àOn€the€evening€of€July€4,€1997,€there€was€a€break„in€at€the€KingsportÏapartment€of€the€victim,€Dexter€ññœññCarl€Morelock,ññ›ññññññ€Jr.,€during€which€an€AMT€Mark€ññœññIIIññ›ññññññ€.30Ïcaliber€carbine€pistol,€a€reloading€die,€and€two€boxes€of€.30€caliber€ammunition€wereÏstolen€from€a€bedroom€closet.€€Earlier€that€afternoon,€between€6:00€and€6:30€P.M.,Ïthe€defendant,€who€"was€drinking€pretty€heavily,"€stopped€as€he€drove€his€vehicle€byÏthe€apartment€of€the€victim.€€The€victim,€who€was€standing€in€the€front€yard,€had€justÏreturned€from€a€shooting€practice€range€and€had€in€his€possession€the€AMT€pistol.€ÏThe€weapon€was€unusual€because€it€fired€rifle€cartridges.€€The€victim,€who€hadÏknown€the€defendant€for€fifteen€or€twenty€years,€had€not€seen€him€for€two€or€threeÏyears€prior€to€the€meeting€at€the€apartment.€€When€the€defendant€saw€the€pistol,€heÏasked€the€victim€if€he€would€sell€it,€to€which€the€victim€replied,€"No,€sir."€€TheÏdefendant€then€asked€permission€to€use€the€victim's€bathroom€and€did€so,€afterÏwhich€the€victim€invited€the€defendant€to€a€July€Fourth€picnic€at€his€wife's€mother'sÏresidence.€€During€the€time€before€the€victim€and€his€wife€left€to€go€to€the€picnic,€theÏdefendant€persisted€in€his€effort€to€purchase€the€pistol.€€Although€the€victim€agreedÐ 8¸.4 Ðto€purchase€a€television€from€the€defendant€for€$75.00,€the€victim€was€adamant€thatÏthe€pistol€was€not€for€sale.€€By€then,€the€victim€had€placed€the€pistol,€a€reloading€die,Ïand€two€boxes€of€ammunition€in€a€bedroom€closet.€€The€defendant€again€asked€forÏand€received€permission€to€use€the€restroom.€€When€he€did€not€return€for€severalÏminutes,€the€victim€looked€for€the€defendant€and€discovered€him€coming€out€of€theÏbedroom€where€the€pistol€was€stored.€€At€that€point,€the€victim€directed€theÏdefendant€to€leave€the€bedroom€whereupon€both€men€left€the€apartment€to€attend€aÏpicnic.€€ÌÌà Œ àà ä àThe€defendant€stayed€at€the€picnic€for€only€a€short€period€of€time.€ÏLater,€when€the€victim€discovered€that€he€had€forgotten€fireworks€he€had€intended€toÏdisplay,€he€returned€to€his€apartment.€€As€he€approached€the€apartment€building,€heÏsaw€a€vehicle€which€resembled€that€of€the€defendant.€€When€he€walked€to€the€backÏdoor€of€his€unit,€he€found€that€the€door€was€ajar.€€The€outside€light€had€been€turnedÏoff€and€a€stone€had€been€used€to€break€the€glass.€€When€the€victim€checked€theÏinside€of€his€apartment,€he€discovered€that€ññœññonly€hisññ›ññññññ€pistol,€the€ammunition,€and€theÏreloading€die€were€missing.€€Several€other€guns,€which€were€also€stored€inside€theÏapartment,€had€not€been€stolen.ÌÌà àThe€victim€reported€the€crime€to€the€Sullivan€County€Sheriff'sÏDepartment€and€Officer€Joe€Delp€ññœññinvestigated.ññ›ññññññ€€On€the€following€Monday,€the€victimÏand€his€wife€ññœññdrove€throughout€Kingsport€lookingññ›ññññññ€for€the€ññœññdefendant.€€When€they€sawÏhim€walkingññ›ññññññ€along€Center€ññœññStreet,€theññ›ññññññ€defendant€ññœññranññ›ññññññ€but€ññœññthe€victim€caughtññ›ññññññ€up€with€himÏin€his€car.€€According€to€the€victim,€the€defendant€immediately€apologized€forÏstealing€the€pistol€and€offered€$600.00€in€restitution.€€When€the€victim€stated€that€heÏwould€rather€have€the€gun,€the€defendant€remarked€that€he€did€know€whether€heÏcould€get€it€back.€€The€defendant€never€returned€the€gun€and€never€compensatedÐ 8¸.4 Ðthe€victim€for€his€loss.€€ÌÌà Œ àà ä àThe€defendant€did€not€testify€and€offered€no€proof€at€the€trial.€€ÌÌà Œ àà ä àA€misdemeanor€theft€is€committed€when€the€value€of€the€property€isÏ$500.00€or€less€if€the€perpetrator€"with€the€intent€to€deprive€the€owner€of€property€...Ïknowingly€obtains€or€exercises€control€over€the€property€without€the€owner'sÏeffective€consent."€€Tenn.€Code€Ann.€ðððð€39„14„103,€„105.€€ÌÌà Œ àà ä àIn€this€instance,€there€was€circumstantial€evidence€that€the€defendantÏññœññenteredññ›ññ€the€apartment€of€the€victim€without€his€consent€and€for€the€purpose€ofÏcommitting€a€theft.€€Here,€of€course,€the€jury€was€entitled€to€accredit€the€testimonyÏoffered€by€the€witnesses€of€the€state€and€reject€the€defense€theory.€€The€recordÏshows€that€the€state€offered€proof€against€the€defendant€of€each€of€the€elements€ofÏtheft:€€(1)€an€intent€to€deprive€the€owner€of€the€property;€(2)€knowingly€obtainingÏcontrol€of€the€property;€and€(3)€a€failure€to€gain€the€consent€of€the€owner.€€It€was€theÏjury's€prerogative€to€accept€the€testimony€of€the€victim€who€claimed€that€theÏdefendant€acknowledged€having€stolen€and€then€having€sold€the€pistol.€€Certainly,Ïthe€accompanying€circumstances€proved€by€the€state€at€trial€ññœññtendññ›ññññññ€to€corroborate€theÏclaim.€ññœññññ›ññññññÌÌà Ðcould€be€imposed€upon€the€dangerous€offender,€as€now€defined€by€subsectionÏ(b)(4)€in€the€statute,€other€conditions€must€be€present:€€(a)€that€the€crimes€ññœññinvolveññ›ññññññÏaggravating€circumstances;€(b)€that€consecutive€sentences€are€a€necessary€meansÏto€protect€the€public€from€the€defendant;€and€(c)€that€the€term€reasonably€relates€toÏthe€severity€of€the€offenses.ÌÌà Ðcourt€reaffirmed€those€principles,€holding€that€consecutive€sentences€cannot€beÏrequired€of€the€dangerous€offender€"unless€the€terms€reasonably€relate[]€to€theÏseverity€of€the€offenses€committed€and€are€necessary€in€order€to€protect€the€publicÏ(society)€from€further€criminal€acts€by€those€persons€who€resort€to€aggravatedÏcriminal€conduct."€€The€òòWilkersonóó€decision,€which€modified€somewhat€the€strictÐ T$ô Ðfactual€guidelines€for€consecutive€sentencing€adopted€in€òòState€v.€Woodsóó,€814Ð  &À  ÐS.W.2d€378,€380€(Tenn.€Crim.€App.€1991),€described€sentencing€as€a€"humanÏprocess€that€neither€can€nor€should€be€reduced€to€a€set€of€fixed€and€mechanicalÏrules."€€òòWilkersonóó,€905€S.W.2d€at€938.€Ð „+$"& ÐÔ#† X#ªXXX#ªÊ*#ÔÔ‡X#ªXX X#ªÔÌÔ#† X#ªXXX#ªêC#Ôà Œ àà ä àInitially,€the€defendant€concedes€that€the€trial€court,€which€found€five€Ð /¼%* Ðenhancement€factors€applicable,€properly€determined€the€presence€of€fourÏenhancement€factors€under€Tenn.€Code€Ann.€ðð€40„35„114:€€(1)€a€previous€criminalÏhistory€of€criminal€convictions€...€in€addition€to€those€necessary€to€establish€theÏappropriate€range;€(8)€a€previous€history€of€unwillingness€to€comply€with€theÏconditions€of€a€sentence€involving€release€in€the€community;€(13)€(B)€€the€felony€wasÐ 8¸.4 Ðcommitted€while€on€...€parole;€and€(20)€that€the€defendant€was€adjudicated€to€haveÏcommitted€a€delinquent€act€as€a€juvenile€that€would€have€constituted€a€felony€ifÏcommitted€by€an€adult.€€ÌÌà Œ àThe€defendant€argues€that€he€did€not€violate€a€position€of€private€trust,Ïas€adjudged€by€the€trial€court,€€because,€in€fact,€the€victim€did€not€actually€entrustÏthe€victim€with€the€items€stolen€and€was€so€suspicious€of€his€behavior€that€he€soughtÏout€the€defendant€after€the€latter's€second€trip€to€the€restroom.€€The€defendant€alsoÏcontends€that€the€trial€court€did€not€give€sufficient€weight€to€a€mitigating€factor,€Tenn.ÏCode€Ann.€ðð€40„35„113(1),€that€"the€defendant's€criminal€conduct€neither€causedÏññœññnorññ›ññ€threatened€serious€ññœññbodily€injury."ññ›ññññññ€€ÌÌà Œ àà ä àAs€a€Range€II€offender,€the€defendant€could€have€received€a€sentenceÏas€little€as€six€years€and€as€much€as€ten€years.€€The€record€demonstrates€that€theÏtrial€court€carefully€considered€each€of€the€enhancement€factors€and€expressedÏparticular€concern€about€the€defendant's€prior€criminal€history€and€his€failure,€on€aÏnumber€of€occasions,€to€comply€with€a€sentence€involving€release€into€theÏcommunity.€€Those€factors,€in€our€view,€would€warrant€an€enhanced€sentence.ÏMoreover,€there€was€a€violation€of€private€trust.€€The€defendant€and€the€victim€hadÏbeen€in€high€school€together€and€had€known€each€other€for€over€twenty€years.€€TheÏvictim€invited€the€defendant€into€his€home€based€upon€their€long€acquaintanceship,Ïconsented€to€his€use€of€the€restroom€facilities,€and€invited€him€to€attend€anÏIndependence€Day€picnic€at€his€mother„in„law's€residence.€€The€defendant,€in€ourÏview,€took€advantage€of€the€knowledge€he€had€acquired€through€the€relationshipÏboth€to€identify€the€items€he€desired€and€to€enter€the€apartment€to€commit€a€theft€atÏa€time€he€knew€the€victim€and€his€wife€would€be€absent.€€While€the€recordÏdemonstrates€that€the€trial€court€gave€little€weight€to€the€trust€factor,€this€courtÐ 8¸.4 Ðconcludes€that€there€was€sufficient€evidence€of€a€violation€of€private€trust.€€ÌÌà Œ àà ä àFurthermore,€the€record€shows€that€the€trial€court€did,€in€fact,€giveÏsome€weight€to€the€ññœññmitigatiñ”ñoñ”ñnñ•ñgñ•ñññ›ññññññ€factor€identified€by€the€defendant€ññœñññ–ñ(iñ–ññ—ññ–ñ/ñ–ññ—ññ˜ñ.e.,€ñ˜ññ™ñthe€absence€ofÏserious€bodily€harm)€ñ™ñbutññ›ññññññ€concluded€ññœññññœññthat€thatññ›ññññ›ññ€should€not€lessen€the€sentence€fromÏten€years.€€That,€in€our€view,€was€a€proper€exercise€of€discretion.€€The€conclusion€isÏpresumptively€correct€and€one€that€this€court€will€not€disturb.€€ÌÌà àFinally,€the€defendant€argues€that€the€trial€court€erred€by€determiningÏthat€the€defendant€was€a€professional€criminal€and€by€finding€his€prior€record€ofÏññœñññšñcriminal›Ïrecord›€of›Ïñšñcriminalññ›ññññññ€activity€was€so€extensive€as€to€warrant€consecutive€sentences.€€TheÏdefendant€submits€that€the€trial€court€erred€by€concluding€that€the€public€required€aÏperiod€of€long„term€protection€from€the€defendant€and€that€the€effective€ten„year,Ïeleven€month€and€twenty„nine€day€sentence€reasonably€related€to€the€severity€of€theÏoffenses.€€ÌÌà àThe€defendant's€criminal€history€included€a€number€of€felonyÏconvictions€and€spanned€over€a€period€of€thirteen€years.€€There€were€severalÏconvictions€for€automobile€burglary€and€felony€theft€and€two€prior€aggravatedÏburglaries.€€The€defendant€had€been€found€guilty€on€prior€occasions€of€vandalismÏand€escape.€€Whereas€the€evidence€did€not€support€the€trial€court's€conclusion€thatÏthe€defendant€had€"knowingly€devoted€[his]€life€to€criminal€acts€as€a€major€source€ofÏlivelihood,"€it€is€nonetheless€apparent€that€the€defendant€qualified€as€"an€offenderÏwhose€record€of€criminal€activity€is€extensive...."€€Tenn.€Code€Ann.€ðð40„35„¼115(B)(1)€&€(2).€€Despite€the€fact€that€the€criminal€offenses€committed€by€theÏdefendant€were,€as€argued€by€the€defendant,€"non„violent,€non„threatening€propertyÏoffenses,"€the€statute€does€not€limit€the€term€"extensive€criminal€activity"€to€purelyÐ 8¸.4 Ðviolent€crimes.€€Here,€the€ññœññdefendantñ›ñ'sñ›ñññ›ññññññ€record€was€clearly€extensive.€€ññœñññœñIn€that€regard,Ïhe€qualified€for€a€consecutive€sentence.€€ñœñInññ›ññññññ€our€view,€the€trial€court€acted€within€itsÏdiscretion€when€it€determined€that€the€aggregate€sentence€imposed€fit€the€entirety€ofÏthe€circumstances.€€€ÌÌà
