€WaltonÏobtained€from€Appellant€on€July€6,€1995,€was€.5€grams€of€cocaine€base.€ò àAppellant€testified€that€on€June€28,€1995,€he€took€some€drugs€to€Walton,Ïshe€gave€him€$60,€and€he€then€left€the€residence.€€Appellant€also€testified€that€onÏJuly€6,€1995,€he€took€some€cocaine€to€Walton,€she€paid€him€some€money€for€it,Ïand€he€then€left€the€residence.€€Appellant€testified€that€on€both€occasions,€heÏbelieved€that€he€and€Walton€would€smoke€the€cocaine€together.€ÌÌà@XX®àò òII.€€SUFFICIENCY€OF€THE€EVIDENCEó óˆÐ  0À&( ÐÌà ` àAppellant€contends€that€the€evidence€was€insufficient€to€support€hisÏconvictions€for€two€counts€of€selling€cocaine.€€We€disagree.Ìâ âÐ ð7.0 Ðà ` àWhen€an€appellant€challenges€the€sufficiency€of€the€evidence,€this€CourtÏâ âis€obliged€to€review€that€challenge€according€to€certain€well-settled€principles.€€AÏverdict€of€guilty€by€the€jury,€approved€by€the€trial€judge,€accredits€the€testimonyÏof€the€Stateððs€witnesses€and€resolves€all€conflicts€in€the€testimony€in€favor€of€theÏState.€€òòState€v.€Cazesóó,€875€S.W.2d€253,€259€(Tenn.€1994).€€Although€an€accusedÐ ÐCode€Ann.€ðððð€39„17„417(a)(3),€(c)(2);€39„17„408(b)(4)€(1997€&€Supp.€1998).€ÏAppellant€concedes€that€on€both€June€28€and€July€6,€1995,€he€provided€WaltonÏwith€cocaine€in€exchange€for€money.€€Appellant€argues,€however,€that€theÏevidence€only€supported€convictions€for€casual€exchange€of€a€controlledÏsubstance.€€òòSeeóó€Tenn.€Code€Ann.€ðð€39„17„418(a)€(1997)€(ð ðIt€is€an€offense€for€aÐ ð  Ðperson€to€.€.€.€casually€exchange€a€controlled€substance.ðð).€€Specifically,ÏAppellant€contends€that€these€were€casual€exchanges€because€he€alleges€thatÏonly€a€small€amount€of€money€was€exchanged,€only€a€small€amount€of€cocaineÏwas€involved,€and€Appellant€believed€that€he€would€be€using€part€of€the€cocaineÏhimself.€€However,€in€òòState€v.€Careyóó,€914€S.W.2d€93,€96€(Tenn.€Crim.€App.€1995),Ð   @ Ðthis€Court€stated€that€a€ð ðcasual€exchangeðð€can€only€occur€ð ðwhen€the€transfer€ofÏthe€controlled€substance€is€made€without€design.ðð€€In€this€case,€the€StateððsÏevidence€shows€that€on€both€June€28€and€July€6,€1995,€Walton€called€AppellantððsÏpager€number,€Appellant€called€Walton€on€the€telephone,€Walton€told€AppellantÏthat€she€wanted€to€buy€a€ð ðsixteenth,ðð€Appellant€responded€by€bringing€a€quantityÏof€cocaine€to€Waltonððs€residence,€Walton€paid€$80€to€Appellant€for€the€cocaine,Ïand€Appellant€took€the€money€and€left.€€Moreover,€Walton€testified€that€AppellantÏnever€indicated€a€desire€to€œñ8ñsuñ8ññ9ñusñ9ñe›€the€cocaine€with€her.€€This€evidence€clearlyÏestablished€that€the€sale€of€cocaine€on€both€occasions€was€by€design€and€thus,Ïwas€not€a€casual€exchange.€€òòId.óó€€Ð 4 *, ÐÌà ` àAppellant€also€contends€that€the€evidence€was€insufficient€to€support€hisÏconvictions€because€he€alleges€that€it€is€obvious€that€Walton€and€another€witnessÐ Ð9p02 Ðfor€the€State€were€not€telling€the€truth€during€their€testimony.€€However,€ð Ð35„113(13)€(1997).€€In€fact,€the€trial€court€noted€that€if€it€had€not€been€for€thisÏmitigating€evidence,€the€court€would€have€imposed€nine€or€ten€year€sentences.€ÌÌà ` àAppellant€does€not€challenge€the€application€of€enhancement€factor€(1)€andÏwe€conclude€that€it€was€properly€applied.€€Indeed,€the€record€indicates€thatÏAppellant€has€three€prior€convictions€for€the€sale€of€cocaine€and€one€priorÏconviction€for€possession€of€cocaine.ñ7ñ׃×ñ7ññ7ñ׃ àAppellant€does€challenge€the€trial€courtððs€failure€to€apply€mitigating€factorÏ(1),€that€Appellantððs€criminal€conduct€neither€caused€nor€threatened€seriousÏbodily€injury.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„113(1)€(1997).€€However,€this€CourtÐ àConsecutive€sentencing€is€governed€by€Tennessee€Code€AnnotatedÏsection€40-35-115.€€The€trial€court€has€the€discretion€to€order€consecutiveÏsentencing€if€it€finds€that€one€or€more€of€the€required€statutory€criteria€exist.€€òòStateÐ    Ðv.€Blackóó,€924€S.W.2d€912,€917€(Tenn.€Crim.€App.€1995).€€Further,€the€court€isÐ ð Ðrequired€to€determine€whether€the€consecutive€sentences€(1)€are€reasonablyÏrelated€to€the€severity€of€the€offenses€committed;€€(2)€serve€to€protect€the€publicÏfrom€further€criminal€conduct€by€the€offender;€€and€(3)€are€congruent€with€generalÏprinciples€of€sentencing.€€òòState€v.€Wilkersonóó,€905€S.W.2d€933,€939€(Tenn.€1995).ñ7ñ׃×ñ7ññ7ñ׃×ñ7ñÝ ÐAppellantððs€criminal€record€consists€of€three€prior€convictions€for€the€sale€ofÏcocaine€and€one€prior€conviction€for€possession€of€cocaine.€€In€addition,€AppellantÏadmitted€during€the€sentencing€hearing€that€he€had€been€using€illegal€drugs€forÏapproximately€seven€years€before€he€committed€the€offenses€in€this€case.€WeÐ 4°*, Ðconclude€that€the€evidence€supports€a€finding€that€Appellant€is€an€offender€whoseÏcriminal€record€is€extensive.€€ÌÌà ` àIn€this€case,€the€trial€court€made€no€express€finding€that€the€òòWilkersonóó€testÐ 0Ð Ðwas€satisfied.€€As€previously€noted,€it€is€not€clear€whether€the€òòWilkersonóó€testÐ  À Ðapplies€in€this€case.€€However,€assuming€that€òòWilkersonóó€does€apply,€we€concludeÐ °  Ðthat€the€test€is€satisfied.€€First,€the€record€indicates€that€consecutive€sentencesÏare€necessary€in€order€to€protect€the€public€from€future€criminal€misconduct€onÏthe€part€of€Appellant.€€Indeed,€Appellant€was€previously€convicted€of€four€cocaine„¼related€offenses€that€were€committed€over€a€period€of€approximately€four€yearsÏand€he€has€been€convicted€of€two€more€cocaine„related€offenses€that€wereÏcommitted€while€he€was€on€supervised€probation.€€Further,€Appellant€admittedÏthat€he€used€illegal€drugs€for€approximately€seven€years,€even€after€he€hadÏparticipated€in€a€drug„rehabilitation€program.€€This€continuing€disrespect€for€theÏlaw€indicates€that€Appellantððs€potential€for€rehabilitation€is€poor.€€In€addition,€weÏconclude€that€consecutive€sentencing€is€reasonably€related€to€the€severity€of€theÏoffenses€and€is€congruent€with€general€principles€of€sentencing.€€In€short,€we€holdÏthat€the€trial€court€did€not€abuse€its€discretion€when€it€imposed€consecutiveÏsentencing€in€this€case.€€This€issue€has€no€merit.ÌÌà
